Tired of waiting. EB3 India is in pathetic situation. I guess, we need to wait till oct' 08 for any movement.

And, ofcourse there comes elections.

GCwander: I think with your PD, you should not even be thinking about GC till mid-2010. Once your PD becomes current (maybe late next year), then you should get back to Trackitt or other forums. Hanging out here will just increase your anxiety.

:-) So according to your estimate - I already waited for 5 years till now + another 2 years of waiting period. That's part of whole ridicule. This wait excludes my previous GC that had PD of April 2001, which was gone with the wind as company got closed.

Anyway, is there a way I could think of swtiching to EB2 at this stage? Or, may be I should take your advice, close my eyes and wait for another 2 years.

You could interfile and switch to EB2 but your PD is not that bad and will be worthless to do the switching. There are people here from EB3/India with '06 PD who expect their GCs in the next few months.

Another Question:

We had a LUD on our cases when we applied for I-485 and recently my wife's case has a LUD, even before we applied for EAD/AP renewals.

Does that mean anything?

Mona here. this is first time i am writing here.
I am EB3 2006. i think i have long ways to go.
EB3 Is really backed up. when i filed my GC i never paid attention to it. though i had masters degree my lawyer filed me under EB3 and he said there lot of rejections in EB2. I dont know if that was true. He said filing under EB3 is safe. God knows what is the reality. But we are all in the same boat. I think average time to get GC in EB3 is about 7 years. Thats great
what u think guys. i think we should all go back to india. Since india is getting better now. I know lot of my friends that make 50,000 a month easily and some more then that. What do u say guys

first update ur case details... u having MS DOESNT automatically qualify u for EB2..the job description( which would wht u will do after u get ur GC) should require it.. if u think ur lawyer has wronged u then get a consultation from other lawyers

so sorry to hear that ur Apr 2001 labor went down the drain! was it washed away in Dallas BEC??

if u have been here for 7-8 yeaers, u shud immed port ur MAy 2003 Eb3 PD to an Eb2, and u will become current, and have a better chance to getting the plastic!!!

No! It went to drain as Mr. Bush started processing GCs for illegal guys by stopping our processing in April 2001. I got a letter from DOL in 2004 asking me to produce proof from my company for their tax records, so that they could process my labor. Anyway it was too late to contact anyone.

Long story short, the big lesson learnt (these are basics):
- Stick to your job until you get your GC, even if you get a good reputable job
- Before applying GC you make-up your mind and once applied, don't repent your decision
- Keep your eyes and ears open and look at all possibilities before you apply your GC and during the process
- Apply GC within 1/2 years of you being in USA. By the way, I was here in USA in 1999 on H1B. I know, I wasted lots of time.

Anyway, is that true? Can I change EB3 to EB2 easily? Then give me more details.

Mona,

My in-law works for Cisco from past 6 plus years. He did his MS in Texas too.

Cisco also applied his GC in EB3. So, I think your lawyer might have done right thing.

Anyway, I am not an expert. It's just my opinion.

I liked the suggestion made to you in this thread to get second opinion from another lawyer. You can $100-200 to top immigration lawyers like Murthy or Rajiv Khanna. They are very good at advicing and advocating.

I will tell you guys a cpl of stories:

Story #1
"A guy that I know" did a no name MBA in the US. He didn't get a job in the US, went back to India. He comes back to the US 6-7 years later on L1. Company sponsors his GC on EB1. He gets his GC in a year.

Story #2
"A guy that I know" manages to get a software programming consulting job out of school at the end of 2000 and beginning of 2001(bad bad job market). Gets laid off once, gets another job, applies for his GC in EB3 in 2003, changes his job using AC21 and finally gets his GC in 2007.

I know another guy who got through EB2 with just a Masters from the US. A guy in the same company having similar education and 2 -3 years more work experience gets applied in EB3 because he wasn't able to push his case with the company lawyer.

Moral of the story:
You have to make sure that whatever you're doing is within the law. The interpretations of the law are where you can take some chances after doing due dilligence. Some people who took chances are somewhere where a lot of us want to be.

Mona darling, I save less money per month in terms of INR staying in the US than my collegue who works in a similar capacity in India; we worked together for 7 years almost & recently he shifted (1 year back) to another company in India.
BTW, my 140 is denied with BEngg & 7 years exp proof in Eb2.

u r getting to rude on me. I am just tired of all these things.
I came to US in 2001 and I am here. Believe me i know lot of people
who just have MS degree and no work experience and they file for EB2 and get things
approved. I think it is just matter of luck. anyway just forget about all these and enjoy life.
Also can anyone give me phone # of those lawyers.

Mona: Add your case details at http://www.trackitt.com/login/usa-immigration-trackers/i485-tracker1/add/ if you need any meaningful input. Depending on your PD, switching to EB2 may actually hurt you at this time.

Are you a Punjabi Mehta or Gujarati Mehta? - not that it will affect the AOS :-)

you have to convince uscis that you are eb1, if you can do it you can get it. you were not able to convince the lawyer for eb2 therefore he filed in eb3. a lot of eb3's especially roxy will eat you alive for such a post. i wanted to post this message it yesterday after reading your post. but thought it might be considered as inappropriate.

anyways roxy you can check that a lot of eb1s are also waiting for more that a year for gc

GCWander - I am also EB3-India, PD May 2003.

As you have read in the thread, we can't expect the approval within two years, based on all the pending cases with USCIS. The change process is not simple. You find an employer, who is ready to file an EB2 LC for you; then after the LC approval file I-140, and wait for one to two years because premium processing is not there for I-140. Ultimately, you are talking the approval of EB2 visa after one to two years with EB3 PD portability. However, if due to any reason, USCIS puts objection to yours fulfilling EB2 requirement, or the job profile does not suite to EB2, then all your efforts goes waste. And no one knows whether your EB3 will be safe or not, because that will depend on your relation with employer who filed EB3 application.

Therefore for our friends of EB3-India up to year 2004, I don't recommend to have a change, unless there is a possibility of I-140 premium processing. Why I am mentioning 2004, because the moment LC backlog cases, which were in BEC, get approve, the queue will be moving little faster.

For those, EB3-India applicants, whose PD is 2005 and beyond, I strongly recommend to consult a good lawyer, find an employer who is ready to file EB2 application, and switch over. If the immigration law does not change and you remain as EB3 applicant, you will have a wait time anywhere close to 10+ years from your PD.

Quick question - I am ROW EB3, PD of July 2005. Do you recommend that I switch to EB2? To me seems that it might be faster to stay on EB3 (and not to mention cheaper). Thanks for your answers.

whats going on here...I also want to change from EB2 to EB1, I want my share of advise too......






if you can tell lies about things you have not done and will never do and yet can get some recommendations, then eb1 is very easy, and you do not need the lawyer as well.

gdd can you lie that you are making a computer which can never be hacked and get some recoommendations that you are doing so. then go in corner smoke pot but don't get caught. your eb1 is sure may be a single rfe but it is sure
