Topic: Public Charge and I 485
I got my GC on June 2008 and my wife got her's on July 2008, why not together, because I was foolish I said YES to public charge which was actually not public charge. They send a RFE for my wife when I got my approval.
As from my past post my wife did take some assistance and i said those to my lawyer, and my lawyer did not not any stuff and calls himself a Immigration lawyer and he is one of the famous dude in Maryland and Virginia.
Please read below and answer yourself, according to me you need to answer NO but put forth this document from the link below and talk to your lawyer, in my case i have to gather all this document before I approached my lawyer to answer the RFE. I know people who lived on Food stamp and got their GC.
Also you wife took benefit not subject to Public charge, read below
Benefits Not Subject to Public Charge Consideration
Non-cash benefits and special-purpose cash benefits that are not intended for income maintenance are not subject to public charge consideration. Such benefits include:
• Medicaid,
• Children’s Health Insurance Program (CHIP),
• Food Stamps,
• the Special Supplemental Nutrition Program for Women, Infants and Children (WIC),
• immunizations,
• prenatal care,
• testing and treatment of communicable diseases,
• emergency medical assistance,
• emergency disaster relief,
• nutrition programs,
• housing assistance,
• energy assistance,
• child care services,
• foster care and adoption assistance,
• transportation vouchers,
• educational assistance,
• job training programs,
• and non-cash benefits funded under the TANF program.
Some of the above programs may provide cash benefits, such as energy assistance, transportation or
child care benefits provided in cash under TANF or the Child Care Development Block Grant
(CCDBG), and one-time emergency payments under TANF.
Since the purpose of such benefits is not for income maintenance, but rather to avoid the need for
on-going cash assistance for income maintenance, they are not subject to public charge
consideration.
Criteria for Public Charge Determinations
The proposed rule states that an alien’s mere receipt of cash assistance for income maintenance, or being institutionalized for long-term care, does not automatically make him or her inadmissible, ineligible to adjust status to legal permanent resident, or deportable on public charge grounds. The law requires that INS and DOS officials consider several additional issues as well. Each determination is made on a case-by-case basis.
Admission and Adjustment of Status
Before an alien can be denied admission to the United States or denied adjustment of status to legal permanent resident based on public charge grounds, a number of factors must be considered by INS and DOS, including: the alien’s age, health, family status, assets, resources, financial status, education and skills. No single factor -- other than the lack of an Affidavit of Support, if required --will determine whether an alien is a public charge, including past or current receipt of public cash benefits for income maintenance.
Deportation
The INS can deport an alien on public charge grounds only if the alien has failed to meet the benefit-granting agency’s demand for repayment of a cash benefit for income maintenance or for the costs of institutionalization for long-term care. INS may initiate removal proceedings only if the benefit-granting agency has the legal authority to demand repayment and has:
• chosen to seek repayment within five years of the alien’s entry into the United States; • obtained a final judgment;
• taken all steps to collect on that judgment; and
• been unsuccessful in those attempts.
Even if these conditions are met, the alien is not deportable on public charge grounds if the alien can show that he or she received public cash benefits for income maintenance or was institutionalized for long-term care for causes that arose after entry into the United States.
Other Public Charge Clarifications
There is no public charge test for naturalization.
Public charge is not a factor in whether a non-citizen can sponsor a relative to come to the United
States.
Benefits received by one member of a family are not attributed to other family members for public
charge purposes, unless the cash benefits amount to the sole support of the family.

I just came across this section in the Immigration Adjudicator's Field Manual on USCIS website.

There I read about this passage, its in chapter 20 section 20.2 item D.
"(d) Form I-140 Petition Must be Approved Prior to a Favorable Determination of a §106(c) AC21 portability request . (Added AD08-06)
On October 18, 2005, USCIS designated Matter of Al Wazzan, A95 253 422 (Jan. 12, 2005) as a USCIS Adopted Decision. This AAO decision established that a petition that is deniable (i.e. not approvable), whether or not the petition is denied 180 days or more after the filing of the adjustment of status application, cannot serve as the basis for approval of adjustment of status to permanent residence under the portability provision of INA § 204(j) . An un-adjudicated Form I-140 petition is not made “valid” merely through the act of filing the petition with USCIS or through the passage of 180 days. Rather, the petition must have been filed on behalf of an alien who was entitled to the employment-based classification at the time that the petition was filed, and therefore must be approved prior to a favorable determination of a §106(c) AC21 portability request."
Can some one decode this message for others whose I140 is pending and want to use AC21.

Why is it a difficult query, if you have a job then you can provide the client info and also the job description, but if u dont have a job then u cannot provide client info which will create issue in ur H1 approval.
The client letter and work order are 2 common thing USCIS are asking every H1B applicant no matter whether its new or renewal. | |  |  |

The Labor Cert was approved - I have a copy but doesn't say EB2 or EB3, though the I-140 says clearly skilled worker or professional.
What I'm sure is that the Labor Cert was done with EB2 requirements. I don't know neither my lawyer why the I-140 was approved as EB3.

Ok first thing first, do you have a approved I140 notice, check the right side of the document it will clearly mention in which category it was filed under. It will not say EB2 or EB3 but will say the following " 203(b)(2) Member of Professional w/Adv. degree or exceptional Ability".
If it says the above phrase then the best way to get the issue resolved is to talk to an IO .
I had the same issue even though i had I140's filed in EB2 category i later found tht the USCIS has placed me in the wrong category even though all my I140 was filed for EB2. But later the issue got resolved by talking to the IO, u will be lucky if its done by one calling I had to call several times to get this resolved, u can read my post i have it in Trackitt. | |  |  |

Topic: Labor Certification Details - for I-485 RFE
Go to this link and request your labor info using FOIA act. U will get your complete labor description in a month u will get a copy of ETA 750B please note NOT ETA 750A.
U can even email or fax or send them a snail mail. U do not need to fill out ur complete info in that request, your name, company name who applied for labor and approx date, if u have the file number or job title u can provide them.

Final note if u need to complete copy of ur I485 then u can file a FOIA with USCIS and that takes 8 months for you to receive it and that package includes everything from labor to I140 to ur I485 along with supporting documents. | |  |  |

A stands for Atlanta processing center (Perm cases)
P stands for Philadelphia processing center(Perm cases) but this one no longer accepts employment bases cases
D stands for Dallas processing center (Backlog cases)
C stands for Atlanta processing center (Backlog cases)
I think only Atlanta processing center accepts the PERM cases while the 2 P and D were for Backlog cases which has now been closed. and Recently they closes Chicago for any employment based labor cert | |  |  |

I'm one among the July 2007 filers. Recently first time on May 6th I got RFE. I tried to check with my lawyer whether he has received the notice or not. But he mentioned that it will take couple of week time to get delivered. My questions, quite obviuos as I'm curious on RFE, to this forum are:
1. Is it really that it takes couple of weeks time for RFE notice to get deliver ?
2. Any speculation on RFE like what it would be about etc
Takes normally a week or 2 to get it, in my case both lawyer and the applicant got a copy.
