Topic: EB3 ROW October VB Prediction
Well friends,
Now we have it. They now say EB3 will retrogress in October....I wonder how much...and how many of us ROW will be current, including myself with the PD 05/2004....
What do you think?

Personally, I dont think the EB3 ROW will retrogress much if not retrogress at all......
If USCIS had Mar 2006 cut off dates for the June 08 Bulletin with only the last quarter of visas to go, it can't be so bad once the whole new fiscal year starts with a new lot of visas.
But thats me just and my simple thinking.....who knows what USCIS is upto?

Read this sentence very carefully from todays bulletin : However, continued heavy demand in those categories may require the establishment of cut-off dates which are earlier than those which had applied in June. A formal decision determination of the October cut-off dates will not be possible until early September.
So EB3 ROW Professionals, (not other skilled workers category) was supposed to go to March 2006 PD. These jerkoffs might actually yank it back. Its totally up to them. We will find out in 1 month around September 15 what guidance USCIS gives.

Guys help understand this:
My PD is Nov. 2002 and I was current in March 2008. So, if I was current in Mar 2008 already do I still have to wait for the visa numbers to be available? What was the point being current in March 2008?
I hope the VB will not retrogress for ROW to 2001? This would be bizarre.

Yes, you do have to wait for your PD within cut-off. If you didn't get approved, it is tough luck. If E3 ROW retrogresses to June 2002, you are out of luck again.
Hey, at least your cut-off is still in the 21st century. India E3 is probably going to 199x, the previous century :--]

Thanks mygctrack. Honestly, I am thinking to lose hope in the GC. It is all bogus. Even though I have the 2002 PD who knows when the VB will move? What if it does not move for a year? Nothing surprises me with this system.

Are you guys sure the availability phrase doesn't refer to Mexico only? It says "Mexico F2A and EB3" so it's possible that they are only talking about Mexico here... Anyway maybe it's just wishful thinking on my part and EB3 ROW gets screwed again... bummer :(

I think we need to analyze the total number of EB3 backlogged appplications by year. every year only 140K or so are alloted, therefore, if we can get the total number of backlogged apps and comapre that to the recent moevements above, we can asecratin when we can get our GCs.
MY PD is jan 2006. I dont think i will get my GC for at least another 2 years.
My logic is probably flawed but these are just my thoughts.

I think that EB3 RoW will be retrogressed upto mid/late 2003.

Guys, I'm reading this stuff for a year now, but I still don't get it:
If at any time the cut-off date is for example March 2003, that means that all aplications from before that date can send their I-485 forms, right?
So after some weeks, all those people have sent their I-485s (except of a probably very small number that were missing the boat).
Then how in the world can the date ever be earlier anytime later on? Anyone before that date already sent a I-485, so if they just keep the date as is, no new applications would come in. What sense could it make to move it farther back??? (Not that US-CIS activities would need a sense to be done, but it looks like you all see some sense in it)
Can anyone enlighten me?

USCIS can do that just to get an estimate of the usage of EB3 quota left within that quarter.

so - in other words - by moving the date forward, they get more applications (=more money), and by moving it back later, they have an excuse to not process them?
seems like a money machine (in addition to time machine).
I would have thought a simple FIFO would be much more effective - everybody can send I-485 whenever he/she pleases, and you work through them in sequence. When you are out of numbers, you stop. Isn't that easier and brings the same result?
