This bill will make a big damage to the entire EB category for the benefit of FB immigration. How naive EB folks are who support HR 3021! The actual number of visas to be allocated to EB will decrease and most likely for the EB3 group. As I have said elsewhere, the main words of this bill are "modify FB per country percentage from 7 to 15," whereas the total number of immigrant visas will not increase. Naive minds swallowed the words of "per country cap removal" and missed the most important words of this bill.

After giving some thought to the mater, I think I should support the bill. It clearly will help to weed out some silly EB 3 folks by significantly decreasing the number of visas given to the EB category. It will not affect any priority category in any way.

HR3012 and the other similar bills are meant to increase the amount of FB visas - and have little or nothing to do with India or China. This is the smoke screen.

Since one of the most important battles in the US is for future Latino voters each party is trying to give them as much as they can. This and their sister bills always include the special 15% FB clause. This is to help Mexican people caught in the FB category. It is a small carrot that both political parties want to give to Latino voters to show 'we did something for you' with the upcoming election season.

The next step in their plan will be to eliminate the EB3 category completely - likely by the next election cycle. It is easy for politicians to show that there is not a great need for EB3 category people since the US is full of people with bachelor degrees. And it will also clear the 20-30 year backlog problem that new people from any country entering the country will experience in the EB3 category.

The outcome of eliminating the EB3 category is that all of the un-used visas would roll-over to the FB category. That is the plan.

I do not think you have to worry about this. What is important for the I-485 form is your wife last entry and non-immigrant status of last entry into the USA, non-immigrant visa number, port of entry. Previous stays, overstays will not mater.

Employers quite OFTEN are interested in and they indeed base their hiring decisions on the basis of ethnic origin or birthplace. it is illegal but it happens all the time.
