Hi Vanitha,

I filled up VAF2 form for the EC application.

But, when I went to VFS the guy told me to fill up couple of extra forms as well, like Tier1 checklist and NOC form (For getting information from third party with my consent).

I confirmed with him that I'm applying for HSMP and not Tier 1, his response was still positive about filling up the forms.

Let see, It's quiet a delay, but remember ALL WELL, THAT ENDS WELL !!

Goodluck to all the aspirants.

Regards.

Hi All,

My EC got rejected . I have applied under old rules on 8th Apr 2008...my hsmp approval date is 26th Jan 2008 I have shown 1,10,000.00 in my account and 4,90,000.00 in my wife account. total 6 lakhs.. and I have submitted no objection certificate from my wife as a sponser. I have applied EC for me as a primary applicant and my wife as a dependant. The funds are not maintained for 3 months .

BHC mentioned the reasons for rejection as :

1. I dont have 2800 pounds in my account.

2. The proof of funds I have shown is acknowledged of having more than 2800 pounds ( my wife account statement ) ....but , is not having 2800 pounds for the last 3 months by the date of application.

They didnt returned my original approval letter.

Folks here in this forum : Any suggestions how to proceed next.

Ravi

Hi Ravi,

Sorry to hear about your case.

I hope you must be having the copy of ur HSMP approval letter.

I suggest you can definitely make an appeal to BHC explaining ur case.

Just one thing to ask what was the time period for keeping funds in ur account & was it in one transaction that amount was transferred to ur wife's account?

Also, read through the guidance not thoroughly and make a point that you have valid agrument based on the facts in the notes.

Please let me know incase you require help once you get the letter from VFS.

Regards.

Hi hsmpdude,

thanks for your mail..

i have shown 490000 in my wife account . out of that 410000 is a one time transaction, that was credit just a week before filing EC. I have provided all the prrofs for that .In the visa refusal letter . they have clearly mentioned the reason as " funds not maintained for 3 months 2800 pounds " . I am feeling appealing takes time . Instead , If i apply fresh again in jul first week thats better . what letter you are talking about from vfs.

hi hsmpdude,

i have given vaf2 . bhc issues a letter visa refusal letter . in that they mention the reasons for rejecting my visa application.. in my case they mentioned the reason as " funds not maintained for last 3 months ( 2800 pounds )....

i got hsmp approval - 26th jan

applied for ec - 8th apr under old rules , vaf2

ec rejected - 13 th may

courier received - 17th may

so i am feeling the best thing is already from apr 1st , i have the funds in the accounts . if i wait another 40 days ..three months period will be completed . so i can apply fresh for ec under new rules in jul first week...

infact no one guided well . before applying i took confirmation from vfs and also i personally visited vfs , hyd to confirm.they told that i need to apply under old rules....

Hi aabcd1234,

No update so far.....

I'm really very tensed because of Ravi's rejection, but I doubt his rejection was because he didn't maintain funds in his own account and not for 3 months balance. Since Venky got his approval even though he showed amount in his account just few days before an application.

Things are very dicey and it's VFS who is responsible, if they wanted us to maintain the balance then they should not have accepted VAF2 form.

Comments.

Hi hsmpdude,

They have clearly mentioned in the refusal letter that

" we accept that you have funds more than 2800 pounds in your bank accounts , but as per new rules it need to be maintained for 3 months before you apply " . since you didnt maintained funds for 3 months , we are rejecting your visa application ".

Yes, we all are cheated by VFS . I dont know why VFS officers are not up to date with information . they are just wasting our time and money ..

Dear Ravi

I suggest you to go to VFS office and fight for your case. You can threaten them that you can drag them to the court as the mistake has happened on their part and you cannt be held responsible for it.

Hi hsmpdude

I collected my passport from VFS today.

It says rejection and the reason is the same that you did not maintain 2800 pounds for last 3 months..

see the below link
http://www.immigrationboards.com/viewtopic.php?t=13385&postdays=0&postorder=asc&start=120&sid=c7e78d184b243dd8a5638ef2dc0a6f41

everybody is getting rejection letter from them whosoever applied after 1st april with old vaf2 form.

