My petition number started with SRC. Yes, I did submit previous employer's experience letter along with education certificates with my 140 petition.


For whatever it's worth to this forum, I also hired the company's lawyer as my own lawyer. Although they are charging me through my rear for both retainer fees and EAD/AP renewal applications, I wanted to be sure that any RFEs are coming to them (and through them to me). I am also a firm believer in letting the lawyers file the EAD and AP renewal application as I don't want to be in a situation of having filed incorrectly and thereby the renewal to be delayed

It was in the 'Same or Similar' field. The new salary is substantially high and the geographic location is different but I was told that it wouldn't matter.

Trackitt Friends,

I received my 140 approval today.

As a background, I had decided to go all out by invoking AC21 with 140 pending (and using EAD) and had accepted an offer with a new company. My start date would have been soon after Memorial weekend. My current employer would have been supportive of any RFEs but there was still a substantial risk of jeopardizing the GC process if anything went wrong. I did tons of research on AC21 with 140 pending and the general consensus after talking to many lawyers was that as long as your current employer is supportive you should be ok, however, there was still an outside risk of USCIS formally implementing AC21 regulations in the near term.

What I have learnt today is that 'no pain no gain' and luck and God definitely favors the brave. I truly hope that all my trackitt friends receive their approval soon. I want to thank all the trackitt Gurus for keeping our spirits high and providing their expert opinion.

I understand you have decided to take the AC21 plunge with 140 pending (based on some readings in this forum). I am planning to do the same as the proposed offer is difficult to take a pass at. My received date is July 29th (EB2) and I am not sure how long it would take to be approved. Topic: AC21 - Quick Reference !!

Question to the experts on AC21. I am sure we all have faced this question from a prospective employer while applying for a job of needing or not needing 'sponsorship' . If I plan to use AC21, then technically am I requiring 'sponsorship' or not? I am led to believe that since I have my EAD, I probably don't require 'sponsorship'.

Also, some insight into what documents need to be submitted while using AC21 will be extremely helpful.
