Topic: Filing I485 while waiting for my H1B extension approval notice.

Hello experts, Is it safe to file I485 while I am waiting for my H1B extension approval notice?
I have applied for H1B Extension(3 years extension after completion of 6 years H1B) on 5/15/2007 and I have an approved I140.

Of course, that should be ok. Is your 6 yrs on H-1 already over? In any case, it might be sensible to include a receipt notice from USCIS that your H-1 extension is in process. Isn't your lawyer already taking care of this?

I remember asking my company lawyer that if my wife (who is on H-1 right now) quits, then can I still file my I-485? The lawyer said yes, they can file an H-4 for my wife at the same time that they file I-485. The two are independent. So you should be ok too. I wouldn't worry.

I have already completed 6 years on my H-1. Thanks a lot for your advise and the information. I have asked my lawyer already and they are going to double check if there is any risk involved. They didnt sound like risky tho.

When you say include a receipt notice , you meant include it in I485 filing right?
