I hope when the comments period opens up , n if it does, everyone can support to include this . It can impact anyone and everyone. Last time for h4ead it was 12000 comments.. for this should cross 20,000 comments :)

Do you think people with i140 approved from previous employers would also qualify ? Specially H1bs around here since 10+yr wait , lot of people change jobs and then gc starts again . Hope they cover people with i140 from previous employers also.

Watch ur words pls and do not judge people at your convenience. The track it link for h4ead does not seem to open on my browser and i have asked this question on h4ead rule website as well but haven't got any feedback. This thread seemed more active with informed people so thought of asking. Many lawyers have already accepted and kept the forms ready with what is available on USCIS right now as a month overlap between old and new forms is valid . I just wanted to check if USCIS has mentioned anywhere that we cannot use the forms uploaded on their website .

This is a question pertaining to H4 ead.. why can't we use the I765 form on uscis form currently on their website ? Has USCIS themselves mentioned somewhere that the pdf forms on their websites cannot be used ? I tried to search a lot but besides law firm websites I don't see anywhere on USCIS website mentioned that we cannot use these forms. Pls let me know.

Name suggestion : Legals Matter

Questions:
1 Can one file for ead if in india? Is it required to be in person here ?

2.what happens if after getting h4 ead the h1b changes job n gc starts from scratch ?

3 would DACA EADs affect timelines or create any backlogs for h4 ead ?

4 when h1b gets his ead due to dates being current or i140 ead rule then does h4 ead need to do any paperwork ?

5 while traveling after getting h4 ead if h1b needs stamping would h4 need it too inspite of having ead ?

But isn't his h1b beyond 6 yrs so would that not make him eligible as per that even if gc starts again with new employer ?


There will be many many families in this situation specially h1bs beyond 6 yrs how can one expect to be with same company same position for 9 /10 yrs ?
On other note Yes very imp to confirm that if i140 is not revoked n gc starts with new employer beyond 6 yrs stay n also incase of scenario under 6 yrs stay what happens then?

thank you for mentioning page number. So beyond 6 yrs in USA but with previous i140 approved and new PERM under process should make the H4 spouse still qualifying for EAD . Hope I am right.

Can you pls post the link here ? So that means even if H1B is here beyond 6 years and his new PERM process is starting again due to promotion the H4 spouse cannot use previous approved I140 of the same company ? Can they still use the benefit of H1B extended beyond 6 yrs ?

Congratulations & very thankful to Anirban, Rashi and everyone who did go to meetings in person .
Had few questions :

1.Just wanted to be sure that previous i140 approved does qualify for people whose new gc process is under process. Have tried to read but no where this is clearly mentioned .

2.Also with DACA/DAPA millions of EADS under process hope it does not add waiting time to get EAD in hand once we have submitted applications on May26th onwards.

3. We need SSN# to give the application right or would it be part of EAD application process ?

Hi, My husband is going through similar change and the successor of interest did not work in his favor as the tax id had changed.. but ya he just got his new h1b and soon the whole gc process will start soon .. the lawyer told us as per her knowledge if the i140 is not revoked and he is on his 10th year of H1b here so hopefully should be ok for h4ead.. fingers crossed cus i know of several people who have changed jobs or going through mergers,acquisitions and such re-orgs and have i140 approved and have lived here beyond 6-7 yrs
