Gujju's are mostly hard working ! Even though they do low level work and are money conscious but i have found most of the Gujju's are hard working and honest and they don't fake.Their might be some exceptions though.
Gulti's on the other hand are mostly fake,they fake their resumes and whereever they get change to fake they do it.I want shortcuts for everything.

I couldn't agree more !Besides i see there is no importance of experience in It these days,they prefer to replace the experienced guys with a fresher or you have to make compromises and work with that kid straight out of college at same salary and hours.This is unlike the research fields where as you get more experienced you value rises .
I am regretting the decision to not pursue other fields like research or some other non engineering fields.
I have graduated from one of the top 5 engg. college from India in electronics engg.My mistake was that i followed the crowd and joined IT.Its been 10 yrs now and i see all jokers in this industry now.Even some jokers (Not from my college)were lucky enough to get a GC after doing PhD.They went for PhD because they were not able to get jobs in the campus recruitment.Now they are way ahead of me.This is a lost decade for me and i am in limbo how to reinvent myself.

Don't respond to him.You can always tell him later that you were travelling and did not check the mail.He is getting anxious and want you to pay him before you get a chance to prepare legal response from attorney.Don't panic and don't respond to him.Find a employment attorney soon and send him a formal response.Also the loser does not pay both sides attorney fees.Each one pays their own attorney fees even if it is stated directly or indirectly in a contract.I have an experience on that.Not everything in the contract is enforceable and certainly not if the clause is not legal or too oppressive.

Also it is not easy to prove liquidated damages.Courts wont enforce these contracts in 'At Will' states unless he can prove the liquidated damages.

You don't need to discuss any thing with the employer.He won't relent.Did he give any deadline when he send you the demand note ?If he is serious he should have clearly mentioned the deadline.
Also don't pay a penny ,he is just trying to create a pressure so that you give him the money.Once he gets the money it wont be possible to recover it back from him.He should be giving sufficient time to pay back the monies ,he just can't ask you to pay such a large sum upfront.
Have the employment attorney send a official response.

Stop your non sense.

OP please go to the employment attorney and have him draft a legal response and send it to your employer.This will shut him for good.
If he is stating that he is not charging anything related to immigration then there is no point complaining to DOL.It's simplay a metter of employment law then.

As per the Parole evidence rule anything said or stated on phone or email are not considered.

Only the terms of the contract can be put on trial not anything before or after.
If you are in at will state i am sure there is no issue for you.You can have the employment lawyer send him a legal response though.

If he cannot explain then he can not enforce the contract since it will be treated as penalty which is prohibited by law.Even in the court he will have to prove the damage actually happened.

Don't revel or give anything to him in writing.Just politely ask the breakdown of expenses and all the other profiles he considered for that role.Also ask him the client agreement.I am very sure he wont be able to prove any damages.

Ask you employer to send the breakdown of the liquidated damages and how he arrived at the $5000 figure.
Tell him you believe the amount is inflated and is being charged as a penalty rather than the liquidated damages which the employer is trying to recoup.
Regarding attorney and legal fees each one has to pay their own expenses even if it is explicitly stated in the contract that the defendant has to bear the costs.

All your comments are in favor of employers .I am seeing a pattern here.You are misleading people because you empathize with the employer community.
Why would the OP loose the suit.The judge will dismiss it on day 1.The employer -employee relationship was not established so there could be no employment contracts.
The OP can go to the lawyer and he will reiterate the same what i am saying.I told you i had a recent experience on this issue and i work for fortune 200.Don't you think their attorneys would be knowledgeable enough.
They clearly told me that employment contracts are not valid in 'At Will' States.
