Topic: People waiting for 100+ days for EAD - Any Info?
As per Trackitt database, of around 1319 people who have applied for EAD, around 78 (i.e. 5.9%) of people have been waiting for EAD for 100+ days.
Any clue what's going on? If someone talked to IO and got some valuable information, would request him/her to share his/her experience with others.
I tried calling IO couple of times but did not get any useful information.
Thanks in advance,
SRK.

99 days for my family today, 4 apps pending.
|
There's really only one thing you can do and that is to schedule infopass appointment and pray that you meet a good IO (with some consience) who can expedite your case, since by law we are supposed to have EAD processed within 90 days (at least that's what they say on their website).
|
i have called CS umpteen times, been to INFOPASS couple of times but noone really has a clue. Some say my pics are missing...some say it is name check and somesaid case is with an officer and wait for 3-4 days. Just feel like so frustated.
My local IO is very nice and has follwed up the case but she also got conflicting answers........and as far as answering you question....Infopass is the best way to go and really hope the IO is a nice person.
Goodluck

I too have been waiting for 115 days, still no news... but I received my AP last week. still... I am so frustrating, what the hell is going with my EAD??????
|
People for whom PD is current and if their I-485 has taken some reasonable time (say 4-5 months) can expect that may be their I-485 is in final stage and USCIS wants to save some work at their end so they are holding the EAD approval.
my EAD is pending for 110 days but unfortunately PD is not current.
|
It is bad pratice to hold the EAD even if the GC is undergoing adjudication. They should issue it before 90th day. Each day of delay causes a lot of anxiety and money for not being able to work immediately.
If they hold the EAD, make sure they send the GC before the 90th day as well.
|
SRK,
Your PD may not be current but your application may have already been adjudicated. Your PD is 2002.
You might hear some good news. Hang in there !
|
Or they should allow people who are waiting for EAD passed 90 days to work while it is pending , just like H1b.
|
I had an infopass appointment this morning, the answer I got was my case is still pending under name/ background check. I am not sure if EAD requires name check since it has to be issued within 90 days regardless, but that's the answer I got from the IO. Fortunately, the IO was nice enough to help me send an email to TSC to "remind" them about my case. again, I am not sure if this could help... what I can do is wait for another 2 weeks to see if there is any response from TSC... so frustrated!!!

hello, i went to infopass on October 2nd, the lady said she sent and email as well. I had a soft update on friday and today got card production ordered.
|
They push back my receipt date to August 3rd. My original receipt date should be July 2, thus it's passed 90 days. I think we just have to wait.
|
Got an update today....last thursday it said "card production ordered" then today it says we mailed you an "approval notice" nothing about the card yet. Do any of you know how long it takes for them to mail the card itself from approval? Thanks!
|
I had the infopass two weeks ago and still nothing.
I see some movement in Nerbraska but since two weeks almost noting in Texas.
|
I really am waiting for the EAD. Is INFOPASS helpful? Some say it is, some say it's not. So I don't know. I originally sent my application on July 2 but they put the receipt date as August 3... Realistically, it's more than 90 days... Any thoughts about INFOPASS?
|
Hi Waitingp.,
I was told to do this.
Send FedEx copy of signed POD (proof of delivery note) with covering letter. As long as mailroom signature shows and date of July 2nd is there they have 30 days to put it right. If your received date IS JULY 2nd., USCIS WILL change received date on your notices. It might take them a couple of months to correct the so called "typo" but they will do it. There has been a few cases like this , but I cant find the threads anymore. I may have over looked them here. If your date was July second then 90 days from receipt are up and were up over a week ago. I know our receipt date was July 5th and it is way over 90 days now. 4 out of 5 have EAD here, but mine is stuck with RFE for proof of marriage certificate. Which we have duly sent to NSC, but confirmation yet. I called and spoke to second level IO who told me he didn't understand why RFE was sent, unless they couldn't read as it was sat in my file. He was looking at it. He also said he sees copies of marriage certificate in the other 4 family members files. He was at a complete stop as to why this was sent out in the first place.
Infopass is great, but only if you get a good IO. An IO who cares about their job and what you are going through with your application. If it were me, I would go to Infopass, but I live not far from our local office. It's easy for me and I don't have small children to carry about either. If you can go and it is an easy travel then go. If nothing else the feeling that maybe you did some good in your plight will make you feel better. But, if you live in a black & white world let me welcome you the the grey area called immigration. By using Infopass your application is flagged. Now some say it is good and some say it does not help to take appointment, like you pointed out. But, "what if" it helps and you are flagged then some IO looks and sees your dates are way out. You can show copies of FedEx POD with signatures from mail room receipted. Just that alone corrects your dates. So, what if it does help. You wont ever know until you go to appointment.
The very best of luck with it. Keeps us informed on what you decide to do. It will be interesting to hear the out come.

