Thanks. I am trying to convince lawyer but looking difficult. What if USCIS comes for audit and they find difference in H1B title and actual title? Any idea.

Hi,

Folks i need your help as i have already taken a promotion without knowing issues it causes in GC process.

So i was working as Sr. Software Engineer and now i got promoted as Technology Manager. Most of the responsibilities remains same but there are few new responsibilities such as delivery, few folks are reporting to me etc.

Now my H1B renewal is due and my lawyer said we have to file H1B extension with new job description and may have to file PERM again.

Questions:

1. Is there any way i can avoid filing new PERM without loosing promotion?
2. Is there any other options such as changing title or adding more and more responsibilities from old job desctiption?
3. Can you point me to USCIS site wherein it can elaborate on what exactly triggers re-filing of PERM.

When you say you used latest one, you mean petition which was valid from future date. correct?

I didn't find any place where you can add multiple petition in DS160. I will check DS1160 again to see whether i can add multiple petition some how.

Hi,

Background: I140 got approved 6 months back, current H1B is valid till 4/20/12. since i am going to India this December (3 Weeks) on vacation, i asked my employer to file extension. Employer did and i got the approval today but new petition will be valid starting from 4/20/2012 till 2015. My current visa is expired so i need to stamp a new one while coming back from India.

Now question, Which petition shall i use to stamp the visa? will it be the old one which is valid till 4/20/12 or the new one which will be valid from 4/20/12 to 2015.

Lawyer told me to use old one since it is active and new one will be active only after 4/20/12.

I wanted to stamp 3 yr visa so that next time i go out of country, i will not have to stamp.

Please advice.

Hi Dreamcard,

I received denial from USCIS based on by 4 yr Engineering in India is not equivalant to BS in Electronics here in US. I did provide my evaluation with I-140 but still they denied I-140.

It would be nice if you can tell me more about your case. I mean what all documents did you submit while replying back to RFE. I am thinking of providing subject by subject evalution and an expert opinion letter. I hope these docs will help me to get out of this denial.

Please advise.

Hi,

I-140 denied on the basis of education equivalance. My degree is BE Mechanical where as job description in LC says BS in Electronic engineering or foreign degree equivalant.

Even after providing certified educational evalution from well known authority, they denied I-140. Now lawyer is going to appeal so atleast i can get one year extension.

It seems that i have to start with new LC with clear educational requirements.

Does any one from this forum got denial based on education equivalance? if yes then please share your exp and what you did to come out of it.

I have approved labor certification but I-140 got denied couple of days back. PD date is 5/4/2011 and i will finish my 6yr of stay on 5/9/2012.

Since my I-140 is denied and labor is filed 365 days prior completing 6yr of stay in US then what all options i have to extend my Visa?
