Mine is a sub labour an received an RFE on experience.
My labour shows I need 5 yrs of experience and a qualification : degree or masters.
but I have only 4 yrs experience and have Bsc (comp sci) and MCA
Is anyone on the same boat?
any suggestions would be appreciated.

Fight till ur last breath! Sneak in some experience from an old co-worker, and suubmit affidavits or experience letters, if ur old priority date is really worth it. |

This is just a documentation process.....basically any body in an official capacity i.e. lecturer, previous supervisor, who could document on a company/school's letter head that you did some sort of project or work that would qualify the experience stated on the labor would be enough.
The key point is you need the 10months outherwise NCS will slaughter you case.
The experience must match what is on the labor.
It must be official....i.e. on a letter head, with the persons position, and their statement that they suppervised your work.
Talk to a lawyer and find out what documentation you could provide.
What did you do prior to the Masters...did you not work in your field at all.

I have only 4months gap btw Bsc(computer science) and MCA and worked for those months .
my full background is on comp science
But will the experience before masters be counted?
I am trying to get in touch with my lawyer for the documentation.(if I include my internal projects I would come up to 5 yrs)
was wondering if anyone has faced this issue:-)
Will the projects done during the course be considered as experience?

EB2 requires Master Degree or if individual does not hold Master Degree the combination of Bachelor-equivalent degree PLUS five years of experience. I think you have nothing to worry about.

The problem here is not with the EB2 , my labour shows I need to have 5yrs of eperience but I have only 4 yrs + 2months,
If i include my project experience that I have during the course it is comming upto 5 yrs.
but my concern is will the internal projects be considered?

I understand about the labor. I think your attorney will confirm that for i-140, they just need to ensure you either meet the Masters degree requirement or the combination of Bachelors with at least 5 years of experience.
Please share the good news after you speak to your attorney.

Does it say: Masters degree + 5 years of experience OR Masters degree / Bachelors degree with 5 years of experience?

Then you need either to prove Masters Degree OR Bachelors with 5 years experience.
If you are going with the Masters (which is what my impression is) you are all set and should not worry at all. If you will try to prove the Bachelors, all experience after the BS graduation - until you started to work for your company will count.
So, if you have 4 years BS you can put any part time experience during the MCA ... It is best to talk to your lawyer though. |
