She says I can withdraw the application, if I don't like the process. Just a bunch of hopeless people working at USCIS.

I just said I wanted to inquire about my application and specially make sure that I-140 mess (two I-140 issues and discussed before) is behnid.

obviously i did not use the word mess :)

I said nothing to offend them.

They said they cannot tell me the status. I then ask them about the fairness issue and why visas are not issued in order. In conversation she said she didn't see any issue with the green card procedure and if I don't like the process I can withdraw the application.

The issue I see is:

1) IOs respond as an unknown identity and they seems to hang up if you ask their name or id. This should be fixed. Ultimately they are facing their "moment of truth".

2) They have no right to tell me to withdraw the application. I am not committing any crime by asking my status that is long overdue.

I am sure she is tired as I called around 4:00 pm their time. But still...

First thing they give is their name and ID. If the IO doesn't give you that, just tell that you want to speak to someone who is willing to give you his/her name and ID.

And they are correct. If you do not like the process you can withdraw. Nobody is forcing you. You cannot really make a legal complaint about it. You can only complain if they were abusive to you. And for that you will need to write with your name, address, application number, time of call etc to USCIS

I know more about IOs than anyone on this site

That is the very thing they don't give out. Secondly, they may give their name if asked. You are confusing contract CSR's with IIO's !!

Completely agree!! Don't mess with them......Looking at your details it looks like your NC is done all is good but your PD is not current then why r u calling and disturbing them? This way people with real problem don't get help from IO cause of people like you. See around you there are people waiting for last 9-10 years for GC. They need more help with their application......with 180 day rule things have become easier for many of us...imagine people stuck in NC for 3-5 years? Feel lucky and yes if you don't like the process then IO is right withdraw your application.

Folks I repeat what EB1desi is saying DO NOT CALL IO UNLESS ITS VERRYYYYY IMPORTANT.....Take a infopass if required..you don't know if you have hurt some one's GC application by irritating the IO.

I'll put into a different prospective - if they don't like our questions, they can find themselves a different job, period.

They refer to us as customers in all official papers, so we have rights too.

Why don't you complain to Ombudsman? Call USCIS and say 'Our conversation will be recorded to improve YOUR service. Beep' - send that to Ombudsman office. You will NOT get anything by complaining just here. Grow up.

If nobody is forcing us and we have no legal rights, then why have this whole hullaboo about immigration in the first place ? Why then do you ask for everyone to vote for immigration bills and support for IV ? Just let USCIS do whatever they please.

BTW, I've already posted about this "issue" - really, what do you want to know? Status of your application - you don't need even to call them to find it out: your case is pending. Name check? They can NOT give it to you because "The Privacy Act of 1974 (Public Law 93-579) prevents agencies from releasing information about you." How do they know if YOU are asking about YOUR application? That's why there is a special FORM named 'Privacy Act Release Form' - only after filing and sending out (confirmation required as well) to them this form they will be ABLE to give you that info!

I think everyone that keep calling should get this kind of respond everytime, why keep bothering them? they are the one that adjudicate our cases, and the more you call the more pay they will get because...: there are alot of calls, where they need to claim for excessive pay for excessive calls... Stop this stupid calls, don't be isane. You are professional why act like madman?

Greenlee you deserve this! and anyone does the same thing like greenlee deserve this too...

Ignore roxy -- see the tall claim "I know more about IOs than anyone on this site" -- anyway who is gonna verify that - anyone can claim so.

Going back to original issue: Before you call them have a glass of cold water and calm urself down. The system is broken to the core. THE IOs/CSRs are sometimes more clueless and frustrated than us. At least we have some vested motive in taking this pain -- for them it is easy to loose patience. Baseline: just get your work done and get out. I called at least 50 times in last one year about my I140. Finally was able to raise an SR for I140 and got a standard response in postal-mail today[ case being reviewed etc..] and online status updated to APPROVED today as well. I really doubt my raising SR prompted anything.
To keep the story from growing on: I really had to calm myself down a couple of times. I know it gets frustrating. Try all possible avenues. Remember they don't have anything to loose .... ITs us who have already invested so much time and what not.

IOs rarely gives their names. Once who do are the ones who serves us best. CSR (customer reps) always give their names.

waitting...

1a) not everyone gives such response

1b) we dont call them everyday.

2) I am waiting for 8 years for green card: 3 labor 2 I-140s and 1 I-485. I am in US for 13+ years.

If you wait for another year and you will be a madman too :) You just applied for your 485.

Really, it depends on one person job stability etc. I have no problem waiting for green card for last 8 years as I had well paid job. For last 2 years I am looking for a change and that is what is hurting me.

I really sympathize with your situation and I can very well understand it too. GC process is all about who seems to be more luckier than the other. So just wait till you get lucky. Some IO's are really helpful and some are not. If at all you call, try calling them early in the morning. The truth is there are many people who just call USCIS due to impatience and people who really need help do not get the help when needed. People have to use rationale in calling USCIS. Hope everything goes well for you.

I hope he is not implying that they are doing us a favor by working on our applications. They are getting paid to do their job and, by the way, we are paying their salaries. So don't talk about what we "deserve". If you think you would deserve such treatment under any circumtances that says a lot about your personality.

I agree with other posts that keeping cool, however difficult it might be, is the key. I am only an year into this process and I feel frustration. Its difficult for me to imagine mental state of someone who has been waiting for five years or more. Good luck and hope you get a better IO to speak to next time.
