Topic: What the heck is going on with I-140s in Nebraska?
Posted by mikey (41) 01 May 2007
Is anybody with a date beyond August 1 actually receiving any regular I-140 approvals? The date has been stuck there for quite a while, so I'm wonderiung whether it is a bogus date, or whether things have truly frozen altogether?

Also, has anybody ever had their I-485 approved BEFORE their I-140 or is this impossible? I'm asking this because theI-485 date is progressing okay and my date is just about current (I submitted it concurerntly with my I-140 last August), but the I-140 is stuck...and I think the I485 is dependent on the I-140 getting approved first. Switching to premium I-140 may be the only solution in Nebraska? Anybody in the same situation?

What I heard is that I-140s get approved first. But in any case you need to have both approved. I filed in early August and received approval for I-140 in late Jan 2007. I am still waiting for the I-485. I am not sure that by swithcing to Premium now will help you. The USCIS is currently processing Sep's I-485.
I would suggest that you call the USCIS and ask them about your I-140 right after the processing time moves to the next month. Hang in there.

Yeah, I actually was lucky enough to get I-140 approval in mid-Apr. My receipt notice date was 8/26, so I guess the USCIS is moving, but very very slowly. Now I am anxiously waiting for my I-485 approval because it seems like they are already working on cases received on 9/11.

If you've waited this long, I don't think it's worth it to switch to premium because it truly doesn't seem to speed up I-485 process.

In my understanding of the I-140/I-485 concurrent filling, the I-140 approval is the basis for the I-485 approval. So, I think it is impossible that the I-485 will be approved before the I-140. The good thing is that whenever the I-140 is approved, the approval of the I-485 should be fast due to the fact they say to be processing september cases.

Also, the Premium processing should take about 15 days to be approved and your date is current. I've seen cases at trackitt as well as other sites that has processed cases as such as september, which leads me to believe that someone should be approving your case right now. Maybe your certifying officer stop to grab lunch, talk to other employees, or is taking longer at the restroom break, but they will get back to it.

I personally wouldn't spend the time and money to seek Premium processing. My case is in Oct 2, 2006 and I am expecting to have that approved around 5/25/07.

Hope this helps

I haven't seen any I-140 approval from Nebraska within last 15 days in this forum. I am not sure why they are processing Premium cases in Nebraska when they are already behind. Texas is processing much faster. Anyone received approval within last 15 days from Nebraska?

Congratulations on your I-140 approval. My received date is September 18, 2006 and I still did not hear anything. Offically Nebraska is still finishing case from August. You are really lucky to receive the approval. I will check with my Lawyer.

VERY GOOD QUESTION MIKEY!! What the heck is going on with I-140s in Nebraska?

My receipt dates for both I-140 and I-485 is DEC 26,2006.I got my EAD and AP pretty quick, but no further progress at all, LUD shown for I-140 is Jan 2007 and for I-485 March 31 2007.
I dont know if Nebraska's processing dates are not updated or it is just a very slow center?

I just got an email notification from USCIS that my I-140 has been approved on May 21, 2007. My Lawyer did not receive anything yet since they approved yesterday. Your one will be coming soon. Good luck!

My I-140 was approved on April 24 and I received approval letter, but uscis web site shows my case as "received on October 16 and pending...." Do I need to contact with uscis to correct this information? I am just worry that this may reflect my I-485 approval if system still shows that I-140 still pending. Any suggestions would be helpful.

You can contact the USCIS Customer service and request to update the website.

I have a receipt date of January 19, 2007 for concurrent filing and based on what I'm seeing posted, there is some kind of big backlog in Nebraska. Very seriously thinking of switching to Premium Processing for the I-140. Yes I need the I-485 approved to but that clearly follows very shortly after I-140 approval.

There is an average 100-day difference between Premium and Regular processing for I-485 approvals!!!
Obviously the $1000 doesn't just affect I-140 times.

I was thinking about that too. It's been 254 days since I filed for both cases. My lawyer discoraged me though, in her thoughts soon I will hear from USCIS. I also heard that there is a huge backlog in Nebraska, though Vermont is even slower. They are still in april of 06, whereas Nebraska is in August. Texas center deserves a Hi-5 though, they are already in Feb 2007. Good job for Texas center! let's keep our fingers crossed.
