VISA AVAILABILITY FOR OCTOBER

The Mexico F2A and Employment Third preference cut-off dates are “unavailable” for both August and September, since those FY-2008 annual limits have been reached. The Visa Office had originally anticipated that this would be a temporary situation. Then with the start of the new fiscal year in October the cut-off dates would have returned to those which had applied during June. However, continued heavy demand in those categories may require the establishment of cut-off dates which are earlier than those which had applied in June. A formal decision determination of the October cut-off dates will not be possible until early September.

I may have interpreted this wromg EB3 will go back to what the the June 08 Visa bulletin dates were.

The EB2 IND going back to APR 2004 is your speculation?? or did u see it some where? some morons had said the same thing about the Spt Bulletin too.

Yes, you are right. More troubles for EB3...Nothing has been mentioned about EB2. EB3 will retrogress further down from June 08 Dates...May be to the beginning of 2001 :)

This is really bad news for EB3s, giving more frustration.

I hope won't retrogress futher, as most of them got their GCs with PD in 1999 and 2000.

Eb3 situation is really bad. Hopefully, repcaturing visa numbers will help bring bring some relief to that category.

There is a section in the FB cateogry for Philippines where the cutoff date is 1986! Are they still waiting, I wonder?

Honestly, can I tell you what is in my heart as a Eb3 immigrant....


Definately, USCIS is going to take some action and we all will get GC with in 3years, I mean all EB 's will become current.

This is the hope i have in my mind.

Can Visa's be re-capture into the next fiscal years quota? I know there is a bill out there but it still has not passed, correct?

you are correct, bill is H.R. 5882 if you read the bill full text it says

Effective Date- The amendments made by this section shall take effect on the first day of the first fiscal year that begins after the date of the enactment of this Act.

Which means it should be passed before Oct 08 so that recaptured visa's are available for 09 fiscal year else we need to wait for Oct 2009 :((

Alongwith the previous bills, a new bill has also been introduced in the Senate (S.3414) on the 8^th Aug..

why speculate and crush everyones hopes. whether Eb2 dates will stay the same or go back or Eb3 dates will go back only causes more useless worries and discussions. These are not under our control so let us just hang on and see what happens.

senate will pass the bill text month and it will come into effect by OCT bulletin...OK.

if you have luck, you may get GC very soon also.

EB3 INDIA - NO more hopes on getting GC under EB3.

I have collected VIsa dates for EB3 india frmo JAN05- till today.

12-02 will be current in 2010 or my be after if they process in this speed.

So can we have any hope on getting GC(EB3 india) ???

USCIS says that FY-2008 annual limits have been reached. It is 4 year in a row.

I personally think EB3 ROW will also suffer the outcome, right now many ppl are not qualified under EB2 or company are not willing to file under EB2 that's why they are forced to go under EB3 umbrella, but once they file for EB3 they atleast secured dates, in the near future most of them will change jobs and will be qualified under EB2, that time they will use EB3 dates porting ( this has already started), which will result Lot of EB2 from India and China, so they will use all roll overs from EB1 and EB2 from ROW, so EB3 ROW will endup being caught 'between a rock and a hard place'

what do you guys think ??

Yes, if its in same area.
ex: you applied for EB3 as software engg. after some time you apply for EB2 for Sr. software engg post which requires 5 yrs min. experiance, then you can port your PD from EB3 to EB2.
but if your EB2 is filed as software engg and EB2 is filed as Sr. Marketing executive, in that case porting is not possible.

Only 2 caveats with your strategy

1. This switch is not overnight. It takes quite some time.

2. Bigger problem is you can do this only if 140 is approved. Also now what is happening is that if you are not current, then they are not even approving 140s.

'Rock and a hard place'

This is like switching lanes. Whichever lane you switch to becomes slow :-) Also there are accidents on the road while switching lanes.

Let me be very clear - EB3 will never be current, ROW or retrogressed countries. Ping me when it does get current and prove me wrong.

under the old rule:
EB1 ROW --> EB2 ROW --> EB3 ROW -->EB2 C&I --> EB3 C&I
EB3 ROW should be current by now.
unfortuntly, the new rule is:
EB1 ROW --> EB2 ROW -->EB2 C&I --> EB3 ROW --> EB3 C&I

conclusion:
EB3 ROW might become current for a very short period IF the recapture bill pass, but not for EB3 India.

Since USCIS and DOS started to have new interpretation of the law, I stopped worrying and interpreting what's in the future for us. No more Visa Bulletin prediction from me. It's hard to do it if the rule keeps on changing.

For me, it doesn't matter anymore. I will just enjoy my EAD, which I renewed recently and hope that in the future I will get my GC.

Que Sera, Sera...whatever will be, will be! I will just cross the bridge when I get there.

Actually I am looking to get EAD, which I missed earlier due to marriage. And Nov1 in EB2 category is date what I am looking for. I am not worried if it goes back again once I apply for EAD. It doesn't matter for me if it is EAD or GC.. I think most of them who got EAD last time should be happy as they can start using it and work more hrs. or do other business.
