One correction in your response - for EC (if applying now) the VAF 9 Form has to be filled not VAF 2.

I went thru the blog and thought this is the right place to get answers to my question.
I am in UK from past 5 months, and am on allowance model (Means I am not on UK Salary structure and in India I get basic only). My indian salary is not too good and does not allow me to accumulate the required points.
Can you please let me know how should I calculate my income and when to apply? Should I consider both Indian and UK salary when I calculate for the last 5 months?
Shall I aply via consultant? or on my self?

I was discussing wiht BHC and VFS as well about the queries.
I got my approval in the month of february 2008.
I got following information from VFS and BHC.
1.We have to fill VAF 2 form and VAF 9A form as well.In VAF 9A form we have to fill only maintenance section.
2.We have to satisfy the criteria of 2800 GBP in single bank account for 3 months.
3.After that we will get 3 years visa.
I think maintenance criteria applicable for us is not fair.This is a new requirement and we have to unnecessary wait for 3 months time to apply for EC.
Even many aspiring candidates may not be able to apply because HSMP letter may expire by that time if they got it in January 2008.
So i think we should all send e-mail to british high commission saying they should put transitional arrangements for people
having HSMP approval letter.Similar arrangements are in place for UK candidates.For UK candidates till 29th June 2008,they dont have to show 800 GBP for 3 months.If 800 GBP is available in bank account at the time of applying for EC is sufficient.
So similar arrangment should be their for indian candidates as well.
I request all the candidates please bring this point to high commission's notice and request them to do fair job of applying rule for all candidates.So everybody will be benefited.
Please keep posted about the updates you get from vfs or BHC.

Did you cross check this informaion from the BIA office?
The VFS is not up to date with the information. The BIA office told me single account is not necessary. As long as the accounts are in the name of the applicant we can submit it.
I think its best to get VFS info and cross check with BIA, and inform them if incorrect information is being provided.
This is really creating a lot of confusion and will hamper our chances if the executives are not properly informed.

I got this update from VFS.They have clarified it from BIA.
If you have any feedback from BIA, Please share the feedback received from BIA ,which was saying that it can be multiple accounts?
Can we show investments done in saving account,Fixed Deposits,Mutual Fund Investments and PPF investments?
Can you please clarify,how can we show balance of different account not going below 2800 GBP for 3 months?
Because this is one of the requirement for maintenance of funds.

Also request British high commission in india to reconsider this decision and make some transitional arrangements.

HI..I called up VFS office and those guys told me that i fall under the old rules...i.e. I have to file old VAF2 form and 9A form for EC....Also, Fund Maintainance of 2800 is applicable for me.....I am bit confused about this...I applied for HSMP in mid Feb and got my approval first week on April.....HSMP approval letter is valid for 6 months out of which i HAVE to wait for another 3 months to maintain the funds in my account...

i have also applied by feb 18th and got my docs back (approval by 28th march) by 7th april. need to apply for EC now.
1. Can you please let me know what are the application forms we need to fill in and where can they be accessed? from ur post, it says VAF2, VAF9A...They also mention VAF 9B? is that also required?
2. For Fund Maintainance of 2800 GBP, is it needed to be there in our account for 3 months? Does that include our PPF , insurance (say ICICI Prudential) and NSC that we had done in the past as investments?
Maybe if we include all these, it will come to this fugure...
Kindly confirm.

all know that decision made on my HSMP application on 24/01/2008 and the same was sent to me on the same day.but still i didn't get the documents.so i want to enquiry yesterday i called HO regarding this but iam not getting the correct options iam confusing can any one help me to which options i will have to select.

i have also got approval in FEB, because of new rules i ll be waiting till july to qualify the 3 month bank balance. if we are in touch , we can be on same page for all kinds of documents before going for EC.

I have got approval in march and have applied for visa in first week of april. I confirmed from vfs that old rules will apply.
Also, they didnt tell me anything abt 2800 pounds requirement & the new form. So essentially I have declared all my assets wgich are 5K +. But my bank details has < 2800 pounds.
I am now worried after reading these posts.
Let me know if smeone gets more info.

In fact I sent a request to chennai consulate to reconsider Maintenance Fund requirement for Indian Applicants and same break should be applicable for Indian Applicants as it has been already relaxed for UK applicants who are applying before 29th June 2008.
Let them response. Will post the response if i receive any.

I have read many posts saying that people who have got the approval in April have to manitain the funds (2800) for three months and this is for Tier1 application......

What I undersatnd from the link below is that it its on our discretion that we want to file EC on the basis of our HSMP or Tier1 (Going straight to Funds Section)...
As we already have HSMP approved under old rules, we can apply for EC filling VAF2 form and need not maintain the funds for three years....(will get viza for 2 years)....We also have option of filing Tier1----going straight to Fund maintenance section of VAF9A form and getting viza for 3 years. For this we need to maintain the funds for 3 months...
Even in our approval letters it mentioned that we can apply for EC under HSMP/Tier1 (General)....
Any comments?

I sent email to chennai UK consulate couple of days back and they categorically responded that EC officers will reject the EC application for the Applicants with Approval letter under old rule if Maintenance fund is not there in bank account for 3 months.

May be you can call them ask and SPECIFICALLY about this.....I am trying to call Home office as VFS guys dont have any update on this and they are confused people...I hate there reply "To be on safer side, sir wait for 3 months: -)

--according to me means, if you apply for EC on or before 31st May (the day HSMP was closed in India), you come under old rule is HSMP, After 1st April it will be Tier1 from india.

