Topic: Tier-1 rules - Points from previous earnings

Hi,

Has anyone noticed the new rules for earning points from the previous
earnings have been upward revised drastically? If you are in India,
earlier to get the 45 points you need to have earnings 7500+ GBP but
now the same has been revised to 40,000+ GBP.

This would mean a lot of people who used to earlier clear the points based criterion will not be able to clear it now.
Is my understanding correct or I have missed something in interpretation?

I think you didnt check for for the correct badn. this must be for Band A countries. Iam quite sure

Hi,

You have missed some thing in ineterpretaion.
You need multiply with 5.3 (for India) your earnings (after converting them to GBP) .

Hi,

Thanks for your reply...But where is this mentioned that you are supposed to multiply your earnings with 5.3 after converting them to GBP?

When I took the online point assessment test on Border and Immigration site, it asked for the country I reside in, then it asked me to convert my earnings in GBP and after that it did not say anything about the factor 5.3.

Have u taken the points calculation test on the site after 1st April?

HI,

It is mentioned in the PBS (Tier1) General policy guidelines 'Annex A -Previous Earnings Uplift Conversion Rate'.
If you are using Self assesment tool it automatically multiplies if you selct India and you will be shown figure of UK equivalent.

I am in UK , I have used this tool to help one of my friend recently.

Hi Ba..

I am slightly confused here, Are you saying calculate the gross pay per annum multiply it by GBP conversion rate and then again multiply it by 5.3? Correct me if I am wrong but previously before April 1, we use to directly multiply it with the GBP conversion rate and arrive at the points based on the result right?

Hi,
yes, you are right.

For example :
Last date of salary recieved: 31/03/2008.
Conversion Rate from oanda: 1 INR =0.01256 GBP
Your Gross Salary for 12 months: Rs. 3,00,000
After conveting to GBP : GBP 3768
UK equivalent Uplifted Gross (Multiply it with 5.3) : 19970.4

Good morning

I came across your website today and as I am looking for the right people to guide me through Tier -1 (general migrant) initial application.

I have a few queries before I can consider myself ready to go for it. I hope you may be the right person to know about it. Please forgive me, in case you consider this inappropriate on my part to have taken your precious time.

I have following concerns:

1) In the recently introduced PBS they have asked for one to have a minimum of 2800 Pounds + 1600 pounds for each of the dependants. I wonder whether one can have a joint account with the necessary funds. Will this be considered appropriate for the individual to have the available funds in the joint account with some other individual e.g. mother?
2) Are the fixed deposits are considered as available funds?
3) Can the dependant himself or herself have the required amount of 1600 pounds in his or her name?
4) Is it necessary to get the certificate from NARIC for the claiming points in the education column?

I hope I am not asking for too much.

Regarding your Q1 - I think if one of the dependant for whom you are showing 1600 GBP is your mother itself then they might consider your application and the funds as part of the fund maintenance. (Meaning you are also going to submit/apply application for your mother as dependant)

Q2 - You can always specify in the covering letter that you can break the FD and make it liquid if required. (I am sure they would understand that not everybody will want to maintain 2.4 lacs plus in savings account without any reason or purpose)

Q3 - No, its not necessary to get your certificate verified from NARIC unless you have been awarded a degree or equiavalent degree from an institution which is not recognised like an University) (Meaning if you have done your regular full time degree or PG from a regular college affiliated to some university then its not necessary)

No, if your University is listed in the Self Assessment tool.

I am applying for Tier 1 in next moth. For maintenance can I show personal Loan amt as maintanance due to this I took loan for 3 lacs. Plz let me know is it ok.

Hi guys,
I am thinking to Apply for HSMP now.I had gone through new rules and site information also but does any one know that whether now I have to show docs for that maintenance funds also as 2800 £ over 3 months while making Initial hsmp application ?? (not while applying for EC but at the time of applying Initial Application) as now they(vfs and homeoffice) are saying that new Applicants as Tier-1 should submit total fees of 600£ (400+200 £) to vfs while submitting your application.

Also, if anyone willin g to apply for Tier-1 (old hsmp) after 1st april, please let me know clear diffrences between old hsmp rules and new Tier-1 rules.

Hi,

I have been working in UK on workpermit since 2006 working on behalf of an indian company. I am getting indian salary as well in addition to UK salary.

For switching to Tier 1 general application, Can someone give me clarification on How I can show my previous earnings?

What should I choose for "Country of earnings" for Indian salary? Should it be India or UK?

Tier 1 application says "Country of earnings" should be the one where applicant is living and working. As per this,I should choose UK as country of earnings and I am not getting eligibility If I choose UK.

I am really confused on this section. Can some help in this regard?

Since HSMP Tier 1 can be made by Indian applicants from outside India after April1,2008 and particulalry UKas is mentioned in the eligibility , the band A statndard will apply. For HSMP Applicants befor ethat date the previous earnings will remain the same 7500 GBP.

I guess, I am in the same boat like u & mayb understand which Indian company u work for..:)
Like u, i don qualify for Tier-1 just based on Uk salary (allowance;)) but if i consider Inidan salary, I do..though now sure how to delacre teh same in application form..

I am trying to get this information seeking various people's help & wouldpass it on to u if I get to know something..Bt woudl rewuet you to also, kindly let me know thsi if u happen to know this first..

Dear looking4hsmp,

After 1st April,209008 only Indians who are either in UK or Abroad in any otehr country can apply for Hsmp.For those in other countires , this is open till such time the transtiional arrangements are in place and the Tier -1 takes over. Understandably, the previous earnings criteria for those are either already in UKwhich is why it has increased from the earlier 7500 GBPto 40,000 since then UK standard will be applicable. Iam dead sure there is no possibility for Indians to apply under HSMP any longer as the very basic eligibiltiy condition is the residence in Uk or extension of previous stay. Sorry guys you ahve missed the golden opportunity. I guess you can go and study in UK and then work uNunder TWES or any other scheme and then gain eligibiltiy for the Teir -1 .I don't think you can now apply under Tier-1 from India.

