What about if the person has already lapsed his H1 time and is in his 10th year. Can he still continue with new labor/GC process? Can he still get extenstions based on new labor? | |  |  |

You can also get the transcript from IRS for all your tax returns by requesting them. That is more appropriate and official. You need to fill up IRS Form 4506T (Request for Transcript of Tax Return).
I myself do it every year and gets it in 2 weeks usually as I have been doing e-filing since last 5 years. | | | |

Topic: Just noticed my case was updated on 6/21/2009. What can it be?
Man thats something. Today I got a SLUD on both of our 485 cases (EB2 PD Aug05 India) when I am just about to start my vacation to India in couple of days. Looks like it has been waiting for the date to be near. I don't know what to do? SHould I cancel my visit or can I call them and check out whats going on with my app. I guess it could mean anything. May be my no. has come. I am on EAD, did AC21 some 6 months back.

Adding to that if the I94 is given only till AP is valid, what will happen after that. DO we need to go out to get new I-94 or stay back with an expired I-94.

Mine is a EB2 with PD as 08/05. Invoked AC21 & on EAD.
I had a similar issue some 5 yrs back when I for laid off and had to transfer H1 from Company A to company B but forgot to apply for extension for wife for H4 visa. After 5 months (before I-94 expiration & 180 days) We had to travel to India on H1 transfer apporval and came back with new stamping for H1 & H4. Since then we have travelled to India on 2-3 occasions and had done re-stamping too. Now in view of your quision, I am not sure if my wife's stay is considered to be OOS uding that 5 months period.
I remember my lawyer telling that in case you go out of US and come back, you illegal hardship gets resetted. So she is safe. Is it true?
We may get similar RFE for wife in coming future too so kind of nervous. | | | |

I would say they are at least in progress. Check out the latest Processing timeframe for I-485 at TX as they have moved on to Aug 08 2007. Last week they were at July 2007.

I am EB2 Aug 2005. No LUDS since 2007 485 filings.
Not sure how lot of guys from retrogessed countries were able to get GC last year with priority dates well over 2006? They really were Luckiest guys on earth........

So does this mean that a person can remain outside of US till his AP expires. This gives him/her a max period of 1 yr (AP validity) without any issue to his GC process.

My wife just went for vacation out of US for 2.5 months and planning to return using AP. The last status on which she entered US some 1.5 yrs back was H4. I am primary and have already done AC21 and working on EAD since last 6 months. My PD is Aug '05 EB2. We have been in US for last 10 yrs.
My question is if is it ok to be Out of US for this long without jeopordizing 485 processing. Will there be any issue on return at POE using valid AP for her.
I am planning to join her and kids(US citizen) on return and will use valid AP too.
Any similar case.

Are you saying that you H1 is rejected or your I-94 extension is rejected.
In case, if your H1 is approved but your extension of stay is denied, you have to go out of US ASAP and get a Visa abroad and come back on either H1 or AP.
I have done the same thing couple of yrs back. Didn't had any issue while stamping or coming back. But make sure you get out ASAP. | | | |

Guys...
I am in a big fix and not sure which way should I go. I am PD Aug 05 EB2 (140 approved some 30 mths back, 485 filed 15 mths). I got a good job offer from a big firm and planning to join it on EAD. My GC sponserer is cool with this change and is not revoking 140 and letting 485 continue.
Now, question is if any RFE comes who should I approach for response. My old company or new company. I am also not changing my lawyer. Is this also called an AC21 change though I am not filing any AC21 papers??
Is it so that if I get GC, I have to go back to my old employer.
I scanned through all the blogs but haven't seen this case so far..

How a denial can be sent even if the PD is not current. Will they look into the 485 file when they recieve the I-140 revocation application.
I am also planning to switch employer but not plnanning to send AC21 package. Both my new company lawyer and my original laywer told me to deal with it once RFE comes. | | | |

Yes, thats correct. I also confirmed with my attorney and he gave me the same explaination about the 180 day period which is Section 245(k).

So the validity of I-94 will be for ONE YR from date of entry or till the Validity of my AP.
And looks like it is OK to let I-94 expire while AOS pending.

Quick question......
If I am working on EAD and have to travel out for USA for short time. I re-enter on AP, what will be the validity of my I-94? Will that be only till my EAD validity? Will that be my last H1 visa validity?
Also if I switch to EAD and don't go out of USA and if my I-94 expires, will I be considered OOS. Is their a way, I can extend my immigrant status in USA itself (anything similar to H1 extention). Is their any I-94 extension too?? Staying in US with an expired I-94 is troublesome.

Guys,
My case is also very much similar to eb3gc4me case. My PD is Aug 2005 EB2 and this is our 9th yr in US.
After working for a company for 3 yrs, I go laid off in Dec 3003. I found a new H1 sponserer only after 45 days when we filed for H1 transfer( I was OOS for 45 days) . At that time, we forgot to file the extension for my wife (again my attorney didn't asked for that). In Jun 2004, after some RFEs, we did got H1 approved but INS denied the new I94 and asked us leave USA ASAP and get H1 stamping/new I-94. We did both H1 & H4 stamping at consulate abroad and entered successfully in Jun 2004. Since then we have H1/H4 stamping two times outside and have re-entered 3 times to USA. Since then she also had I-539 approved for 2 times also. We did filed AOS in Jul 2007 also. She is also approved EAD/AP two times since then.
Now having said that, will my wife have a similar issue as she may be considered out of status for Jan2004-Jun2004 timeframe (but not since LAST ADMISSION and before AOS filing). She is still on H4 visa. Pls suggest as after reading eb3gc4me case, I am confused too whether it can create a problem for her in GC.

Quick advice is required....
If I am working for a company A on H1 who is also my GC sponserer and then invoke AC21 and joined Company B on a similar job on EAD. After some time, if I go back to Company A (while my file is still pending) , can I revert back to H1 status or do I need to continue on EAD with A who is my original GC sponserer. While invoking AC21, I didn't informed INS so they r not aware that I switched job. | | | |

Where did you got the feeling from the post that I am not changing job. I just mentioned that I am not planning to file AC21 papers for my job switch. I will be responding to RFE directly in case it comes. Not sure how many out there have taken such steps. Really wanted to hear from all those who got greened without filing AC21 papers.
