It is the question that says: Current Immigration Status: (Visitor, Student, etc.)
Again, my H1B is expired so I cannot use it in the second question. I am in adjustment of status - EAD only (I did enter on H1B though)

Topic: Ead renewal - specific question
I want to renew my EAD online.
At some point I need to choose from a drop-down list an item for "Current Immigration Status"
My H1b visa has expired (not renewed), I am only on EAD. What type of visa should I choose there?
I don't see anything in there that will fit for my case.

Topic: EB3 to EB2 change
Short answer: No.
In order to obtain such transfer you have to start the whole process all over again, beginning with Labor Certification, then a new I-140 etc.
Also, your current job description should be somewhat different from the old one (wages included) suitable for an EB2 process. Your new degree is relevant only if is related and used to your position.
The only good news is that you can carry over your old priority date (April 2004) to the new process.
Consult an attorney before you jump into it. |

You can not!
However, you can start everything all over (labor, I-140, I-485) and consider the priority date from the first application(EB3). At least that will save you some waiting time. |

Guys,
Why on earth do you think the person who answers your inquires is smart, well prepared, passionate about his/her job etc???
If they were so, they wouldn't be doing this from the first place.... After all, what is rewarding in such job? Money? I seriously doubt it... Career? Duh!
Like any average (American) employee, they just try to get their wage with as little effort as possible without upsetting the manager.
They don't know about the drama behind each case they handle. And frankly, I don't think they would care, anyway..... |

I'm not sure I'd buy that... What if they simply run out of visas? What difference does it make wether your finger prints expire or not?
I think in your case the IO wanted to seem nice and give some hope just looking to your PD.. (Gosh, 2001 - how did you resist all this waiting??? )

wait!!! don't give him wrong advises.. you can't have 2 statuses. If you get ANY visa your GC will be considered abandoned. You have to chose: GC or diplomatic visa.
I don't think so. Below is the reasons one may loose GC, according to USCIS. It is possible that they would refuse to issue a diplomatic visa or at least rise their eyebrow...They may also ask questions about next job, like if it follows the specs from the original labor certification etc. I would talk to an attorney first.
Maintaining Permanent Residence:
You may lose your permanent residence status if you commit an act that makes you removable from the United States under the law in section 237 of the Immigration and Nationality Act. If you commit such an act, you may be brought before the immigration courts to determine your right to remain a Permanent Resident.
You may be found to have abandoned your permanent resident status if you:
- Move to another country intending to live there permanently.
- Remain outside of the US for more than one year without obtaining a reentry permit or returning resident visa. However in determining whether your status has been abandoned any length of absence from the US may be considered, even if it is less than one year.
- Remain outside of the US for more than two years after issuance of a reentry permit without obtaining a returning resident visa. However in determining whether your status has been abandoned any length of absence from the US may be considered, even if it is less than one year.
- Fail to file income tax returns while living outside of the US for any period.
- Declare yourself a “nonimmigrant” on your tax returns. |
Topic: Diplomatic visa versus GC?
You can keep the GC once you get it. (I would wait for it....)
I don't really get the "diplomatic visa" part. You are still a French citizen and therefore your diplomatic visa has to be issued in that manner. There is no connection between the two.
However, you need to live in USA a certain amount of time (I believe it is at least 6 months every year) in order to preserve your US permanent resident status.