Thanks lrindy for the long detailed reply. Thanks for the information. I didn't know they can correct the receipt date in 30 days. I know it's important since 180 days start from receipt date (AC portability). I'll discuss this with my attorney.
|
It's a good idea to bring my proof of delivery to them too on the Infopass, to see that my application is passed 90 days and they can correct the receipt date too. We will see what I can do. Thank you for the information.
|
You are very welcome. USCIS are willing to correct any mistakes they have made as long as you have proof and deal with it ASAP. I am told Infopass appointment is best to correct this. Take all evidence with you have. Oh and a question you might like to ask, only if FP has been done, is have FP's been returned. They can check on that for you as well. Killing many birds with one appointment.
|
oh ok , I don't have any FP appointment yet. Also my Alien number is different from my I140 and I485, maybe they can correct it too. The office is just 30 min away so it should be ok.
Also in scheduling an appt, do I schedule one appt for both my spouse and me, or do we need a separate appointment for our EAD inquiries? Thanks.
|
hello GUYS..
my Notice date is SEPT 14.. i have not received EAD till now.. my wife received EAD almost 2 week back.
How the USCIS is issuing EAD cards??
|
it's like issuing food stamps....they give it to the ugliest first...lol...just kiddin'...no offense meant.....
No one knows for now how they do it because CRIS is not updated.

You can wait to sort out "A"# being different on notice 485 and I-140 at FP appointment. They are very used to doing that one there. It is a very common thing to happen and easily sorted out. They will choose then and there which number to be used in future;OR get Infopass appointment and clear up everything, but only if you get good IO. Make two appointments one each, see if a certain day has a slot one after the other. Which is what we did as there are 5 of us to deal with. It's the amount of time it takes. And if you don't like the answers you get from IO at appointment ask to speak to supervisor. I have seen this done at our local office. The IO seemed to be giving the guy a hard time as she couldn't understand his very heavy English accent. It was the funniest thing as we went next and she asked what a plonker was! We didn't tell her until he had left. We did tell her what to say back if he ever came in again and said that! I don't think she will, but she now has a good idea what the usage of certain words are in the UK.
The very best of luck with it all. keep us updated as to how it all goes.
Cheers,
LRIndy.

gnrao,
Have you set up an account using your receipt numbers on uscis site yet? If so, have you received any CRIS emails confirming card production or approval notice sent emails???
|
I was just looking at the EAD tracker and could not help but notice that some September filers have started to receive their approval notices for EAD cards !!!
How does USCIS justify this while there are literally thousands of filers from June/July let alone August sill waiting for theirs. Perhaps someone can give me a logical explanation to appease my mind before I lose it !!
By the way congratulations to all those who have received their EAD's recently.
|
I wish we could answer that for you, but honestly no one knows why. It is the muse of us all right now.
Sorry I couldn't answer you.
The best of luck,
LRIndy.
|
I figured that too but was hoping that there was some other reason while they were getting it. Why do they even bother to give us monthly updates on processing times which form all accounts is essentially useless information. Come to thing of it a much more realistic way of presenting the data would be for them to give us a percentage of people who have their EAD processed within a time frame e.g 90 days ( in much the same way as airlines do for example when presenting their punctuality).
Thanks LRIndy for your reply.

Most of these "September Filers" are not really september filers. The put in mistake the Notice Date as the Receipt Date.

I posted here last week. I FILED I-485 I-765 in April
receipt notice 1-485 end of april
recept notice I-765 27 Mai
finger printed twice already last time 23 june
no news since.
I called service center 2 weeks ago they told me the case was still pending
they gave me a tracking no and told me to call them in 45 days
I received a paper to confirm last week phone call and to say that my case was still pending.
they recommande i take an appointment through infopass.
I did and was there yesterday to find out that indeed I had called and they were aware about it and the case was still pending/
when i talked about the 90 day rule she acknoledge they were breaking the law
when i asked her about an interim work visa apparently they dont do that anymore.
THE OUTCOME I AM NO MORE AHEAD THEN I WAS JUST MORE XXXXXXXXXXXX
