It is possible now that LONG waiting EB3s who ported will get ALL the #s from this movement, if it happens. Say dates move from 2005 to 2006. Then only porters are expected to be in this range. Similarly till 2007.
Then by the time spillovers happen, dates will jump like how they do in big leaps. That time more 1st time EB2'ers will get a chance along with some porters. Fair for long waiting EB3 folks who do not get any spillovers, and then EB2s will get their share in the form of spillovers. It may cheer EB3, and may disappoint EB2.. but what else can be expected.



There will be very less ( probably couple of thousands) spillover this year for EB2I . Most likely dates will not cross May 2009 in FY 2015. Reason: EB1, EB5 will consume their full quota, EB2ROW is likely to consume its full quota ( based on PERM approval rate) , Spillover from FB is only 4 k , EB1 might end up consuming some of spillover from EB4.
It seems, this year USCIS is adopting a new strategy where they will start moving EB2I early to accommodate porters and to have a better idea about the demand. But early movement doesn't mean that it will help those who have PD in second half of 2009. EB2I category is DOOMED and screwed and there is no way out of this. Meanwhile EB3I is going to move much faster once it start getting spillover from EB3ROW.

It depends on how much time is left on your H1? Since you have I 140 approved and you will be working for same company , I guess you can recapture time left on h1b (if it get expired) or apply for h1b extension based on approved I 140. Please note one can apply for EB1C while on H1B visa. No need to apply for L1A.

Not too sure about timing of EO and how big it will be if Dems end up loosing senate. Law firms just like to sensationalize what we (their clients) want to hear. Politicians say something ( which they never mean) and media make their own assumptions/conclusions of those statements and publish it. These news / rumors/false hopes keep us going.
So far I unable to find logical answer to this question " what incentive Mr O and his administration have to remove dependent count from EB category ( and not from FB category)". Anyone has any theory why he will do it?
H4 EAD rule is different thing. There is a parallel process that is going on.

strong indications that even Eb3 ROW willl be current by end of FY 2015. And once it become current it will remain current for many more years unless a) H1B increases b) suddenly there is jump in number of Nurses filing in that category.
If nothing changes within next 5 years, both Eb2I and EB3I will move together at the same pace and possible will share similar PD.

Its more aggravating than that. I have protcols in IV to adhere so cant revel more. Senram just busted one of the provisions.



So they won't allow visa holders with approved I 140 to apply for EAD but might give EAD to those didn't clear lottery?.
If that happens than my advise to EB India folks to work and live in this country with same mindset like those who working in gulf countries. Because getting PR or citizenship in gulf countries is next to impossible. Folks who work there invest every single penny in India and are mentally prepared to returning back to India some day.

I read your post on August 18th. You mentioned H1B visa recapture for denied, duplicate, not used h1 visa for last N years.
Well if that happens than it will further backlog EB2/3 India. It is pretty obvious that whole point of EB immigration is to provide high skilled slaves to corp-orates therefore I won't be surprised if H1B visa recapture actually happens.

and what are their provisions? Corporate know H1 cannot be increased via EO. Only thing which can be accomplished via EO is H4 EAD or increasing OPT duration. I think it is in favor of corporate to include H4EAD in EO because a good number of h1 new filers are those who are on H4, L2, H4--F1--> OPT.

Regarding your point about porting. there are many cases where companies and law firms purposely file cases eligible for EB2 in EB3. Some folks (EB3) continue living with it while others try to do something about it.
Anyway soon this discussion about porting will become obsolete as eb2I and eb3I will share same PD within next 4-5 years.

If you ask me it is all about lobbying. For some IT companies EB2I/EB3I backlog is more important than getting more H1B visa. They are already using L1 route to meet their demand. Similarly for immigration law firms, backlog is key to their business.
I guess they all reach out to him to oppose any initiative or attempt to clear backlog in EB Queue.
Do you ever think why Senator Grassley never said a word about L1A/EB1C abuse?

Exclusion of dependents in visa count is next to impossible because that will bump number of GC given every year from around 1 million (approx) to 3-4 million. Policy makers are already worried that Family based immigration is leading to chain immigration . In senate bill there was provision to stop people for applying GC for their parents and siblings. Removing dependent coutd will do the opposite of senate bill, it will further increase chain immigration.
Only thing President can do is to remove dependent count only from EB category, but I doubt there is any reason for him to do so. Corporate also like EB category to be backlogged.

Wishful thinking but BO could allow indefinite renewals of OPT for those with US degrees as long as they have a job so that they dont go against the cap. GW pulled out the 17 month STEM extension as an executive order. So whats to stop an EO that allows indefinite renewals. The Facebooks, Microsofts, Intels of the country that want this labor would rejoice and get some return for the lobbying dollars they have spent.



But this is again a very bad news for EB2 and EB3 India. In this forum itself I am seeing that number of ROWERs applying for GC while on F1 is on rise. Latest PERM data also confirms that PERM for F1 visa holders had doubled since 2013. Some of these ROWERS get their degrees from for profit/unaccredited schools and later continue working on OPT and CPT till they are eligible to file for 485.
