I have the same situation, A#'s are different on 140 and 485. And 140 is approved from TSC and 485 is pending at NSC. Not sure how these will be linked. When they will be linked etc.

Why would an employer who revoked 140 will open the MTR. Even though if it happens what would be the justification for the MTR to USCIS.

Its very much possible that your employer may revoke the 140 as retaliation. And they can do it at any time, as its thier document. So prepare for the worse and plan the consequences etc.

Topic: Different A #'s on 140 and 485 !!

I am a Canadian Citizen working with Company-A on TN Visa.

Company-B applied I-140(With Substitute Labor) in premium with Future Employment clause in April 2007.

Company-B got RFE for Ability to Pay. Company-B answered the query, but USCIS denied the case in July 2007. One “A# xxx xxx xxx” associated with RFE and denial.

Company-B filed MTR (I-290B) against the denial in August 2007. USCIS have sent another receipt with the same “A# xxx xxx xxx” assosiated with the denail case.
Current Status as of 9/29/08 : Case received and pending.

Since the substitutions are ending, Company-B filed another I-140(Substitute Labor) application with same Labor Used above with Future Employment clause in July 2007.
This I-140 Application is approved in May 2008. This aproval also have the same "A# xxx xxx xxx"

Company-B filed I-485 and I-765 for myself and spouse in August 2007. This I-485 receipt and approved 765(EAD) have a different "A# yyy yyy yyy"
Current Status: Case received and pending.

I got H1B approval from Company-A Valid from October 2007. I went to India in October'07 and entered USA on H1B. Still working for Company-A on H1B.

Here are the questions:


Because of two different A#'s do you anticipate any issues in future since the denied I-140/Pending MTR application and approved I-140 have the same A#'s. And Pending I-485 have a different A#. Will these A#'s be reconciled, and my pending 485 and approved 140 will be tied together.

I am thinking of asking Company-B to withdraw the pending MTR applicatrion for denied 140. Will that impact my pending 485 in any way. What will be the possible implications. I am worried, MTR withdrawal may lead to 485 denial.


Does my Change of status from TN to H1B(at Company-A) in October 2007, with Pending 485(AOS) at Company-B, will in any way jeopordize my I-485 application. Is there any problem associated here.

How lucky some can be....file got moved or touched by IO being PD with 2006??? Sorry for the RFE though.

Most likely previous employer might have revoked the 140. Figure it out and however file MTR and fight, you have pleanty of time being eb3'ite.
I feel sorry and hate that kind of employer. And I guess your employer should be a Desi?

Its not because of invoking AC21. Its because the employer revoking approved 140. If one can manage employer not to revoke 140, then thats fine.

Topic: US ECONOMY SINKING RAPIDLY..... Very scary situation

With the sinking economy, what would be the effect of 485 applications with Future Employment clause. Will there be lot of queries for ability to pay etc. again? What is the solution, should FE applicants, better move on to sponsored employer rolls???
