Topic: Called NSC and talked to IO today
I talked to IO this morning. I didn't ask her anything but the status. I was told that my case is waiting to be assigned to an officer. If i don't hear anything from them before April 30th, i was told to call them again.
She also mentioned about 180 days memo and told me it may take 30 to 60 days for any approval.
What do you guys think of this IO's response? My PD is Feb 2002, EB2 INDIA.
|
April VB should set India EB2 to Dec 2003. This will allow your application to be approved then. I think the IO is giving you very accurate information.
|
these information suggest that we can indeed be positive about movement in EB2 India in april bulliten!
|
I am so eager to see a forward movement in EB2. My PD is Dec-2004 (sub labor still pending USCIS approval for 8 months now)
BTW just curious on what basis do you think this might happen.

Well, 'U' means they exhausted visas for this quarter, they MUST have visas for the next one! Yes, question about cut-off date remains, but it must NOT be 'U' at least at the April beginning :)

Could you please tell us how you were able to talk directly to an IO in Nebraska. I know of POJ trick to connect to TSC but I was hoping to find smething similar for Nebraska. My case was transfered 3 months ago to Nebraska with not a single peep so far. Thanks in advance
The same phone#, the same trick. If you get transferred to TSC using POJ method, then talk to them, it means your app. has not arrived to NSC yet. My app. has been transferred to NSC as well (a long time ago), and POJ transfers me correctly to NSC.

Today I have called NSC and the IO told me that my case is pending and assign to an officer and may be I will hear something after 30 days. He also mentioned that they are riviewing all workable/ approvable cases as per the new memo and it will take few weeks to take the decision. I was trying to make it clear about the more preferences between NC cleared and NC pending for more than 180days but he just tactfully avoid to answer it by explaining me about the FBI Name Check and the new 180 days rule.
My case EB2 India, PD : Apr 2002, RD : Apr 2007.
Thanks...

It seems like each customer service reps, and IOs sets their own deadline, March10th, April 30th, 30 days. 6 months BLA, BLA, BLAH

I spoke with a pleasant female IO today using POJ method. She advised me that I am still under name check but because of the 180 day rule that my case was subject to the new review process. She did say that my other security checks were cleared without me asking.
I asked her if my case had been assigned to an officer as it is outside normal procvessing plus 30 days and my PD is current (EB3 ROW April 2003). She flipped to another screen and said that it has not been allocated to an officer yet, but that it will be swept up in the reviews they are doing right now as everything qualifies for my case to be moved forward. She finished by saying that if I do not hear by April 30th I should call back. She wished me well and said she sincerely hoped I would hear before that date.
April 30th is the new March 10th :-)

Well, I had read on Murthy that the U was for the entire fiscal year...and numbers will be available again in Oct 08...but u guys really seem very positive about the EB2 dates moving forward...well, that's how we can survive with USCIS by always trying to be positive...

"The law limits the issuance of visas in any of the first three fiscal quarters to 27% of the annual quota"

April 30th is the new March 10th :-)
I have gotten April 30, 2008 from NSC on my numerous phone calls and something to the effect of "here at NSC not all eligible cases will be done so a realistic date is Apr. 30". My FPs were refreshed recently by NSC in the last week of Feb. without any second FP appointment.

Visa bulletin pages on U.S. State dept used to have this rule of 27% quote in quarter listed until last year but it is removed from there. So i think the rule is changed and they have used up all quote for the year. New quote will be available in Oct 2008 unless they get quote from EB1.

sounds good and promising...but let us see what USCIS does...

Well then according to this, then in June 08 we will have 27% visas available for EB2...if not 40%...

It's amazing that people are still calling even though they know very well that EB2 India is unavailable for now. Many Trackitt members continue to amuse me. :)

"the quota was exhausted for the entire fiscal year - not just the quarter."
kaisersose,
You are not giving hope to EB2 Indians?! The truth is painful, but it's better for them to "dream" and "hope" than to despair! :)
