My case details:

My PERM was applied under EB2 (10/2008), at I-140 stage my I140 was denied, to lock the priority date my attorney downgraged the application to EB3 now my I140 was approved, but the problem is the priority date is not correct in my approved I-140 (the new date is 03/2012) when we filed..

I am no in touch with my attorney onthis issues, he said he submmitted a SR for correcting the priority date in athe appoved I140. for the past 3 months i am working working with them so far no progress..

Experts pelease advise, how i a can get my original priory date in my approved I140...

My EB2 labor was approved, but EB2 140 was denied by USCIS due to the language problems in the PERM application.

To lock the priority date my attory downgraded the I-140 from EB2 to EB3 and refiled I-140 again and now this is approved under EB3 catogery.. Now the problem is the priority date from my oringal PERM was not captured in my approved EB3 140.

I had a discussion with my attoreny and now they have raised a ticket for capturing the priority date from the PERM application.

Please let me know how much time this will take, it USCIS is not captured my old priority date what all the options I have.

Experts please advice..

I have received an RFE for my H1-x, USCIS is requesting for a client letter.. I have singned sow, my clinet is not proving a clinet letter due to their company policies, client asked us to use the SOW, but USCIS is asking for a letter as an RFE..

My Eb2 140 was denied because of the misrepresentation in my PERM applicaton, now the current status is my attorney downgraded from EB2 to EB3 and submitted 140 for approval for locking the priority date, now it is pending with USCIS since last 2 months.

Now my attoney is planning to file another PERM in EB2 for the same position as Project Manager, my earlier PERM was also approved as Project manager and now dowgrated to EB3 for 140 approval. My question here is can my attorney file the second PERM for the same postion again with the same employer? Is this possible? Please adivice..

Denial Reason:
A review of the record finds that the petition was accompanied b ETA form 8089, Application for Permanent Employmnet Certification, filed with the U.S.Department of Labor on 2008. This date then is the priority date for this petition. Section H of the ETA Form 9089 lists the minimum education, training and experience requirements of the proffered position. Here, Secetion H-4 and H-7 list a bachelor’s degree in computer science, engineering, mathematics and section H-6 and H-10 sixty months experience in the job offered or as an IT professional, IT consultant, programmer or systems analysis, or software.

However, section H-8 lists an alternate level of education as “other” and will accept any suitable combination of education, education and trainings” By accepting a level of education which could included less than a bachelor’s degree the minimum education requirement of bachelor’s degree is not established. As such the labor certification deos not support an advanced degree professional visa classification.

The Form 9089 establishes that the petitioner will accept less than a baccalaureate degree when it lists as minimum requirements any sutable combination of education, experience or training is acceptable in lieu of a bachelor degree or foreign equivalent. Therefore, a bachelor’s degree(plus five years experience) is not the minimum requirements for the position.

your labor was filed for EB2, the minimum requirement for EB2 is
1. Masters
2. Bachelors + 60 months of experiance

When the attorney was filing your case, he did a mistake to put 60 months of expericance for the questions 6 and 6A

Your details are as follows:

4. Education: minimum level required:
Bachelors

6. Is experience in the job offered required for the job?
No
6-A. If Yes, number of months experience required:

Based on the above information your labor will not falls under EB2, but try your luck.. Check with your attorney what he is going do the missing information for the questions 6 and 6A.

My 140 was denied because some wrong representation in my PERM application (EB-2) and now my appeal is pending with AAO.

My employer is willing to fine another file in EB-2? my questions is "Can one company file two PERM Labor Certifications for the same employee for the same position or two different positions? "

AAO processing time is if my case is moved to AAO .. I have wait for 31 months as per the given timelines.

My question is:

Can we/attorney will get any kind of communication that the case is not considered for MTR moving to AAO??
