My I-140 was filed on May 29, 2015. More than 6 months now and Still waiting. Trying to get AD approval as My H1 is expiring in March'16 and I do not want to go through another round of 1-yr extension. :(

Don't wait till F1 EAD expire. apply for H4 COS and EAD atleast 4-5 months before. USCIS would not cancel EAD that is already authorized for work till its expiry date.

Check iCert. I see mine approved A-13266-XXXX. look up with your A number as there there are tons of approvals

Guys- I did not see my case in icert neither did I receive any email from GIT. out of curiosity I checked with my case manager to see if they received any. Here is the reply

"We have starting to see some movement on cases filed with similar priority dates as yours. The online status is subject to change, therefore, it is our policy not to provide confirmation based on the same. We can only confirm when the actual certified PERM or a decision is received in our offices. DOL sends all certified PERMs/ decisions to Cognizant via regular mail and this can sometimes takes two weeks to be received in our offices. Once a decision is received, Cognizant will update myvisa and email you with the next steps. "

Response I received from Immigration team today:
"We continue to raise updates and reach out to DOL through all available means and also have external legal advisors doing the same. Till date, the Department of Labor has not provided us any further update on long pending cases. As soon as Cognizant has any further information for a significant update on the PERM, you will be contacted."

H4 validity is based on H1 validity. Go to https://i94.cbp.dhs.gov/ and get your i-94. whatever date you have on dhs site is your H4 expiry date. H4 doesnt get an seperate USCIS approval paper unless its a change of status within US. With the printour from DHS site, you should be able to apply for EAD.

I don't think they are doing anything. i got below reply when i asked if cognizant is doing anything to straighten up things with DOL

There is no minimum time frame within which DOL must make a decision on a PERM application. I understand your frustration with the delay from DOL, however this is outside of Cognizant�s control. Cognizant is doing everything within the DOL regulations to receive an update from DOL on your case. DOL continues to just come back informing us the case is In Process and they will send us an update once one is available. Unfortunately, even though DOL asserts process time is based on first-in, first out, in reality/ practice, the processing times vary widely. DOL does not provide any reason or explanation to employers for long pending PERM cases. Thus, we are unable to provide any further details as to when we can expect to receive communication from the DOL related to the PERM filings.

Once we receive any significant update on a case, (an approval, an audit, or a denial) we will update myvisa and contact you via email within approx. 24 hours.

Hi Ashali- In your case when Cognizant file for extension. you will get extension for 1 yr from 27-Feb-15 to 26-Feb-16. In my case similar thing happened. Based on pending perm, my h1 was extended from date of expiry to 1 yr. I didnt have to wait for 6yrs to complete

You can apply for new H1B in April 2014, since the new H1B's are valid from October 2014 which is > 1 yr from April 2013

Audits are very common these days.
1st Wait some more time to hear on your company B PERM final decision. If it gets approved, then you can file I-140 and retain the PD Sep 2008 after which you can file your 485 if it current
2nd if the PERM get denied for some reason, you may ask them to file again or change your employer.
Going back to company A will depend on your relation with you. Remember, if you tell them you did not get PERM after leaving them, they may withdraw the i-140 (they can) and you would be in NOt so good situation. They may not hire you since they would be sure you will leav them again after I485.

lets say you joined company B after perm approval. for I140, mostly consultancy will ask you to bear the cost. Once I140 gets approved, you can ask for copy. Once you find an employee C, you can provide this copy while h1 transfer to get 3 yr h1. Company C will,. have to initiate perm again.

In my case, they filed the same day the ETA was generated. But Myvisa got updated the next day and it send an automated email to cts account. If your perm is generated, there are good chances it is submitted, but there is a delay in getting it updated on Myvisa.

Check with your Case Manager, they may have filed it on the same day. Though I got notification today, the PD date is 09/24 as per email. I got the notification when I check with CM on ETA of submission

Follow up with Case Manager untill you get a proper response. I hear some Case Managers dont respond to emails, its sad but keep buggin. your case should have been filed by now. Ask for ETA.
