Topic: Is processing times based on Notice Date ?

The Processing times which is due for update anytime now.
Is it based on ND or RD ?
My RD is July 17, but ND is Aug 15 and when I call up on phone or check status, it says ON AUG 15, we received your 485.

So it looks like this ND is really the internal RD .

Any opinions ???? experiences ???

Its receipt date not Notice date? It was the day they got our applications.

Burbak,

yes but it was their fault. They had a lot of applications received with less people thats why they had a hard time coping up with bulk of papers to encode/feed on their system. The discrepancies of dates comes out becoz of those circumstances.

my ND is 2 months after RD... so I would be happy if they follow RD.. but again its the same thing.. RD would be in the same order as ND

IMHO, its most likely ND. The only time RD comes into play is for counting purposes, i.e. 180 days for AC21. Just on Trackitt, I have seen some cases where people with RD before me, ended up with ND after me. Opposite also true, I have seen cases where people with RD after me, ended up with ND before me!

For processing time standpoint, I believe they go by ND. Which means, service request can only be opened when ND is 30 days past published processing times.

yup, the receipt date that uscis considers is between just a day or two before your ND (just check your case status online and it will say when uscis "received" your application). i've seen threads/posts here where the IO has confirmed over the phone that it is the ND or the date on the online case status that they consider as your receipt date. also, you might want to look at burkino's post regarding how uscis enter's our files into their system.

I agree with you, it is their fault. There are several memos in USCIS aknowledging that when CIS makes a decision to transfer or move a case between centers or by any means, and the ND cames in a later date than the RD you filed, for all purposes they WILL HONOR the orignal RD at their mailroom. In the practise, it is just happening THE OPPOSITE WAY contradicting those memos and policys. Definitely it is not my fault if they are not prompt making the data input in their system until three monts later after I filed, because they decide to transfer my case to another service center out of the blue. I should not pay with an aditional delay of three months their broken system of doing things. We already wait for years to be penalized this way in adition, extending in time our already painful agony with this unasked gratuity. It lacks of all fairness, and shoudl be unlawful because when it is time to account dates for expirations and fees, they use the double morality code and make dates and deadlines fixed with no remorse. This outrages me a lot.

My recived date is July 27 mailed to CSC. Then application was trasffered to TSC with Notice date of October 1st. Can anyone tell me what date they might follow. Thanks a lot.

Just confirmed with my attorney and It should be processed based on the Receipt Date.

I talked with NSC IO yesterday and she told me that the date they are considering is the date our information is entered into the computer not the mailroom receipt date.

When I called few days back to TSC (to find on the status of SR on my EAD application) I asked that question specifically and I was told they followed RD.
I think it make sense refering back to July 2007 when USCIS made the decision to honoring original received date.

When I had called NSC in January 2008 they told me they were processing applications as per a certain received date.
Your application was received in August and you have to wait.

So my take.. It is according to RD..

Its Notice Date. MY RD is July 2 and ND is Aug 9th but I haven't seen anything. When I called USCIS they said when your ND (Aug 9) becomes current, then your case will be touched.

Its definitely ND

it should be the receipt date.. Some IOs just want to get away by saying it should be the Notice Date.

Whatever... Others are beyond those published dates (priority dates and processing dates) but still no GC like me. I'm tired analyzing which is which. I'll just wait for my turn. I'll just hope one IO will get hold of my case from the stack of cases in their warehouse.

Receipt date.

"6. Receipt Date on Notice – USCIS has indicated that the date of the receipt notice will be the date USCIS received the application in the mailroom. However, some receipt notices received indicate a later date. Can you please explain why this might be happening? What should an applicant do if there is this error?"

Response: On USCIS’ website it says the agency will honor the actual date that an application was received in the mailroom. These are questions for USCIS and we will post their answers here when we have them. In the meantime, if you have specific examples, please email them to us at cisombudsman.publicaffairs@dhs.gov.
