Topic: Any chances of 485 approvals during retrogation of EB3-India
Posted by pnathani (20) 05 Jul 2008
Are there any chances of 485 approvals during retrogation period for EB3?
Meaning can uscis approve 485 during this time and send out notification of approvals and later once visa numbers available they actual process GC and send out actual crad?
Any chances?
And past cases related to this scenario?

You mean "retrogression" ? Well as per the exact possibility that you mention, there is no chance of that happening. You would in 99% of the cases get an approval notice and GC in one go. (the 1% deals with cases where there are only minor biometric IT issues)

Perhaps they could:

1.) Pre-adjudicate an I-485 (just waiting for a visa number from DoS). You won't get any notice since actual approval means
allocation of visa-number as well.
2.) You already had your appl. approved and visa number allocated and you will receive your approval and GC in July.

Approvals when your priority dates is retrogressed can be compared to asking a rooster to lay an egg.

Based on this I remember a joke:
A farmer has a poultry and the egg count keeps going down
One day he goes out to the farm and declares
If any of the hens lay less than 2 eggs he will cook them for dinner
The next day he goes out to check most has done so
Until he comes to one that had laid only one egg
Very angry the farmer asks "I asked for 2 eggs and why did you lay only one"
And the reply he gets "It was your pressure that I laid one egg otherwise I am a rooster"

LOL
