Topic: Help with RFE

Gurus,
I got an email on 11th Feb for an RFE on my 13yr old son's 485 case. Till today neither my attorney or me has received the letter in mail. Can anyone tell me
- approximately how long it takes to get the letter in mail. It makes me nervous now as its already over 10 days.
- how much time do I get to answer it. I think its 1 month but is it from the date its issued?
- any ideas what doc should I try to prepare in advance to answer the enquery?

I don't think so. I got a RFE E-Mail for my son this morning only and my EB3-I PD is no where close to current even.

I know its a big frustration and extremely difficult to make this decision. You will get differenet opinions from different people you speak to regarding the financials. If I had to talk to my father and tell him the kind of money you are taking and having 12-15 lac job, he would say "what else you need. Its a lot of money". He lives in big town but not as big as metros. On the other hand if I speak to my friend living in Mumbai and making 50+ lac annually his thinking is that it would just be enough. So my suggestion would be to decide what standards you want to maintain there. You might opt for maruti800 or go for a high end car, might like to send your kids to internation schools or get them a normal schooling. Please consider all these factors into account and then see if you have enough.I have a few friends who moved back and are happy there and also know a few who moved back after a few years. It all boils down to how committed you are to your decision.

OP : Why go after numbers? Think where you and your family would be happy. I have seen people setting a target and saying we will go back when my bank account reaches that number but they keep bumping it up when ever they get close to it. They would share a small appartment , drive a junk car, shop only limited stuff all in the name of saving money and meeting that target. Is that what you really live for. Do not make a decision based on money, you will never be able to go back. What will happen max - you will not be able to afford a high profile life style but still be happy because thats where you wanted to be. Need to make a decision, then only you can enjoy your life. I had the same issue a few years back and it was biting us everyday. My wife and I then made a decision that we are going to stay here and not worry about going back. I still do not have a GC but bought a house 5 years back and enjoying my life to the fullest.

Topic: Support immigration reform here

People have already started talking about this bill. I heard in a radio talk show last evening and this morning again about this. Its a conservative talk show and its a pity how they project this bill to the common people by saying that this bill is to convert illegals to undocumented democrats. Not sure if this bill will move any forward or will be just scrapped at some stage.

I totally agree with you. I had a canadian PR and had to give it up. One of the reasons being the job market. The salary is no way compatible to what you get here and on top of that you have high taxes. Also if you have stayed in the US for 6+ years (10 years in my case) and have gained the US experiance, is there a harm working on EAD for a few more years. I agree there are a few restrictions with EAD but otherwise I find no issues changing jobs on EAD and if you are lucky your company pays for the EAD and AP renewals even. I am not sure of this, but I have heard from my brother in Toronto that they evaluate your education in a different way.

Seeing so many things falling dead on the ground in the last few years I have completely lost any hope in the system. I, like many others have always participated in all the differene campaigns but boy, now I am totallly depressed and not sure if anything will help. I do not want to discourage anyone but its all falling on deaf ears who have no interest in. They just want our money thru different extensions year after year and clearing the backlog won't be of any help to anyone - neither the attorney's nor the government.

I think the estimates are correct unless any immigration reform does not happen.
I think working on EAD is not an issue, but maintaining your jobs and keep the jobs inline with your original labor details for 20+ years is a big challenge. Do they think if we started as developer/analyst we need to stay in the same category for the rest of our life? This is like a home prison where you do not have freedom to do anything. I know it was our choice of choosing this path, as some people would say, but it was not like this when we started the journey. First the labor backlogs and then 485 and the only reason most of us applied in EB3 is that a few years back the categories did not make much difference and the attorneys (specially the big houses) just wanted to play safe and not get any refusals.
I feel completely helpless and frustrated.

I would love to do whatever it takes to get out of this mess. No offense to anyone, but, it�s a big frustration seeing people getting greened who applied after me. A friend of mine who was stuck in the Labor backlog centers with me, got fired in 2003, he applied from a different company with a substitute labor and got greened in 8 months after that, and I am still on trackitt seeing the traffic pass by. I think I have missed all the opportunities I had that could have expedited my journey. At this point I only see a ray of hope in porting my case to EB2, but seeing at the different posts about how difficult it is to get an EB2 labor approved I feel like waiting without disturbing my dust eating GC files at NSC. But if I had an offer from a good company and the lawyers feel safe about this porting, I think that�s the way to go. I think EB3-I won't be moving anywhere in the near future.

I did move to a new location in FL and filed my AR11 10 months back. Still my case is at NSC. Is it something to worry about?

My original company that filed my GC is based in NY; so my center of filing the 485 was NSC. I changed my job and moved to Florida and applied for AC-21 in Jan 2009. Still my case is at NSC and not transferred to TSC. I have renewed by EAD and AP also since then with out any issues. Shouldn't the case be transferred to TSC as for Florida it should be TSC.

Make sure one of the jobs satisfy labor description for atleast 6 months before you decide on opening that panshop :) Some lawyers say 12 months. Best of Luck.

In the same zone - do you mean demographically? You don't need to be in the same zone. I did change my job a year back from NY to FL and I am fine. My company did AC21 and transferred my H1. Since then I have extended my EAD and AP also without any issues.
Regarding the 50% match on job description, its not well defined anywhere. I would say your new attorney is the best person to guide on this.
