Permie,
How did you follow up with USCIS to make sure your application was being charged under CC (UAE)?

Congrats Permie,

questions to folks here, how do you push a lazy Attorney to do the needful "to pursue USCIS when USCIS refuses to accept the CC request".

now that my Attorney has all the money ( including the money for Ac21 I filed the paper work for) claims it has done everything that could be done, fell it is like a bs, what else can the Attorney's office do.

Sort of having a thought freeze due to the frustration, so hoping you have a suggestion.

dacooldude, I did receive the copy from the Attorney of the documents they had sent out. I am pursuing the Senators office in parallel but want the Attorney to also do some work for me as they charged me for the application. I also noticed if the Attorney puts in a little effort USCIS usually resolves the issue promptly.

my Attorney's office mentioned that they have to wait for another 45 days before making a second inquiry, which I felt is another BS, so want to know the available approaches an attorney can / should take, and if my application goes south I intend to submit this to the board they got their license to practice law.

I am the primary, my spouse is dependent - who was born in UAE but is an Indian citizen.

I did two things so far:
1. Called NSC using POJ. Luckily got a very nice IO, who said that he will put in a request to get my application and make sure it gets routed to the right section. Don't know if that worked. He knew what CC is and was very good talking on phone.

2. Faxed NSC with a request letter, copy of spouse's birth certificate and the section of 485 SOP detailing what Cross Chargeability is (google for the document)

Permie,

can you post the fax number and also the page numbers you faxed,

Here's the link to the SOP - there are several version on the internet (google), but they all have this section on cross chargeability. It's a PDF, just search it for cross chargeability.
http://www.immigration.com/newsletter1/uscissopprocd.pdf

Don't have the fax number with me, but you can search this forum - just type 'NSC fax' in the google box on top and you will find it.

Hmmm... I read in another post that USCIS recalled a dependent's card because it was accidentally approved before the primary applicant. So I am holding off on celebrations until I see my approval.

I could care less about the EAD $$ - its paid by the company :) Faith with USCIS? - oh well, let's see...
I'm cautiously optimistic.

Congrats on your approval!
It could not have been faster and I hate TSC.
I don't know what's the problem with these southern adjudication centers.
When I filed my PERM back in Feb/March, it took 6 months to get approval from Atlanta center while Chicago has always been doing it in couple of days. Later I learnt, they were busy processing H2 applications so they hold off on PERM processing.
Now when I filed 140/485 at TSC during Aug, it's going to be a year with no action. I am sure they would come up with some silly reason like they are busy processing Naturalization cases. What a shame!
In my opinion there should be only one center and same rules should be applied to all applications filed at a time.
Or else count these days towards citizenship wasted due to service center's inadeptness.

Premie - I am not undermining happiness on your approval.
