Topic: Pending I-485 to F1 status

Have her check with a good lawyer. I was on F-1, filed for 1-140 once my labor certification got approved. My lawyer kept assuring me that I could transfer back to F-1 if it got denied. It was denied, I have changed lawyers and now my lawyers are telling me, I am not eligible for F-1 because I have shown intent to migrate. I couldnot even apply for OPT, so I am hoping my MTR will go through, very bad position to be in.

This is encouraging. I see that you had some A2p issues. What was your specific situation and how did you deal with it. My 1-140 was denied based on ability to pay. We submitted MTR November 10th and have not heard back. Please let me know, really anxious.

I agree with Wasilm: I also had worked part time for some part of the year. We submitted this information , clearly indicating that the rate per hour exceeded what I would have made had I worked for the whole year and they denied it. You have to show that the company had the funds to meet the difference between the proferred wage and what you were paid. You can do this by showing that the company's income or the net assets equal or exceed this difference. Please get advise from a good attorney. My old attorney convinced me that the first approach was good enough and now I am facing many anxious months waiting for a response from the MTR

Topic: Securing H1B renewal appointment in US consulate in Canada

My attorney told me that Mexico will no longer be renewing H1Bs if the initial one was not issued by them. Has anybody heard about this. I am told that Canada is hard these days since we have to wait 5 business days. Any idea if both of these are true?

Has anybody been to Canada for H1B renewal laterly. I remember seeing some where on this chat room that it takes 5 days but my laywer says not necesary. Also has anybody been there to extend H1B while their 1-140 is in appeal? All help appreciated

Topic: Motion to Re-Open receipt

I filed for MTR but the receipt sees "Notice of Appeal" so does that mean that they have not re-opened my case and instead have just sent it to appeal. My lawyer had said that we didnot want to ask for the appeal option because it takes long and that we just had to ask for MTR, so they either will deny or accept that. Can somebody please advise how a Motion to Re-open receipt should read.

Yes, you can show ability to pay with net current assets, if those are equal to the proferred wage or if they meet the gap between what was paid out in salary and the proferred wage.
