Patiphone, I agree with everything you say. You are right too many Indians are getting approved everyday and ROW has very few approvals.

So despite being an Indian myself, I've sent letters to all senators, USCIS chairman, Ombudsman, the President, First Lady, Hillary, Obama as well as McCain (You never know who'll become President) stating that you instead of me should be given a GC.

And what's more, after getting your GC, I won't be surprised if you start cribbing about other things like that Indian who is on a higher position than you, that Indian who owns a more expensive home than you etc. So I've suggested to them that Per Country limit should stay not just for GC but also for EVERYTHING in the US.

And please don't worry about us Indians. We are very much used to quota system back home and will continue waiting for our green cards. As someone rightly pointed out, we are pretty patient :)

Same cr*p. Except these people actually show their chauvinism. And then accuse other people of being racist, just because they support a policy of the US, regarding immigration, that allows at least some ROWs to sneak in past the vast amount of India cases.

You show your complete ignorance about immigration matters in this post. Which jobs are not allowed to sponsor GC ? Even religious workers such as Rabbi's can get GCs (they have a seperate category though).

And if you are for equal rights for everyone, why are you cribbing about Indians in every post ? And how do you equate Employment based green card with circumstances of birth ? Employment green card prerogative lies with the Employer. If the company has 10 jobs available and if all the qualified persons they get are Indians, should the company reject them and hire someone from another country just for the sake of 'Diversity' ?

I think you ought to do your homework before you start posting such senseless messages. And my racist comment was directed to you since you called everyone chauvinist.

And by the way, Did you read the Headlines ? Trackitt website was started by an Indian to help everyone regardless of nationality, race or religion. But since you hate Indians so much, I guess you'll not be seen again. So now practice what you preach and disappear.

Where did I state that ? US is very good to India. Indian companies make millions of dollars every month on outsourcing. We are here in the US in the millions. The CEO of PepsiCo is an Indian. If you google, you'll find a list of Indians who hold top positions in the US. Bill Gates himself pleads to congress every year to increase H1B Caps just because he wants more Indians in Microsoft even though Microsoft already employs thousands of Indians.

So my question to you is, Even though you hate Indians so much, why do you want to stay in the US ? Unfortunately you'll meet many of my countrymen every where you go in the US. Your boss maybe Indian, the 7-11 Gas station where you fill gas will most probably be owned by an Indian, the hotel or motel where you stay during a long trip will most probably be owned by an Indian and so on. With your paranoia about everything Indian, you'll have a hard time handling the India-phobia.

So why do you still want a GC ?

dobraGC: You are in much better shape than a lot of other folks. You have an **approved** 140. Invoke AC-21 & move on. Professionally, what would a GC do that you cannot do with an AC-21?



With a GC you don't have to transfer visa.
blah..blah...



Jaywalking is risky. Getting out of the house is risky, hey even sitting at home could be risky. Now, with an approved 140 & a 485 pending for more than 180 days, what are the risks in invoking AC-21? Logic is probably not your forte so it is futile carrying on an argument with you :) But we have to admit that you are good at whining.

Well, the US that is NOT racist against Indians, decided on the Per-country quota. Why are you complaining that supporting it is "racist"? That makes the US racist against Indian people.

Ow... how sweet... - take it easy, Patiphone, we are all in the same boat... (even Indians...)..

Try to think positive... - you are lucky that you have filed your I-485 and now you are covered by AC21. In my time (late 90-ies, early 20-ies) - we had no PERM and labor certifications were taking 3-4 years - and it was regardless of country/category. During that time we couldn't change job, couldn't move, didn't have EAD. If company was sold/merged/moved - we had to restart everything again... So you are in a very good shape... This is how it is... You have to deal with it, live with it, accept it... - Maybe a person really has to go through some real hardships (not this pathetic: "oh my god, i'm not approved yet) to value what he/she has...

PEACE FOLKS ....

Patiphone (and many others) only has issues with Indians that the in EB2 AND Priority < then hers. She loves all other Indians EB3, EB1, blue collar, those not in the US. Ashwarya Rai (Miss Universe or Miss World), Dalip Singh (WWE Great Khali), maybe Indian food, etc. And also she has issues with people who offended her.

