Topic: 7th year H1B extension with previously filed LC

Hi,

I have an approved but expired Labor that was filed from my ex-employer (in 2006). I am currently on 5th year and my H1 is with new company. This new company hasn't yet filed for LC and my 5th year get completed in 03/09. My question is would I be able to get a 7th year extension using my previously filed labor (from ex employer) although that is expired and in case if this new company is unable to file new labor before 365 days?

Experts please help!

Firstly, I think the inquiry letter you wrote is bit length, you might get 2 lines response saying, please provide requested documents to avoid delay in processing or something.

TOEFL doesn't work, nor does US Masters degree or being resident for several years count, as long as you are an immigrant they strongly suggest you provide ielts exam.

Trust me the exam is real simple, not even close to TOEFL. You should visit nearby state and take up the exam rather than taking a chance if you are serious.

Give them the copy of enrollment record from your school showing the credits you are currently enrolled for and prior semester's gpa record. I think you should get that from the registrar (Official / Unofficial transcripts - which would be incomplete if you are still graduating). - I think this should prove you have been in US for more than a yr. If possible, get a letter from your professor saying you'd been studying in X univ. from past y years (as an additional proof)

Did your check get encashed & when? Usually that a good way to anticipate the AOR month by looking at the history of people who got their check encashed and couple of months later got the AOR..

Topic: Cover Letters

Just give a breif description of you and your dependent's educational qualification and professional experience. Make sure it is short and crisp and not more than 2 paragraphs or one page.

Including the checked checklist is more important than the cover letter. Cover letter is optional.

Topic: Question: should spouse apply independently or with me as a dependent?

Do you both have same NOC code? anyone who has a NOC code that is in demand (ex: IT) is better to be a principal applicant according to me. If NOC code are the same, go for whoever works in a bigger firm.

Yes, because I did not put N/A in sections which were not applicable in schedule 1 form (section 13,14). They asked me to CORRECT and re-submit it. It is frustrating to wait for 2 months before you know your application will be returned due to missed n/A
