You can try this too! This is indeed a tried and tested successful method!

How to find out your current PERM status.

OK, let say your A number is A14281-12345

1. Find an approved case with an A number close to yours (I use DolStats.com).
2. If the number found is smaller e.g. A14281-12340 then subtract this number (last 5 digits) from yours and you get +5. If the number found is larger e.g. A14281-12349 then subtracting this number from yours you get -4
3. Click the the iCert link for the case you found in step 2 and view the case details.
4. Edit the URL. The last ID in the url is some internal ID used for the PERM cases but it is sequential. So your 'internal' case number is this ID number plus/minus the value you calculated in step 2.

If you see a bank case with no data or default values it means your case hasn't been processed yet.
If you see a case with correct values it means you case has been processed. Now, if you can also see your case in PermTracker.com or DolStats.com then your case has been approved. If you cannot find your case then it has been denied or sent to audit.

H1b cap exempt means, Normal H1B only but you have to choose CAP Exempt in I129 form.
It will not be considered under yearly quota.
(Apply anytime and start to work immediately upon approval )

Section 3, 1. Specify the type of H-1B petition you are filing.
(select only one box): d. CAP Exempt

You can apply I-140 Premium through Consular Processing only (while in India).
If I-140 is approved then you can apply H1B Premium/Regular (H1B CAP Exempt).
No need to worry about old H1B. you will 3 yr extn.
I did the same without any issue.

If your perm job requirement says as Master or 5+ Yr Exp required then you can claim for EB2.
Otherwise no.

During I-140 process, EB2 or EB3 is decided based upon your perm job requirement.
If I-140 premium is denied, you can file 2nd I-140 in Regular mode within 6 months of perm approval date.
Verify the above items with your attorney.

I thought of filing H4 EAD Myself. (Very simple process)
But I was filing with H1B Premium process so i went through Attorney.
Got H4 EAD card within 15 days.

karthiksubbu is correct.
H1 Extn is eligible based upon either pending Perm with 360 days or Approved I-140.
Not for Approved Perm.
Even if you maxed out H1B 6 years still you are eligible for 3 years H1B extn using Approved I-140 under CAB exempt.

I think, you applied H1B Extn along with H4 Extn.
If you do apply H4 EAD before getting H4 extn approval then you will get H4 EAD with validity as current H4 expiry date.

Recently one who got EAD with just 2 month validity date due to current H4 expiry date.

Changing employer means, you need to file H1B transfer petition. (beyond 6 years in H1B period then you need valid I-140).
you will receive new H1B expiration date upon approval (may be one to three years).

For future H1B extn or transfer, you need valid I-140. (you can not use revoked I-140)

If the current proposed rule is implemented then you do not need valid I140 for future H1B extn or transfer.
But need valid I-140 for filing 485.

1. What is the validity period of PIO (now considered OCI cards)?

Pios are now deemed to be OCIs and valid for lifelong.

The existing PIO Cards are now valid for life of the holder. All the immigration offices have duly been informed by the Government of India that they should affix a ‘Lifelong’ stamp as and when the holder of a 15 year validity card enters/exits any Indian Airport. If the Immigration Officer does not affix the stamp you should ask for stamping “Lifelong” stamp on the PIO Card. Until new rules are in place endorsement on PIO cards continues.

PIO Endorsement - New Passport is no longer available. so you cannot do that.

You can get lift time validity stamping in pio card at port of entry in Indian airport.

Instead of life time stamping ( i am not travelling this year), so i applied and got oci card by surrendering pio card using new passport (old one expired).

Processing time 2.5+ months.

sorry for your situation.

My friend had a similar problem like you.
After that rfe, He got a new experience letter from previous employer.
But USCIS refused to accept that new letter.
His petition got denied.
Reason stated as USCIS will only accept additional evidences which are created before rfe date.

Luckily he applied another I-140 (regular process) with new exp letter. Recently his petition got approved .

Getting new exp letter won't work for this rfe.
Try to provide some other documents which are dated before rfe date.

If your I-140 approved (irrespective of your current location India or US), your new H1B comes under CAP Exempt.
No need to wait for 365 days.

Q3 Ans. Yes. You can file I-140 while staying in India. (GC means future employment. So No need to be in Payroll)

Q4 Ans. For applying new H1B, Option 1 - using Pending Perm LC with 365 days Old (Not Approved LC) (under existing Quota. Cap Exception). Option 2 - using Approved I-140 (under existing Quota. Cap Exception). Option 3 - Staying Outside US for more than 365 days irrespective of Perm status. new H1B under new Quota (Cap limit)
