Topic: Can H1 do side business while awaiting 485 approval (EAD is aproved and over 1 years old.)
Posted by alpha (30) 21 Sep 2008
I am on H1 with EAD approved 1 year back and still waiting for GC which might take 2 years or more. Is it legal for me to start a side business while I keep doing my H1 Job full time or I need to wait till I get me GC? anyone who has correct information on this? Will it impact negatively on my GC approval?

I asked exactly the same question to my lawyer's office a few months ago, and their answer was that should I decide doing so, my H1B status would be no longer valid, and I would have to be on AP from there on. So, I had second thoughts and forgot it.

I'm not a lawyer, and I'm just recalling a past experience. Hope it would help you to make up your mind. Patience is the name of the game. Best wishes

Actually, it is perfectly legal to start a business even on H1b...but you shouldn't get paid from the business you started (for maintaining H1 status).... You may ask....what good is doing business without making money? There are legal work ways to make this happen...just talk to your immigration attorney & a CPA....
