Topic: Administrative Review from May 2008
Hi,
this form belongs to the people who are applied after april 2008 with new system, that means tier 1 general migrant.
Who are got refused, they have the chance to appeal, administrative review.
Please people who on the process of administrative review, please share your experince and the result here. thanks

Hello,
administrative review timeline 28 days, decision are two, one is uphold the decision, second overturn the decision.
We are not allowed to send new evidance for the existing ECO decision.

My EC got rejected because of funds not maintaining for 90 days. I got my HSMP approval on 23rd Jan, applied ec on 23rd of april.
Admin Review: They told wat ever decision the entry clearance officer taken is valid.
Note:ALmost 99% of admin review cases were rejected. Thats wat i have been told in the previous blogs.

thanks for your reply, may know the details of your refusal. Actually my case i maintain the GBP 2800 for 3 months properly, but the ECO is not checked it properly.
and one more problem is i applied on May26, after that they changed some policy on fund maintenance, that means they add one more rule, the statement date is not more then 7 days.
the statement date must less than 7 days before subbmitting the application. I collected my statement may 17, applied on may 26. I don't know what will happen in the admin.review.

the uk border agency are updating their website, regularly we can't get proper idea from that. Exactly what are the changes they are making.
Even the application centre vfs guys are not helping the application verification. Just they are making money.

I have filed for a review. My application got rejected because last date of my bank statement was 23rd may, while i applied on 4th of June. I was not aware of the rule that the max gap can only be 7 days. I am still awaiting the result of teh review decision.

PBS Tier 1 general migrant visa is not easy after april 2008, they are changing the rules regularly, so it's very difficult to fullfill their terms and conditions, so please share all your experince in this forum it's a great help to others.
Even we all able to know what are the exact things happening in that visa category. Integra screening?, I don't know exactly what is there role in this visa, what they are doing, there is no transparancy from their side. It's just like hide and seek.
Vfs office and integra is not helping the applicant in proper way, even they are not ready to provide the infromation which we are required to apply the visa.
Administrative review? How many peopls know exactly what's happening there. Even we can't track our administrative review application form.

my case similar like you i taken the bank statement may 17, applied may 26. But the ECO is not mentioned the date issue (7days), but he said the fund is not maintained 3 months, but i maintain the fund properly.

EC REFUSED, PLEASE READ EVERYBODY...
I had prior HSMP approval obtained in Feb 2008 based on UK earnings, I went to India
and submitted my application on 25th June, stating that I need to return back to the
UK on 20th July as I am currently employed.
On 17th July I received a refusal stating:
You have submitted bank statements from 04/02/2008 till 05/06/2008, however this is
not immediately preceding the date of the application
You have submitted internet bank statements from 06/06/2008 till 23/06/2008, however
this is not accompanied by a letter from the bank.
When I applied, the rules (as on 20th June) just said that you need to submit bank
statements covering a period of 3 months (did not mention any precise days), and the
rules also said that internet statements are acceptable provided they contain
account name, account number, etc.
When I look at the websites today, it says bank statements should be upto 7 days of
submission of application, and internet statements must be accompanied with a letter
from the bank. Thus they have rejected on the basis of rules introduced AFTER I
submitted the application. I have requested for an administrative review as
fortunately I had the prinouts of the rules from BIA and VFS websites.
Would you believe that I had more than 10k GBP in my bank for the past 4 months, and
moreover I am already employed in the UK.
Thus the moral of the story is that they are very very sensitive about maintenance
funds requirement, and since the application reaches the assessment officer after a
few weeks, some rules might have changed...
Guys pls be aware of these factors.

One more thing we can take personal loan and kept into our salary account and shown
as maintenance funds..?

I applied admin. review July08, they said the processing time line 28 days, i thing that's 28 working days, so i'm waiting for the result.
you can take personal loan and kept it for 3 months in your saving account. Maintain GBP 2800. I hope u read out all above mentioned cases.

Even they did not return me back around 5 months of bank statements. I have mentioned that in the review form. They would already probably have all your data in their files, because one set of photocopies is always retained by the BHC. In fact the review form mentions that you should not send any additional documents along with it.
I am not sure if this helps but good luck anyway.

we are not allow for send any additional documents to the admin.review, if you send they will return it with your application form.
In my case i send the admin. review application form with my explanation about the refusal.

Hi guys i want to share my bad news with u guys....
My visa got rejection sterday
ECO comment was bank statement was false doc so i didnt get points for previous earingins as well as no points for maintainance though i have maintained funds from 3months they have not even contacted bank. i am going to apply for Administrative Review within 2 to 3 days.
hope i get +ve result comments and suggestions plzzzzzzzzzzzz............

