Topic: making money in different field while 485 is pending

You can work anywhere in any capacity as long as you have EAD. However, at the time of your 485 adjudication, for some reason you receive a RFE on the employment, then you need to produce one. Therefore, while I would take up any job to sustain myself, I will keep looking out for a similar job described in 140 petition.

Topic: 14yr old kid did not get GC, only principal and spouse did.

I am somewhat in a similar situation and here is where I stand :

Primary, Wife and Daughter Approved on April 30th. (CPO).
Son : No update.

My Son is 9 and daughter is 5.

Received Cards for Primary and Wife and welcome notices for all three 6 days after approval. but no card for my daughter. No status change for my son as well.

I waited for a week and called TSC : I was told that they are sending out an internal email to find out why my daughter's card was not sent, Again : No update on my son, as they say case is still pending.

I called TSC today : exactly 4 weeks after the approval. An extremely rude lady whose only desire was to just hang up the phone somehow managed to take my daughter's receipt no and said again : Sending out an email, and wait on. For Son, she was not even ready to take the number and insisted I call their customer service and take out an SR. I am reluctant to call their customer service number as they have no idea there what to do, and just read out from a pre-formatted text.

I hung up and called again and got another IO who was a lot sober : She took time to find out about my daughter's case and verified that biometrics are in and dates of approval, confirmed if there were any other issues including our address. Everything seemed all right and she said she is initiating something called a "Card Push" and that the card should arrive within the next 3 weeks.

About my Son: She checked again said that his case is still pending, and she was initiating an email to adjudicate the case, as its possible that it was just overlooked. Everything seemed to be in place for an approval. Therefore, if I interpret this right, they just FORGOT that there was ALSO an application of my son along with ours.

In both cases : Wait for another 30 days and call again.

I think I dont have much choice to wait and see what happens. I find it difficult to understand how could they just leave out a case completely, and forget about producing a card for the other.

However, I have seen that calling helps. Call multiple times to get a sober human who would give out the right information. Amazing but true. :)

dds4GC,

Congrats.....You are Green. This is exactly how it was done my case too. .Soft LUD on I140 and CPO status on 485 on the same day.

Six days later I received my cards and welcome notice in the mail. I went on to change my DL, SSN status and even till date my I140 shows pending. They are careless in updating the status correctly as per their actions, therefore I learned not to read to much into it. I am yet to receive my children's cards.

You are fine as long as you have the CPO status. Make sure you keep your lawyer informed of everything.

So go have a drink and await your cards in the mail. They are on the way.

As far as my knowledge goes, you are eligible to claim unemployment benefits only when you are citizen or a GC holder. You might want to check with your lawyer to be sure.

I am on a similar boat too.

Primary and my wife approved and card received. Received welcome notice for my daughter but no card, and my son's case is still pending.

I checked with my lawyer and was advised to wait for a while as in many instances they find problems with fingerprints or medicals or birth certificate. I doubt that could be the cause in my case as I have made sure all documents are in order except for the medicals, as the are pre-sealed by the service provider. However, my lawyer assures not to worry as sooner or later it will be done as since they are derivatives.

SUMPI - We had a small chat earlier. With an employee strength of 150, you are well Above any minimum eligibility that the recent administration has started talking about. It is indeed true and very frustrating that a lot of folks get away with it in this category. Its a rather clogged system where its difficult to determine who is actually genuine. Therefore an the right paperwork is extremely important, which can help a lot a smooth process. EB1C is an eligibility criteria if truly followed to the tee, then we will have a lot less folks in the que.

Anyway, back to reality : If you are over 300 days and counting, then you are also over the current "published" processing dates. You should be making some noise if you have not made already. Call TSE, take out a SR, Infopass.....meet the Congressman with your case..it makes a good example or a case for him to take a stand on this.. Calling helps too....so get on with it..!!!

Good luck to you, and I am sure you will see an approval soon but make sure you make some noise.

I talked to my lawyer today. He says that you wait it out for a while and if it does not happen in about a couple of weeks or more they will call USCIS for an update. BUt i think I should do it as well. Meanwhile, I rechecked and find that my daughter's application too is pending. Just a LUD. I had thought that they had ordered her card production...... So now I have a LUD for my daughter and nothing for my son. I just hope they get it done........i don't feel so good with my little ones hanging out....

My son is 9 and my daughter is 4.....so still too young to get adventurous SUMPI....:). And for your case, I see that you have just sent your RFP recently and I am sure you will get your approval anyday now. Your dates are way over the current processing dates. Make calls.....thrice a week at least.....they will do it I am sure....

Do you think biometrics for a 9 and a 4 year old could create problems ? I remember when we did finger printing, they took a whole lot of time for my kids to ensure that their prints came out fine. But you can never know....

Got the CRIS email this evening...."Card Production Ordered"....I have 4 cases..that is me, my wife and my two kids....But got only two emails...

Anyway,

- Checked online and see that LUDs in all my cases except for 485 for my son. Me, my wife and my daughter's case showing "Card production ordered"

- I140 - LUD on the same day but still shows "case received and pending".....

Any thoughts ? Should I sit tight or make some calls ?

Strange is the working of USCIS. From whatever I have learnt, Name Check should not take more than 24 hours give it one week at the max applying general administrative logic. Indeed 5 months is definately unusually long. But how do you know its pending for 5 months ? Is there a way to check / track ? I dont see anything on the portfolio side of where you track your cases. Do you get an update there ?

I was just told by my lawyer, that EAD is not really linked to Fingerprinting. Its an independent process and starts from the date when the application is mailed.

Is that true ?

I did my fingerprinting recently and then saw a soft LUD on my 765 the next day. So was wondering.

Yes, this makes sense. I presume this is a procedure they follow with their criminal record check. I can imagine how slow it might be working with governments of maybe 100 or more countries whose citizens are trying to get green card. It makes logical sense to get information from a centralized agency such as the Interpol.

I am curious. I had thought that name check and background check is only done in the US. Which is verficiation of a clean record here. I did not know they go back to the Home Country.

What do they exactly check with the home country ?

I guess anything is normal. We did our FP on the 10th. We immediately got soft LUD's in all our cases (485, 765 and 131) immediately the same day and the next day. Nothing has happened since then.

With your case I am sure they will work on your FP immediately. I am assuming that the name check happens when the FP is done. But with your I140 already approved, there are good chances that you could get your 485's approved soon. Some EB1C cases have seen very swift action.

Another thing, my original FP notices were returned back due to the change of address. It seems that USPS does not forward mails from USCIS. The notices were mailed again to the new address which they "already" had on file. It reached us on the 12th. 2 days after our FP date. My lawyer was sensible to FEDEX me his copies and I could do the FP with those notices.

Guess what Zaira..what i was fearing just happened. My lawyer got the notice and sent me a message. :) I ran to the post office to see if the mail had missed due to the change in my address and guess they are trying to sort if if that was the case. I hope to get it tomrrow, and have put a watch for it.

Folks,

Do you get a LUD (or last Update in your portfolio) when the USICS sends you a notice for Finger printing date / appointment ? And does your attorney get that advice too ?

I just changed my apartment and although I have updated my addresses online, and forwarded my mail from the post office I am a little skeptical about missing out on the mail.
