Topic: Next Step after Card Production
Posted by greencard07 (28) 07 Sep 2007
This site has been a great source of information. I have a question?
What is the next step after Card Production

My wife has got a job offer and we are waiting in on the EAD. Its been 93 days already.
If the Card Production ordered message is shown can she work or has she to wait for the actual card to come in?

If yes then has she to wait for SSN. Can she apply for SSN after she gets EAD ordered message.

Thanks for answering.

regards,
Greencard07

Why doesn't your wife have an SSN ? Is she a FOB ? What visa was she on before AOS?

your wife should go with her EAD card to the SS office and get a SSN then with it in hand can start working , unless she ask her employer to wait until she have the fisical card
good luck!!

Please apply for SSN. I don't remember how long it takes. Go to a local INS office and get it done. I wouldn't wait for the EAD to come.

i went to ssn.gov to check that out . Its not possible.

Valid work visa is required to get ssn

I called the USCIS and asked wheter she can work with just an email that Card production is ordered.
They said its between the employer and employee to decide.

Did not get what he meant.
I guess he meant that we can

AS I said before legally she can not work , but a conversation with the employer can help, at least I would ask them to hold my payroll until I get the SSN . social security usually takes two days to send a number so it is safe to say that you can get it within a week
best of lucks!!

Maggie - Since you have a dependent H4 visa, you are eligible for a SSN. Don't you have a bank account?

But you definitely cannot work without SSN.

Hi goofydhowa,

If someone is on H4 visa than that person is not eligible for SSN.

Yes

If someone is on H4 visa than that person is not eligible for SSN. and not eligible for a Credit Card and Bank Account, unless its a joint account with the SSN holder

Wrong! You canot get an SSN when you are on H4! The most you can get is a Tax Id number from IRS.... but you cannot work on H4 visa so you cannot apply for SSN!

Hi,

I am also in a similar position as your wife..
I tried contacting SS office & they said me it takes upto 4-6 weeks to get ur SSN..
But meanwhile, when u go they will issue a letter saying that u have applied for SSN..This should be enough for your employer to let u to start work..(I really wish this is true)

Here is a link in the FAQ on SSN website..I hope this is helpful

http://www.ssa.gov/pubs/10181.html#need

It says :

Do I need a Social Security number before I start working?
We do not require you to have a Social Security number before you start work. However, the Internal Revenue Service requires employers to report wages using a Social Security number. While you wait for your Social Security number, your employer can use a letter from us stating that you applied for a number. Your employer may use your immigration documents as proof of your authorization to work in the United States. Employers can find more information on the Internet at
www.socialsecurity.gov/employer/hiring.htm.

1. Anyone can get a bank account. This is the USA.

2. If you arrived in the USA (say) before 2000, you could get a SSN with an H-4. My wife got one on a TD. YMMV.

3. See the directions for Form I-9, Section 2. It clearly states the requirements for starting work.

"Employers must complete Section 2 by examining evidence of identity and employment eligibility within three (3) business days of the date employment begins. If employees are authorized to work, but are unable to present the required document(s) within three business days, they must present a receipt for the application of the document(s) within three business days and the actual document(s) within ninety (90) days. ... Employers must record: 1) document title; 2) issuing authority; 3) document number, 4) expiration date, if any; and 5) the date employment begins. Employers must sign and date the certification. Employees must
present original documents. Employers may, but are not required to, photocopy the document(s) presented. These photocopies may only be used for the verification process and must be retained with the I-9."
