Justification for 90 days effective date (copied from page # 52 of the draft): This effective date is intended to prevent an overlap of H-1B cap season and an initial filing surge of Forms I-765 under 8 CFR 274a.12(c)(26). As a result, USCIS will be able to implement this program in a manner that will avoid prolonged delays of processing other petition and application types, in particular those H-1B petitions seeking an FY 2016 cap number. It will also allow USCIS to maintain excellent customer service for all USCIS stakeholders, including H-1B employers, H-1B nonimmigrants and their families.

Page# 11111 is not merely a place holder, please check the volume 79 (2014 year), volume 78 (2013 year) with 11111. You will indeed find a rule that is on the page 11111. For your reference, see the below link to access federal register pages (citation search).

Please type the page number and select the volume to 79 or 78 etc.,

If the decision is pending from USCIS end means, officially he/she is still on H4 status. I didn't understand the part of bringing him/her back to H4 when he/she is already on H4. To cancel the AOS, while the application is pending, go out of the country. It will automatically cancel the COS. To avail OPT, one has to be a full time student for year (no part time in between) and on F1 by the time of filing I-766.

In my opinion, if he/she planning to graduate in Spring 2015, I will let him/her stay on F1 and avail the OPT without jeopardizing the F1 options by changing back and forth from F1 to H4.

To avail OPT option, one doesn't have to maintain one year of F1 status.

From the above link, you don't have to meet ALL the conditions to avail OPT, it is OK if you meet most of the conditions. In this case only TWO conditions. The reason why I am confidant is my wife availed OPT by changing the status from H4 to F1 in final semester. There are only two semesters in a calender year, summer semesters don't count. Apply COS in one semester thus that semester will count towards F1. In subsequent semester apply for OPT (it takes 3 months to get OPT EAD card). In this setup, you pay out of state fee in only the last semester (most likely one course- could be your project or thesis).

Feel free to ask any questions related to the OPT, I engaged in the same conversation with international department at GSU and successfully got through the process.
