Topic: Anyone efiled renwal of EAD without documents and got approved?
I have efiled my EAD renewal and even got FP notice. Its been more than 10 days since my FP is done and yet no update on the case. Is this because I did not send any documents or mere coincidence?
|
I don't know anyone who efiled renewal without documents and got approved. But you can try and let us know the results. You will find out in around 60 to 120 days whether it's an approval, denial or RFE.
|
what's the point in not sending the supporting docs?
I efiled AP on 5/1/08, got soft LUD when documents were received by uscis and another soft LUD on 5/19/08.
I'm still waiting for approval.
|
.. and it wasn't renewal, it's my first AP since my original applications got lost.
|
Could somebody who has received EAD after efile please list the steps for those of us who would like to.
Thanks

what's the point in not sending the supporting docs?
because they have all the supporting docs. I e-filed mine without sending anything, they called me to take a picture and that's it - I got my EAD.

I had my EAD renewed last year with eFile. I didn't have to send any document except for a Finger Print appointment that took care of the picture and FP on the card. I did the same thing this year and had my FP already. Waiting for kind renewal by their highness USCIS.
So bottom line, you don't have to send anything. If you get a FP notice , go and do that and sit tight. If not approved within 90 days, send expedite fax to service center or/and visit your constitutional reps(congressman or rep) and cry for help.
|
I have helped a few friends, 10 in all, efile for EAD. All have received renewal cards and never had to send any supporting docs. Even one was 1st time EAD and they received FP letter asking them to bring certain docs to appointment. Did what they were asked, docs were looked at and then given back after being copied. Got EAD 60 days later for 1st timers and within 2 months for renewals. Saying that please remember that all us July Fiasco folks are starting to apply for renewals now and the wait may get longer.
Good luck and hope this info helps.
Cheers,
LRIndy.

Thanks for your input folks. Just to clarify few...
krustycat,
I do not want to send documents if not asked. There was no mention in the instructions regarding documents to be sent when you efile.
bestia/ancientMariner,
As I mentioned earlier , is it normal NOT to have soft LUD even after 10 days after FP is done?
|
I know someone who e-filed EAD in NSC and didn't send documents.
She had RFE asking for "supporting docs" about 2 weeks later. But her case was on TSC.
Maybe that's the difference, or maybe the mood of the IO... nothing can be predictable with uscis.

1. E-File (Chose - intend to send the supporting document check box). Must read the e-file procedure, which reads that wait after clicking the payment submit option, and don't click the payment option again and again. It will charge your card everytime you click to pay, and you can't get any refund.
2. Print Receipt (it also gives you the copy of 765 filed by you online - keep 765 for your record.
3. Send the front and back page of your (a) current EAD and (b) the letter which came with EAD , and (c) receipt (NOT the 765 copy).
4. You will receive a copy of receipt in mail.
5. You will receive an FP Notice
6. You fingerprint (one soft LUD)
7. Email card production ordered (Hard LUD)
In my case
1. E-Filed, and mailed documents on May-9
2. Received receipt from USCIS May-14
3. Received FP Notice - May-16
4. Figerprinting June-4 (soft LUD on 6/4)
5. Card Production ordered July-1 (Soft LUD on 7/1, CRIS E-MAIL)
**NOTE: The letter which came with first EAD reads that if you send this - it makes easy to process the case. I believe that if your case is getting expedited by sending that document, then why not to send it.

Honestly it does not matter either you get a soft LUD or not. They have your FP in the system. For my AOS FP that happened last year july i never had a LUD but whenever I got in touch they said my FP from July'07 is in their system and looks good.

yes absolutely right.

I don't think it happens as a rule. It just the unseen/unheard forces within USCIS that deal with your case. some are lucky and some are not-either way with or without document sent.

We may request additional information or evidence, or we may request that you appear at a USCIS office for an interview or for fingerprinting.
You must file your application with all the required evidence.
If you do not submit the required evidence, it will delay the issuance of the document you are requesting.
All applications must include a copy of an official photo identity document showing your photo, name, and date of birth. (Example: a valid government-issued driver's license; passport identity page; Form I-551, Permanent Resident Card; or any other official identity document.) The copy must clearly show the photo and identity information. A Form I-94, Arrival/Departure Document, is not acceptable as a photo identity document.

For the status of your application, you can access the USCIS web site at http://www.uscis.gov.
This receipt notice provides notification of the date that your application/petition was received by USCIS. This receipt notice does NOT grant any immigration status or benefit. You may not present this receipt notice as evidence that you have been granted any immigration status or benefit. In addition, this receipt notice does not constitute evidence that your application remains pending with USCIS (i.e., that a decision to grant or deny your application/petition has not yet been made). The current status of your application/petition must be verified with USCIS.
I didn't send photos, it was listed in the required evidence but as ancientMariner said, they use the info they have from your FP. That's why they sent my son's EAD with the photo of his sister in the card.
I sent his photos along the replacement application but instead, they pulled up the case # and my daughter's photo, fp and signature came up. They used their info and produced the card.
Weird.

EAD Renewal Filed May 1 (my 485 PD PD 8 May 2003, EB3 India )
EAD Approved July 1
Recevied I-797 in mail indicating validity of one year EAD after expiry of current EAD / Card is in mail.
*I read in forum loosing time on EAD. Though we all know that there is no logic in understanding USCIS working. However, one reason for this may be submission of letter (which comes with your EAD) as supporting document. I will strongly advise anyone filing for renewal of EAD - you must send the supporting documents - especially the letter which comes with EAD. That has a bar code, and it may be allowing IOs to approve extension after the expiry of current EAD.
It was told that there is no logic, and USCIS IOs are free to take their own decisions. Though EB3 in all category is U, and India being retrogressed country is not having any hope to move beyond three to four month from last PD in one year - they should have granted TWO years EAD. But it did not happen.
Again next year I have to follow the same process......

quoted from uscis
When will applicants expect to receive the new two-year EAD?
USCIS expects to implement this initiative for cases pending on June 30, 2008. Applicants filing Form I-765 under 8 C.F.R., Section 274.a.12(c)(9) should begin to receive their two-year EAD a couple of weeks after the anticipated June 30, 2008 implementation date.
After 2 weeks... mid of July, then.

Thanks to all who provided the EAD filing information

I am now working on an approved 140 & EAD after the 180 days. Can I efile new EAD? They ask for my status - I can only see H1B - can I use this when I am no longer on H1B status. Please help.
Thanks in Advance
|
It seems that you have used AC21. Did you? If so, then it depends on you - whether you want to be on EAD or H1, and what is the wish of your employer.
As for as efile renewal of EAD - it should be within 120 days of expiry, and NOT 180 days. Therefore, if you want to efile EAD, wait for some time.
|
..and about your status is "AOS pending"
|
Have not filed AC21 because I might have to change my job again.
When you efile they ask for your current status - what do we use? Those of you who efiled please suggest.
By the by, Are we classified as an immigrant when you have filed for AOS?
Thanks again for all the answers.

I already answered your question, your status is "AOS PENDING", therefore you have to use that.
