good question. USCIS does not explictly state the Sections. They have a generic/standard statements about work location.

Mowry,

I am on EAD and on H1. Our cases are similar.

1. Use SFO as permanent location as your first argument. Talk to lawyers and get the right langauge
2. Use AC 21 as your second argument (180+ days since 140 and 485 are pending)
3. Weakest argument is commuting distance as these are different metros

goldfish, I luckily filed H-1B extension until next September (09). Not sure on MTR processing times. Varies from a month to several months. Could take longer.

thyramax, This is totally un-related to H1-B. Address on I-140 RFE was different from the one on my LCA (ETA).

Action now is to file MTR. I have not seen anyone else getting the exact same reason for denial. If you see my case details, i stated that we did receieve a RFE.

Yes, this is frustrating.