Rules are ok, but still not clear with one thing, people who have applied for initial approval before 31st March 08 (i.e. with old HSMP rules) and waiting for approval, will they be assessed based on new EC rules or as per transitional rules? B'coz somewhere I read that the transitional rules will be applicable for those who are going to apply for EC before 29th June 08.
Any views on this?

reg the mail u received from chennai consulate, did they specifiaclly mention that the maintenance funds that should be there in the bank account for 3 months prior to application is 2800 GBP?
Bcoz one of my friend who was planning to apply told me that 2800 GBP has to be there in your account at the time of application, and 800 GBP has to be there for 3 months...

I had called up VFS banglore . They said that now form 10 & maintenance fund is compulsory, though they were not sure abt my case's outcome as it has happened in initial april & they started asking for the form after receving notification from high commision. Too much confusion.keeping fingers crossed.

Hi All,
First of all, i received response from Checnnai UK Consulate Casework team and not from VFS South Office and they mentioned "maintenance fund" i.e 2800 GBP should be there in bank account for not less than 3 months, otherwise EC officers won't accept the case.
After that, I sent another email to Chennai Consulate requesting them to re-consider the duration of having "maintenance fund" since already rule break has been given to applicants from UK who are applying before 29th june, i did not receive any response of my second email.
In this forum, some other guys contacted Mubai Consulate for same reason and waiting for response.

Thanks for the update. I too sent a mail to the Chennai consulate citing the difference in the treatment for applicants from India and UK....
It will be good if they reconsider the case for applicants from India, though not sure whether this will be possible...

VAF9A and 9B both are for main applicant. I don't think there is something similar for dependent since dependent is not require to submit the financial soundness.

you can not add ur allowances earned from UK visit for 5 month. that is part of ur daily expense not salary.
but u can add any reimbursement form ur company for this.
There is no point of going with the consulatant from India.

Am also feeling same. I got approval in january. I have 2800 GBP in my account. But if i have to maintain it for 3 months means it would be impossible applying for EC. Would you guys please furnish the email id's of Mumbai or chennai consulates so that we can contact and ask for relaxation. I have got communication from VFS in march that if i have to apply in April i don't have to whow funds for 3 months> i have based this one n didn't apply .Now if they say i have to show for 3 moonths...We will rise this issue to british consulates..

There was another case like yours , dont remeber the name of the person, he got his approval in Jan...but he did not wait for 3 months criteria and applied for EC.....in mid april
He has not got any decision yet on his .....I think even you can apply for EC as got your approval before 1st april and you fall under old rules....You should go for just VAF2 form and not VAF9.
and moreover you dont have any other option.....This is my understanding.... Regards

I have got my HSMP approval at 1st April.I have asked to Bangalore VFS office.They have replied me....
the applicants who are already holding an
HSMP approval letter is required to fill VAF-2 and VAF-9A.
In VAF-9A, the applicant required to satisfy English and the maintenance
attributes of the PBS criteria
The applicant is required to provide 6 months bank statements in which
the last 3 months should reflect 2800 GBP.
As long as the funds are held in a personal bank account covering the
3 month period and a letter from the bank accompanies the evidence of
these funds

Did u get your Hsmp approval letter from India or uk.coz i have seen the website and it says that u need to have 800 pound or above...and i have seen the website it says.
If you have been issued with an HSMP approval letter, you must now make a Tier 1 (General) - highly skilled worker application. You are automatically awarded the 75 points required to qualify under the attributes points assessment of Tier 1 (General) - highly skilled worker and the 10 points required for English language. You will still need to meet the maintenance requirement and other general requirements of Tier 1 (General).
If you already have a valid HSMP approval letter, you do not need to fill in the attributes section of the points assessment and should go straight to the maintenance section of the application form.

i went to the VFS Global , Hyderabad office today.
The enquiry person there told me that you need to show the minimum of 2800 GBP in your account, for a consecutive period of 3 months .
When I asked him that can I show the same amount by going for loan, and showing it in my account for 3 months ??,to which at first he said that , any kind of loan is not allowed, and the EMIs should not be connected to the bank statement you are showing.
But later when i asked him to cross confirm it , he asked his seniors and told me that , you can show thw loan amount in your account , but along with that u need to show the loan sanction letter and a covering letter stating the purpose and basis of the loan ( if taken against property).
My question is , i m planning to take the personal loan , and not applying on the basis of property .
Is it ok ??
Based on my salary, education and age, i m already scoring sufficient points.
I am worried , that during the interview process, i might be disqualified because i have taken loan.
Any one else with similar case ??
Also has nyone got the experience of HSMP interview , in recent days ??
If so , what kin d of quetions are asked ??

Regarding the maintenence funds- the VFS says we have to have the 2800 pounds in a single bank a/c over 90 days.
The balance cannot dip below this amount anytime during that period even if the opening and closing balance is above/ same.
Also insurance/ shares/ mutual funds/ cannot be a part of the liquid funds.
Also we cannot show family support.
This is really ridiculous because now I will have to sell shares to show money in a bank a/c which is such a waste.
Or have to wait 3 months for it to build up.
Any advise from anyone who has applied for EC recently and got it?

which center did u visit ?? because today morning itself i had been to VFS Global Hyderabad office nd what the enquiry guy clearly told me was that .. u can show insurance/ shares/ mutual funds as part of ur maintenance fund... infact he was showing me some faxed letter clearly mentioning this ...
if that is the case can the loan from bank help?? .. because i m plannig to show the maintenance fund amount by getting personal loan ... will it be ok ??

Hi Sameer,
I called the VFS office and they told me this.
I asked them about the Investments/ MF's and family support specifically- they said since the maintenence will now be under VAF 9 form, we will have to comply with those norms, and the old one has been discontinued.
Let me know if you have written confirmation of some other advise they have given.
Also I have not yet spoken to the BIA office, I think speaking to them will clarify the matter.
