No Their is no harm for the original beneficiary...GC is shared and using one labor. the basic argument is that: "The theory of Mytosys" which means splitting the labor. Since the immigration has some loops and breaking own laws by giving rights to Employer and employee....so The murthy law firm argued on this and they won it...the proof is : I got my I-140 approval. |

I would suggest not to invoke AC21 untill your I-140 gets approved and you need to work atleast 6months of your I-140 approval and according to law employer can revoke your approved I-140 up to 2yrs it seems so i suggest you wait untill your I-140 get approved and after that also work for atleast 6months to avoid all complication in I-485 stage... |

First of all my employer didn't reveal this information before doing LC sub...if i would have known before doing i wouldn't have choose this labor to substitute since i am in this county from 98 not have enough time on my H1B and lost my Orginal Labor applied when my project when to INDIA and i got laid off from my original company and i was in position not to take any kind of risks....this is all happen .....and i came to know when i got my I-140 denial letter from USCIS till that time i was in impression that USCIS didn't satisfied with REF reply about my education evaluation...
anyways i have already started new PERM LC but problem is i don't have much time on my H1b extension (which got when my I-140 was pending) for I-140 process with my new PERM labor.... I am just looking for options where i can get my H1b extension atleast for 12months so that my I-140 gets approved with new PERM labor so that i will have my H1b extensions for every 3years |

My employer revoked the i140 of a person after 180 days. He did not reveal this information to me and used labor substitution for me.
The other person used AC21 and got his 485 approved. INS has denied my I140 since a 485 has already been approved and there can be only one GC on one labor. INS says that once the 485 is approved that job ceases to exist.
My company is saying that they have done this in the past and got approvals. They are saying that they applied the I140 substitution long before the 485 approval of the other person.
Now they are saying that they will appeal that the other guy never had the intention of working for the comapany.
Is there any chance for the I140 approval and using the existing labor ? If not will the INS help me keep the Priority Date.
Does anyone have knowledge of such cases (or) know the results of such appeals. I have only less time till may 15th 2008 to appeal....

Thank you somuch Akrk for your answers and your time...i have not received the deniel letter yet it has been 6 business days and we didnot receive the letter from USCIS ....could you tell me howmany days it took to come your deniel letter to your company??

Could you please clarify my doubt ?? did you file Motion to Reopen or Motion to Reconsider or just filed Appeal?? Please can you tell me clearly which option you selected on for I-290/I-292 ...
we have not received our deniel letter but we happen to talk to one attorney and he mentioned that we can not file MTR when I-140 is denied you have to Appeal..is this true??
BTW did your I-485 also denied?? including with I-140? please let me know...
Do you have any tracking for MTR? how they process and howmuch time they will take to process??
