Finally I can give a relief to myself. Now I'm just waiting for card to arrive.

Yes, I did receive RFE.
Its about W2, paystubs, I-120, I-94, copy old & new passports, employement letter, and tax return for the H1 periods.

Here is my detail:
I-140 & I-485 Concurrently filed on 10/30/2006 (RD).
Finger print taken on 11/18/2006.
RFE received for I-140 on 1/7/2007, replied on 2/21/2007, USCIS received on 2/28/2007.
I-140 approved in 3/5/2007.
RFE received for I-485 on 5/22/2007, replied on 6/21/2007, USCIS received on 6/28/2007.
I-485 approved in 7/5/2007.

Congrats! Wasn't 5th July the date when they made visas unavailable for all categories? I suppose you just slipped in? If I'm wrong, please explain.

The date was July 2nd, not 5th. And he's not the only one, look at the tracker, people got approved yesterday.

That's my question. How are people still being approved if no visa numbers are available?

Mine is approved today (07/10/07), so I guess they are still approving I-485 cases

According to my lawyer: no visa available for the new application filed in July 2007, but uscis have assigned visa number to all existing I-485 application filed prior July 2007.
She based her opinion on the recent progress that has happened.

It can't be "all", there are at least 400k of them (source: NBC (the GE company), 07 July 2007), but the rumor was that 60k visa numbers were assigned to applications more than 6 months old. Another rumor stated that these numbers expire after 7 days. If one understands that the 7 days are of the calendar variety, we should not have seen any approvals on July 10 or 11. If it is business days, then there should be no approvals starting on July 12. If we keep seeing approvals after that, it means that visa numbers don't really expire as rumored.

According to what I discussed with my lawyer, once USCIS gets your application, they start processing (fingerprint, name check, etc)...If evrything goes thru, then you get reccomended for approval and at that time a visa number is requested to Dept of State. Numbers are not requested prior to approval because it will expire in 7 days and get reassigned to some other case.
As it stands now, all of those Visa numbers were requested and question is if any of us are in that group.... Processing of documents will continue but if you reach approval and no new numbers are released then you will be on hold until October when new numbers become available. Two things that can happen is that we are on the group of 60K numbers requested, or some of those numbers get reassigned if process does not go thru in a particular case then somoene else gets it. If niether of those two happen, then it will be wait till October for new releases and who know how many request there will be in October...they may even have a similar situation as it happened with H1B that all avalabele numbers were gone in just a few days....that is just a thought, hope it does not become a reality.

- Are you talking about 140 RFE or for 485? Seems like you got 1 for each.
- Just wondering whether you haven't you submitted W2, paystubs, I-94, copy of old/new passports, prior year tax returns etc when you actually filed the 485? Or is that USCIS is requesting such information though its already submitted? Thanks in advance for your value reply.

I got one for each.
Both of I-140 & I-485 asked for W2, paystubs, and employment letter. I submit these twice, once for I-140, second for I-485.
Only I-485 asked for copy of passport, I-20, I-94, tax returns, and prove of legal status.

Hi, thanks for all your comments. Your above comment seem very important to me. My concurrent filing receipt date is May 08. If your lawyer's comment is valid, then you might agree that it is a very good news for me. Will it be possible for you to please re-confirm with her?

Did you NOT submitted W2, Tax Returns etc etc when you filed 485? Whats your Priority Date and your 485 is with what service center. Thanks

It isn't unusual for the concurrent case to get approve early as long as you don't receive any RFE.