Hi reddy,
sorry to hear the news. Did u take the seal and signature on the statements and were they on letterheaded paper? Submitting false docs can impose a ban on u from going to UK for 10 years. If they mentioned that make sure u provide proper explanation and atleast make them take bak the false docs comment

Hi Guys,
Today I received the courier from BHC. My application has been rejected on basis that on one particular day in entire 3 months period the amount was GBP 2750 based on the exchange rate on the date of application (85.7). I had a amount 235000 in my account on 28th Apr which is more than GBP 2800 based on exchange rate on 28th Apr (79.74).
This is totally bull-shit. no one can estimate exhange rate thet what it is going be in future.
Other thing is mentioned in my refusal letter that my application has also been considered under general ground for refusal. I have no idea what does this mean. Do you all received the refusal letter mentioning the similar line when it is refused on maintenance attributes.
I received my passport back with refusal letter. I dont think it would be gud to idea to apply for admin review. because it will take hell amount of time. so i am planning to re-apply but all my original docs are still with BHC. Can someone tell me that is it possible to re-apply with just application forms, new maintenance proof and visa fee with cover letter stating that all the original docs are with BHC.
Please respond me asap.

what was the rate on the last day of bank statements. it is the one that shud count. was 28th april ur last date of ur bank statement..if yes, then they shudnt have rejeted ur app on basis of this reason

I took seal and signature on the statements they were on head letter only. Bank guys said tht they didnt got any call anyways i m just thking to apply for review i vl let u knw if i processed with anythg.

They have mentioned in my refusal letter that my application has also been considered under general ground for refusal. They have not returned my docs and they have sent a review form as well with tht. I have applied on 27th of june.

this is really a sad news, my application also refused on the basis of fund maintenance, but i applied for the admin review, but still i'm not received any result from their side, even i maintained the fund properly, they calculated wrong dates on my case.
under general ground for refusal, these words also used in my refusal letter also. In the vfs office they returned my passport and refusal letter.
they mentioned anyother reason in your application

i heard that no one is going to get original hsmp approval letter back from BHC. is it possible to reapply for EC with photocopy of hsmp approval letter?

thanks for your reply message, i applied after april 2008, on the basis of tier 1 general migrant visa, generally called PBS system.
you can ask your doubt with the vfs application centre or u can send them mail, i hope u can see the mail id from your refusal letter, mail to them they will reply.

my case is exactly same as your, i got rejection on 9 aug, statting the same things,,, they taken my ballance of 29 april,, for 181000,,, and saying it is 2272 GBP by in ma case they taken exchange rate of 29 april ony, and not that appli date i.e 16 july ,,, but on 30 april my balalce is 235000, then it will be approx 2949 GBP, as per 30 april exchnage which they agree, i dont why they taken 29 april and why not they taken 30 april,,, my application date is 16 july
they even didnt consider another bank's letter stateting that
"mr Amit has Rs 20L in his investment a/c no ............ since last 1 and half year consistantly and this amount is liquid and avilable to me as and when reqired by me,, this amount is entirly at my disposal"
same like you,, they kept all my original papers,,
they only send admin reveiw form and refusal notice with passport,,

if you are in hurry, then you have to apply fresh under tier ! with fee of Rs 51000, now you dont have to apply under transitional,,, because you HSMP date is laps,,
in latter,, there is not refulsal date mention, and no case worker name,, and date on which they given to VFS to sent us,,
VFS site say that till 6pm on 8th Aug, that app with BHC,, and at 6.30, it say that : prcessed application delivered to bluedart to deliver you,, and on 9 aug i got courier at 2pm at my address,, envlalope contain only refusal notice and passport,,
I think in admin revew, we dont go to VFS to submit,, we can sent by courier at BHC, or email and fax too.

I mean the process for the same. Mine is rejected for the bank statement date tho I had maintained more than 5.5K pounds.
Should i go in person to mumbai consulate and apply for it or I can send thesame via courier.
Also it seems no documents are need to be sent.

in my case they gave me administrative application form along with the refusal letter, i send the ad.review by courier to the chennai BHC office. may i know when u applied the pbs tier 1 visa, the application date and the bank statement dats, that means the last date of the statement.

Statment dated 30th JUne
The thing is there were no transactions after 16th June. so the last txns in the statement is on 16th June.
The EC is refused with a mention that the statement shows only till 16th June.
Checked with the bank, they said they can give a letter confirming the same.