Anyway, good luck to you.

Hi All,

I applied for my EC on 5th of may, just before 2 days of my hsmp approval expiry date.

I applied under old rules with VAF2 form and didn't show the funds for 3 months. I am maintaining the funds in my account from 25th of february nearly 70 days as on EC Application date.

By 24th of this month, I can show the 3 months funds in my account. please clarify the following

1. Can i take a latest bank statement on 24th of this month and send it to BHC?

2. Will BHC accepts the extra documents that we send after appying for EC before the decision has been taken?

I will need your valuable inputs, please send ASAP.

Regards,

Hi Ravi,

Your case and my case are exactly going on the same boat, Difference is just dates.

HSMP Approval - 31st Jan
Applied for EC - 23rd April
EC rejected - 15th May
Courier Recieved-16th May

I have shown more than 6Lacs, but the maintenance of 2,800 pounds was done only from last two months. There is no validity in appealing for this case. I was not aware of the rule, about the 10 points for maintenance of funds, which they stated in refusal letter.

I will re-apply after June10 by which I would have funds soaked in acc for 3 month period.

I agree that there is no proper guidance. Still we can't blame anyone, as the updates in website are clear, and we didn't notice in hurry.
I wish you apply EC and get it soon.

Hi All

I am planning to reapply for EC after 3 months.
I would like to know whether one can again apply for EC and the already approved HSMP letter still holds for 6 months or the entire process has to start again once EC get refused.

Please advice asap.

It would be great if any link from official website of BHC can be posted.

Hello all,

I have some news for the forum:

1. I personally visited VFS, Mumbai today and spoke to the supervisor over there and she said that they were not aware of the fact that VAF 9b form was suppose to be taken along with the application. (VFS: Totally unreliable)

2. After speaking to VFS, I made my hardest effort to get in touch with BHC, VISA Helpdesk....And to my surprise, I now know where does the unreliability of VFS comes from. The CSR was very scarstic and she said that VFS is not suppose to guide you for anything, they will just accept what you give. The only source of right information is UK goverment website and ideally all the information is suppose to be there.

3. After careful consideration and speaking to BHC, CSR, I confirmed with her that the decision is still not made on my application. I then went to VFS again and applied for WITHDRAWAL, faxed them and email them as well. VFS guys told me it's all upto BHC's discretion, they might consider and they may not.

4. FYI............I completed 3 months of balance in my account on May 12.

Suggestion: Anything said by VFS / BHC, suggest you to get it on the mail, so you have your backup ready.

Regards.

Guys ,

I got a confirmation mail from Deputy High Commission. Please read this :

"Sir,

As a general rule each single applicant will be required to produce evidence that they have £2,800 at their disposal. This money should be immediately available in sterling in the UK or there should be formal authority to transfer it to the UK. The funds should be in the applicant's name or in a joint account with a married, unmarried or civil partner. If it is in a savings account, the funds must have been held for at least 3 months. Should the money be in a current account the account must have been active for at least 6 months and show regular salary or other income in line with the applicant's stated occupation. If the money is held in trust it must be at the applicant's disposal and not administered by others.
Applicants must provide documentary evidence detailing the source of any funds that have entered their account(s) within the last 3 months, for example fixed deposits, receipts and/or legal documents relating to the sale of assets.

This is a mandatory requirement and the chances of relaxation are very remote.

Yours faithfully
Casework Section

Please write to me if you need any more information.

i have been a silent member in this community.
I have applied for EC at VFS mumbai with HSMP Approval letter dated 5th april 08.
HSMP approval : 5/4/08
EC applied: 17/4/08
Integra: No idea
EC decision: not yet.

I had been instructed to fill up VAF2 and VAF9A by VFS people. I also had 5lakhs balance for last 3 months before applying.
also, i have not been working for last 3-4 months due to some serious personal problem ! I am a chartered acctt and have good previous experience n earnings and savings
any idea, whether not working for last 3-4 months would cause any problem for EC?
What are the timelines thesedays..its 23 days now ..am worried !!

any one who has waited for 23 days or so and got ec approved ?

pls reply..
