When you receive the card, would you be so kind and share the exact date it shows under "Permanent Resident Since"? If that date is in September (when you were current), then I guess EduKondalaVada is right. That date should hopefully be the date when a visa number was glued to your file... It would be very nice if you could share that date.

Topic: Second Finger Print
I thought I'm going to get approve this month. Today, I checked my mail and I got a letter from USCIS. I was happy but the letter for second finger print appointment. What you do you think? Am I gonna get approved soon?
No way for us to predict your case man... Yeah, you're more than current, so to speak (RoW EB-2 from Nov 2002), but to get approved, your file has to be physically reviewed by an officer, and that's the unknown.
Now, the only smart thing I could add is: it would be very, very interesting to know if 2nd FP notices are issued automatically by the system when the old ones are 15 months old, or are they issued "manually" by an officer reviewing the case and noticing the old FPs are 15 months old? So then I ask: what date did you do your first FP? It's not in your profile... Was it approximately 15 months ago? If so, then it's a bit more likely that the system automatically issued the 2nd FP notice. If it's more (like 16 or 17 months), then you might speculate that the file is with an officer who "manually" requested the 2nd FPs and who's very likely to approve the case as soon as you take said FPs. Of course, it's all speculation based on whether these 2nd FP notices tend to be issued 15 months after the old FPs (plus/ minus a few days) or they can get delayed... basically it's speculating based on whether we see a "machine-like" issuing pattern or a more "human-like" pattern.
So, in short, when did you do the first FP? :-) |
Topic: H1b revalidation - stuck in PIMS verification
Man, oh man, I feel your pain. I have no idea whatsoever how long it could take; my wife went through this a few months back; here's her story: http://www.trackitt.com/discussion-forums/i485-1/143081889/
I wish you get as lucky as she did; she had her appointment on June 24th and they gave her the passport on July 1st (one week later) at 9am; her plane was leaving at 1pm that very day. So yeah, I know the stress full well, that week has been hell (with a happy ending).
On the other hand, an Indian friend of a friend spent a couple months (!) in Canada when stamping his H1-B... first H1-B stamping, if that matters.
Given that (in Chennai) it's Monday (Oct 27th) morning and you have you flight on Saturday... I have no idea what advice to give you. It'll depend on the type of plane ticket; if it's non-changeable/ non-refundable, you might want to start looking for another one (w/o canceling this one); if it's changeable for a fee... heck man, no idea. Try and call them every day, be polite, explain the situation, maybe they can do something to speed it up. It sucks, I know. Best of luck, I feel your stress. Keep us posted. |

if you read in this murthy article there is another case in which the 485 approval was given 4 months later when pd was not current. apparently the visa # was assigned few months earlier.

Normally, yes, PD needs to be current for your I-1485 to get in the USCIS door AND for it to go out the USCIS door. See the I-485 Standard Operating Procedure (SOP) at http://www.ilw.com/seminars/august2002_citation2b.pdf Look at page 134:
"The Visa Hold Shelf holds cases whereby a visa number was available at the time of filing, however, between the date of receipt and the date of adjudication, the visa became unavailable. These I-485 filings are otherwise ready for approval. These cases are staged chronologically by priority date, preference category and country of chargeability until a visa becomes available. They are reviewed monthly to determine visa availability."

(3) There is also the fact that, in theory, an application can be fully approved (including the visa number assignment) and still spend time on the shelves before getting out the door for good. The "shelf-life" of such an application can be up to 120 days (see page 133).
Interesting. Let's hope that the date shown on the actual card, "Permanent resident since MM/DD/YYYY" is the date when the visa number was actually glued to the application. In this case, to the original poster: srkr, could you please let us what is the exact date written on your friend's card? |

Also worth of mentioning (from the same document) is that CIS will soon accept SRs only 1 day after processing times, instead of 30. Topic: I need your kind advise.
This question involves family-based immigration, a topic I'm not too familiar with. I'll try and answer, but please, keep in mind that I am not a lawyer, just a normal person; I would very strongly advise you to seek the help of a good lawyer.
Here's what I (not a lawyer!) think:
A) right after you marry an USC, he could file an I-130 for you (the FB equivalent of an I-140 from the EB world); since as a spouse of an USC your PD for that I-130 will always be current, you could also file a concurrent I-485 based on that I-130. Once you have filed that I-485, you should be in status (or better said, in "authorized presence", something that any pending I-485 should offer), be able to get EAD and AP, etc.
B) I don't know how long an I-130 + I-485 takes; I suppose it's like an I-140 + I-485 by a RoW EB-2 in the EB world, i.e. something that typically should take 6-12 months, less if you're lucky, more if you're unlucky.
C) I do know that CIS will question your marriage big time, so you should be prepared to prove you guys are truly in love. There are tons of fake marriages, and CIS is coming down hard on those. Don't get me wrong, by no means I'm not saying you guys don't love each other :-), I'm just saying that in CIS' eyes you'll be guilty until proven innocent. Photos of you together, joint bills, joint accounts, etc, etc, should help. Again, ask a lawyer...
1. After I get married do I need to stay on my current H1-B (EB3 I-140 pending) and continue working for my current employer until I have my family-based permanent residence approved?
Like I said, if you file an I-130 + I-485, from that moment you should be in status. You could quit your employer, give up your H1-B and your EB-immigration.
2. Can I quit my job, move to his home town and get married right after I get there?
Umm, make sure you don't accumulate too much out-of-status presence. If you quit your job on day X, then move, then get married, then file the I-130 and I-485 on day Y, you have been out of status for the period [X, Y]. There's forgiveness for 180 (?) days in cases where you're married with an USC, but still...
3. Will I have a legal status while my family-based green card is pending and will the fact that I have applied for employment-based green card slow the process down?
Like I said, I believe that any I-485 (be it FB or EB) offers "authorized presence", so yeah you should be okay after you will have applied for that (FB in your case). There should not be any slow down, either...
4. What if god forbid my employment based I-140 gets denies in the meantime? I am still on H1-B, but would that denial affect my green card through my future husband?
Umm, an I-140 typically gets denied if your education is not enough or your company's ability to pay is questioned. Neither of which will matter in a family-based case...
But, again, please, do speak will a lawyer; I know some stuff, but I can't give any legal advice. Best of luck girl! |

The other option, where you form a corporation (inside which you have the same job description) and said corporation contracts out might be okay, though it does seem a bit fishy... True, self-employment is allowed under AC-21, but you might want to check with a top lawyer though. |
Topic: Disability? while waiting for I-485
You should be fine; neither you nor the company are violating your promise of employment. They still want you to work for them indefinitely, you still want to work for them indefinitely, the disability leave is just a temporary thing. Or in other words, they should be able to give out a letter of employment at any time, regardless of your disability leave.
Of course, I am not a lawyer, the above is just my personal opinion. Good luck with your surgery! |
