Topic: F1 status and I485 Filing
Posted by dallascowboys (23) 31 Aug 2007
Hi I am in F1 status and I am going to graduate on November 17th. Since I file for I485 on july 2nd, still I didn't receive any receipt number yet, I can not file for OPT or CPT. as I read the today's article on murthy.com, they mentioned that to be in safe side try to stay in status or go to school until you get EAD or AP. so what should i do in this situation. My lawyer told me that the day when we file for your I 485 you are in status. is anybody on the same boat please share your thoughts. thanks in advance.

Hi
Just read your posting, i am also in the same situation as you F1, application reached TSC around july 2nd still waiting on EAD and AP, money order not yet cashed worried coz my money order expires in the next 20 days so crossing my fingers that they cash that damn money order before then else will be so screwed and yes, my lawyer too told me the same thing that once you file your AOS you dont have to stay in school, so i really want to get those receipt numbers for proof. FYI you are not alone i have a few friends all F1's and filed during the miracle opening same advice from their lawyers.

Out of curiosity, what have your lawyers told you about working with pending I-485 but still no EAD card?
I am in F1 also, lawyer told me I don't need EAD unless I use AP (ie I am in F1 status, can study/work but if I use AP, I will become pending AOS status and can study but can't work without EAD).
Just wondering what other lawyers are saying about F1 status with pending AOS still working based on F1 status.
