Topic: EAD RENEWAL :: Effective after expiry of current EAD expiry date
Posted by am36 (469) 05 Jul 2008
EAD Renewal Filed May 1 (my 485 PD PD 8 May 2003, EB3 India )
EAD Approved July 1
Recevied I-797 in mail indicating validity of one year EAD after expiry of current EAD / Card is in mail.

*I read in forum loosing time on EAD. Though we all know that there is no logic in understanding USCIS working. However, one reason for this may be submission of letter (which comes with your EAD) as supporting document. I will strongly advise anyone filing for renewal of EAD - you must send the supporting documents - especially the letter which comes with EAD. That has a bar code, and it may be allowing IOs to approve extension after the expiry of current EAD.

It was told that there is no logic, and USCIS IOs are free to take their own decisions. Though EB3 in all category is U, and India being retrogressed country is not having any hope to move beyond three to four month from last PD in one year - they should have granted TWO years EAD. But it did not happen.

Again next year I have to follow the same process......

am36: what letter do you mean? The approval letter from the original EAD? Please advise as I might use e-file for extension of AP and EAD as well. Thanks much.

am36 means the top portion of the folded card in which your new EAD was inserted inside the envelope it arrived in. That top portion is a tear-off portion and it states that one should send it with any renewal application.

That's right. I am talking about the same in which your card is tucked in / "inserted on four corner". I believe that if you use this, then you are going to get extension after expiry of current one, or otherwise the approval date will be your start date (even though you may be getting approved two month before expiry of current EAD).

Yap, they wont give you 2 yrs extension since they want you to pay another $340. My EAD will be expired on August 6th, 2008. I filled my renewal EAD on May 1st, 2008 and got approval on June 24th, 2008 (valid for one yr which is till 06/25/2009). The affective date for the new card is suppose to be 08/05/2008 but it is 06/24/08. I think USCIS is just trying to make as much as $$$ from all applicants.

Thanks guys. I found the letter with "4 corners" where the card was "tucked in". Good thing that I did not throw the letter away. You even have to save the envelope from the USCIS nowadays. Have a great weekend folks and I hope it will be our "independence day" soon.
Also, do I have to send the letter or can I just use the A# on it? How will you be mailing out documents if you are e-filing?

I sent the copy of front and back page of this letter and current EAD, and got approved within two months. Just attach a copy of reciept (which you print after online submission, and DO NOT SEND THE 765 COPY printed along the receipt. That is your copy).