Hi,
I have some query about bak balance for Tier1 - of HSMP .
Is any time limit from which balance in bank account should remain.? Suppose , today, I deposited 4 lacs
Indian rupees in my bank account and tomorrow I can apply for HSMP . Will they consider this type of case ?

Please reply me if you have some idea about it .

hi All,
my 12 salary slips are according to my old salary structure ..
Very recently I got appraised and salary increased from 6 to 6.5 lacs.

If the Integra guys called, will this salary mismatch create a problem ??.
Although pointswise I am not gaining any points for the salary hike...

another thing that I want to ask is - What pound rate do they consider ??
Is it the currently prevailing one or they have set some standard??

presently i m scoring 90 points..

Hi Sameer,

Salary hike is not a prob you can mention about the same in your covering letter and can also enclose increment letter(OPTIONAL).
They consider exchange rate prevailing on the date of last salry slip.

Hi,
Was just a bit doubtful on the assessment of Previous earnings under the Tier1(General)PBS.
I'm Earning in the UK but get an Indian salary component as well ,which is shown on my payslips in pounds but goes directly to my Indian account .This part of my is included in my Gross salary in the UK (on my pay slip), It does not get reflected in the Bank Statement (UK account).
My Questions are

1. Do I show my earnings in Two Countries?If yes How?
2.If I want to show my earnings in UK alone, will my payslips along with the bank statements be enough to satisfy the two proof criterion?
My bank statements from the UK Account do not reflect the pound amounts that I get paid in India so there will be a discrepency in the proofs.My UK account gets my salary NEt of the pay in India ,Taxes,and Insurance.

Is this OK?Salary brackets are on the Gross amounts,but the corresponding bank statements are in net amounts.

Please Help!!

I am planning to apply for my Tier-1 by this month end..All my docs are almost in place just then I had this quick doubt.Just thought of getting it sorted rather than messing it up.I hope one of you will be able to help me out..

Ok..My salary slip only shows the net pay and no gross pay on it.Does the Tier-1 rules specify that the Gross pay should also be mentioned in the payslip as i got a little confused. Can anyone update me on this.

SVVJ.

If you are claiming points for gross income then the Supporting documentation must show all the relevant payments claimed by you.Your payslip and bank statements will only show net salary ..how wil you convince them about gross salary claimed...I would suggest that you must get letter from ur employer stating your mothly gross income for claimed period...to avoid any confusion...

Well in that case its not a problem but do mention it in your cover letter that you have considered your net salary for claiming points under previous earnings to avoid any confusion.

Hi All,
Can anyone of you be able to help me out on this query please?

I have a quick question here-I am appyling for tier-1 very soon.For my previous earnings category I am submitting my payslips and Bank statements.On the bank statement for one particular month, the Employer name is not fully printed.It has got cut off after the first letter.Will this create a concern during processing?Is there anything that I need to do in this regards?Do i need to get a letter from my Bank to prove this.I receive an advise of credit letter from the bank stating the details of the employer and amount credited.Will that suffice?Please update me as it is a matter of ergency..

Hi Svvj,

That i s not an issue, many of them including me dont have employer name on any bank statement , it just says June08 salary.
You can mention in your cover letter about the same, though its not going to make much diff, the idea is that net salary on ur payslip must match with that on ur bank statement. Highlight the salary credits on bank statement to make it easier for the case wroker to identify the transactions. As long as your payslips and bankstatements corroborate wid eachother their is absolutely no prob

Hi teena,
If you add,the NARIC letter,then it is easy for them to assess.I think everybody add that letter nowadays.Payslips,if it were in India,then pl check the statement,about the place of earning.I think in the earning notes,it is given that,how many months you have to be one place like that.I dont remember.Just check.
And add as many documents as possible,so that they would get convinced about your application.Pl confirm these.

Wel if you can verify your degree from BIA assesment tool then you dnt need any letter from NARIC, but you can go for it...I mean its optional..

So, I think it will work..

I am just getting a daily allowance in UK. So will my salary slips from India work?

Also, if I apply for Tier1, and I am through, are they going to cancel my work permit?

hi every1 there...i want to apply for tier 1 general and need some help regarding my application.

actually i have been student for past 4 and half years and did my masters from bolton university UK last year in 2007 which i m claiming points for. i want to claim points for my previous earning back in from 2002 to 2003 because of being student since then. i have all proof of my education here in uk and pakistan which home office is required. so all i am wondering is if i can do this and also do i need to get recognised all my qulifications from NARIC or just that one which i m claiming points for ?.

for my work experience i have wages slips from my company and tax return from tax authority. will it be considered from 2 different sources ?

Hi Nishant,

I got in touch with an immigration consultant. As we receive allowance, and dont pay taxes in UK, we cant show our UK earnings.

But yes, you can produce your Indian salary slips.

But I found that I'm unlucky to apply for the Tier1 visa, as I have 5 points less.

Try to calculate your last 12 months gross sal. It should be greater than Rs 380000/- As I had few K less, I am not eligible

Hi ya,

I am working in switzerland for the past 8 months. Previously Iworked in UK for around an year. I am planning to apply hsmp. I need to submit my previous 8 months earnings in Swiss and the rest 4 months in UK. can anyone explain me about prorata basis. How will be my application considered? Please help me in this regard. Higly appreciate your help.

Hi RK,

Have you filed taxes in UK/Swiz?
If yes, I dont think it should be a problem. You can show 8 + 4 slips as your earned inccome.
