Topic: traveling to india after seven yrs - need help for doccuments
hi everyone,
need help form expert,
came to USA in feb 2002 I 140 got approved,h1B extension in 8th year for 3 years since I140 is approved
thinking to go india and wanted to go for H1b stamping at mumbai can some one suggest what doccument is needed do they ask the record of w-2,tax return from 2002 please advise

I think there shouldnt be any problem if you have proper paystubs and w2's, client letters etc. For list of required documents you can check with VFS-USA website. This list differ from consulate to consulate. goodluck.

I went India after 7 year, came here in Nov 2000, visited India during last december, was on 8th year H1 extention, did stamping at Mumbai, took last 5 pay stub, 5 year tax return, all the H1 extention, current employement letter and copy of 8th year H1 extention application
During stamping they asked why I am at 8th year extention so explain about pending green card application, give him a copy of
extention application and he just approved it, did not ask anything
During entry in us they asked to provide all the H1 extention to make sure stay in US was legal

I was asked for the I129 form , current paystubs and last three years w2 forms... I was also asked marriage certificate ... nothing more then that... I did not have 2000 or 2001 w2's during my visit to chennai counsulate...

they may ask regarding LC filing/140 approval.. make sure you get some documents to support this. Also check with your attorney and ask him/her to give you the whole set of documents (they should know which ones you'll need).

My advice for you is to take:
- the H1-B approval (I-797C) form, obviously;
- the H1-B application, which most likely includes a copy of your I-140 approval; what convinced CIS should be enough for the US Embassy as well...
- a copy of the I-485 receipt;
- very recent EVL (Employment Verification Letter);
- recent paychecks (if possible, all paychecks w/ the employer that sponsored the H1-B);
Also, please be aware of the PIMS delays; here's what my wife went through when she got her H-4 visa: http://www.trackitt.com/discussion-forums/i485-1/143081889/ She got lucky, but I heard of much longer delays. Make sure you have enough time... (and no I don't know what "enough" means).
On the same topic, some people suggested one could inform the US Embassy/ Consulate in advance of their planned H1-B appointment and request the PIMS checks to start earlier. I have no idea if this is possible (I didn't know about this potential possibility when my wife got her H-4); people that have done, if anyone, please chime in.
Alternatively, if you have an approved AP, valid until after your planned return, you could just return using that and still resume working for the H1-B employer w/o using your EAD.
And of course: please double-check everything with a good lawyer, don't just take somebody's word for it.
Enjoy your trip home after 7 years (!!) and don't let the H1-B thing spoil the joy. (Easier said than done, I know).

I will talk to my lawyer. I hope some one can answer how long we have to wait for GC, its just endless process