Hey that's understandable right? Other get to step in front of the queue. 10 years from now if the situation changes are all Romanians decide to apply to come the US. Then she would suddenly dislike Romanian, comprende?

You folks who are misreading her post need to get some help and have someone more objective read the post b4 applying.

Anyways whatever anyone say does not bother me and should not bother anyone ... everyone her is virtual ... we probably NEVER see other in real life. No trackiit user ID's are verified ... nobody knows for sure if so and so if Russian, etc, etc... an Indian could a Pakistani, etc, etc.

By the way, if you look at the 2007 stats provided by USCIS, for Employment preference, 27,419 of 154,458 immigrant visas and AOSs issued, are for India. That's actually 17.75%. Much more than 7%....and this number is much more relevant to this forum, as it is employment based.

And it has nothing to do with the fact that lately there's almost no approvals for ROWs. And in addition to the general low approvals numbers this week, gets me worried and concerned.

Oh well it is what it is ... I will sit back and patiently wait ... approval will eventually come even if is after tons of EB2 India ... are approved first.

There is no country quota on captured visas (not used in other categories) .most of them got approved in june,july 2007

Every quarter, unused visas flow from EB1->EB2->EB3 and when they do the "per-country" limit is not considered. That is the law [Section 202(a)(5)]. That is why Indians get more than 7% approvals.

Note: only EB3 ROW is retrogressed. EB1 ROW and EB2 ROW are not. India (and China) EB2 use the unused visas from ROW(EB1 and EB2).

From the April Visa Bulletin from Dept of State.

D. INDIA EMPLOYMENT SECOND PREFERENCE VISA AVAILABILITY

Section 202(a)(5) of the Immigration and Nationality Act provides that if total demand will be insufficient to use all available numbers in a particular Employment preference category in a calendar quarter, then the unused numbers may be made available without regard to the annual “per-country” limit. It has been determined that based on the current level of demand being received, primarily by Citizenship and Immigration Services Offices, there would be otherwise unused numbers in the Employment Second preference category. As a result, numbers have once again become available to the India Employment Second preference category. The rate of number use in the Employment Second preference category will continue to be monitored, and it may be necessary to make adjustments should the level of demand increase substantially.

immipassion, believe me, it is in your best interests that USCIS will be following the rules and laws. For 12 years visas were just wasted - it didn't matter if countries had or didn't have caps - visas were wasted anyway. What are you gonna say if next year India will receive 1% of approvals? Won't you go on rally and complain to get at least this 7%? Won't you complain that USCIS doesn't follow the rules? "practice what you preach" indeed :)

I actually suck at soccer... And I never had a good manager in Brazil so maybe you have a point there.

But I never said that Brazil/Equador/Argentina are better... all I said is that the fact that Indians have a bigger pool to get people from makes getting better people there easier than in other places.

I think India also has a much higher number of college graduates in IT than Brazil does... I am not comparing countries.

Basically, that is the point in question here: No one can compare countries because unless you are from Denmark (the girls are super hot there and I think its considered the best country in the world) it makes no sense to compare because all countries have good and bad things (some more good, some more bad).

Everyone here should look at the facts without taking it personally... When you say Brazil is good at soccer, the reason is because there are lots of kids living in the street and all they do is play soccer the whole day. So of course, a lot of them will become good (if they ever live long enough to become adults, or don't go to jail).

Therefore I don't think its racist to assume every Brazilian plays soccer well. Its a fact because a lot of them do, and its the national sport (also volleyball, jiujitsu and fighting in general amongst other things). All I am saying is for the people in this forum to chill and stop crying "racism" all the time, it already sucks having to listen to Al Shapner doing it all the time...

If you look at this page and use the LUD history feature on the page for todays date, seems like there has been activity but no approvals. Maybe more people approved today who are not on trackitt or immigration .com Could also be that they are conducting another sweep to get to the next batch and all the activity is related to "sweep hits".

The July & Aug '07 cases have been shipped to an asteroid. When the asteroid makes the next rendezvous, those applications will be picked up. Until then - ROW, ROW, ROW your boat ....
