what I meant was the profits each year were over 20K than the PW - all the business expenses had already been met - business is a multinational franchisee with over 1.3 M in sales and 200K in payroll - the financials are prepared by the franchisor which is independent of the franchisee thus being audited as the franchisee (my petitioner) has no control over the financials in it / the petitioner has been in business since 1984 and always posted profit. |

I was just reading your post. I am in the same situation. My I140 was denied due to A2P but in a wierd way. My PD is 2001 and at that time my petioner was a Sole Proprietorship. In 2005 it was changed to "S" Corporation. The problem here is that the business is the same with positive and progressive figures all throughout. However, since CIS treats the first 4 years 01 - 04 as sole proprietorship it says that the business owner cannot support himself after paying the beneficiary (each year the profit is about 20K to 30K over the PW) and CIS does not take the net current asset value into consideration as it does in 05 and 06 when the business is a S Corp. I have already filed my MTR but would appreaciate any kind of suggestion in this regard including links like u mentioned. |

Well I had applied at NSC in June and had not received any news - so this is what I did and got positive results:
Called a couple of times on the 1-800 # and requested politely
Took an InfoPass after 90 days - met the IO who tells me that since my case is under appeal (my I-140 and I-485 denied and subsequently Appealed) they will not issue me a EAD until there is a decision on my case
Faxed a letter to NSC stating my hardship and financial problems if EAD not issued in time (my current one expired Sept 19)
Again called 1-800 # couple of times
Got 2 year EAD approved and card received yesterday - Try it - who knows what works |

Topic: How does USCIS mail EADs?
Regular USPS mail - will not require a signature - so just check your mail box. Mine was approved on 9/18 and I received it yesterday in the mail. |

I hereby leave the 100+ club - got the magic CPO email - applied in the start of june - went for InfoPass, called USCIS numerous times and even faxed a request - looks like something worked. Best of luck u all |

Just wanted to know if you are eligible to renew your EAD and AP while your case is with the AAO (MTR / Appeal). I have heard different stories and not sure. Can anyone please help and if poosible back their answers with the relevant law. I applied in June 08 and still waiting for a response |
