You can land on a pony for all they care! :-) The issue is not how you land, but that you land. Canadian border crossings have facilities for people who walk or cycle, so you can land without a car. Some people might even take a public bus to the border. Good luck! |

PS. I think you need to realise that applying for both US and Canadian PR is pretty risky, as others have noted on here. I do not want to scare you, but I am not sure you understand the implication of applying for both US and Canadian PR. Customs officers in the US might want to know what your plans are if they see your CORP (confirmation of permanent residency - a stamp in the passport that says you are a Canadian PR) and then see on their computer that you have applied for US PR. If they do not like your answer, they have a legal RIGHT to deny you access to the US, which means travelling back to your home country or a third country to apply for an H1B stamp. So be polite and friendly, answering all their questions calmy and without a bad attitude. You will need to think about an answer for the issue of dual PR status, if they ask you about it. Their main concern is that you are not entering the US to overstay your I-94. If your I-94 has a good few years on it, you should be OK. But you need to take responsibility for what you have decided to do and play by the rules. I sincerely wish you good luck,

It really is NOT complicated. Simple as this: as long as you have a valid I-94 (if your H1B ran out, it will be attached to the notice of extension, which is called an I-797) you can enter Canada or Mexico to visit only those countries and return to the US within 30 days. It really is as simple as that ... there is no need to get a new H1B stamp. You will need to take your original I-797 that your employer should have in his or her possession because it has your extended I-94 in the bottom corner.
When you land in Canada, let them take your OLD I-94 and then just staple in the I-797 I-94 for when you return. As long as you show the US customs your valid I-94, they will let you back in under the AVR rule.
I did this 2 weeks ago and it was fine for me. I landed at Windsor and came back through Port Huron.

While I agree it is problematic, I think we should not scaremonger on this site. I agree that US-CA PR is awkward, but it is not categorically forbidden. A decision will have to be made by the immigrant in the end, if it is not made by the immigration people on the US side. Take a look at this discussion for a more nuanced and informative answer:

Hi there, I am a UK citizen presently living in US (altho moving to Ca next week!) I had a similar issue to you. If you lived in the Greater London area, you need to go through the Metropolitan Police, which is the main form that CIC recommends. However, if you lived outside of London, you need to contact your local police office. Let me know if you were outside Gtr London and which city it was and I will find the details for you. It was exhausting to get this info for me and required a large number of calls to the UK, but I got it in the end. My sympathies. Good luck! |

I landed and came back with an expired H1B visa. If you are planning to go for US PR you might have some issues down the line as they do not like Canadian PR applying for US PR - I think it is about wasting time; not sure. Landing and returning with AVR is fine. But do expect the customs people in the US to want to know why you are back in the US if you have Canadian PR. They might be fine, but they could be slightly hostile with you. Personally, I do not think it is a good idea to go for Canadian and US PR at the same time, but that is your choice. Good luck! |

Basically, you can you it if you are travelling ONLY to Canada or Mexico for less than 30 days and do not travel anywhere outside of these countries. You will need to have an expired visa but a valid I-797 (extension of stay).

Hi again,
Yes, I returned to the US within a couple of days. I drove to Toronto in my own car and put the car on the GTF list. The Canadian customs officer asked for my address and I gave a friend's for the PR card to be sent to. They did not ask if I was going back to USA so I did not tell them. I returned to the US through Port Huron on the AVR rule as I have an expired H1B with a I-797 notice of approval until 2010. I had read on other forums about what to have so I printed out the AVR rule so I could show them (but they all knew what it was); I printed a copy of my resignation letter; I attached my I-94 from my I-797 to my passport AFTER I was in Canada (so they could take my expired I-94 if they do wished - they did not); I kept the original I-797 with me to prove I had an extension of my H1B visa; I also had my new Canadian bank card and my apartment contract for Toronto. I wanted to prove that I was only back in USA as a Canadian PR to sort things out and would leave on August 15th. They did not ask to see the papers I had, but they made me see an officer about getting an I-94. As I planned to go back to Canada they told me they would not issue an I-94. One piece of advice he did give me was that on my way out of the US to Canada for good I should stop at US customs and tell them I am leaving so that they can change their records - it will stop me being pulled over when I return to the US as a visitor.

Yes, it is because you are from the UK - I was the same. You are classed as England, Scotland or Wales. Try that on eCas and you will be fine. I had the same problem. |
