Topic: When is it safe to leave?
Posted by urlittlecat (6) 20 Jun 2007
I recently got an email from USCIS stating that my 485 is approved and I will be getting the card within 30 days. I was wondering when will it be safe for me to switch jobs after getting my GC. I've been reading different forums about this issue, but I always get mixed messages.

Some people said I am free once I get my GC, but some said at least to wait 6 months. Are there any immigration experts can tell me which one is correct? Thanks!

If you can move after your I 485 has been pending for more than 180 days under the AC21 portability act.
Once you get your green card in hand, you can do what you want.
This is my opinion, I am not a lawyer but a well read immigrant hopeful.
Cheers

I read a lot (I think so), and still don't know what is the rule of thumb. I know for sure the best situation is to stay for the years to come. But this is not the case for a lot of people who want to change jobs, get a salary increase, and so on, considering the long process to get the GC. If there is a lawyer out there, or more people who have talked to layers, your information will be appreciated. Also, when asking lawyers, challenge them by asking why people need to stay several months after getting the GC, when you can move under AC21 provisions after 6 months of filing I-485. I would say, that the safe time is min. 6 months after submitting I-485 no matter if you are still pending for approval or already got the GC.

It just doesn't make sense to me that in terms of time, you have more freedom with the EAD than with the GC.

I have read some comments by lawyers that say that after getting the GC you're free, no matter if it comes whithin 6 months of filing I-485.

I would say it's better to be cautious and wait at least the 6 months after filing I-485. This way, you can say that you did comply with the min. 6 months of AC21 (even with GC approved) that was in effect at the time you changed jobs. Lawyers out there please confirm if this is a good argument during application for Citizenship or not.

Also, anybody has heard of actual experiences of people applying for Citizenship and that have switched jobs right after getting the GC?
