Topic: Question on fingerprinting

Hi all,

I and my wife applied I-485 in Aug 2007 and got our fingerprinting done in Nov 2007. After that we never received any notice for Fingerprinting. Is that common?

In fact all my friends that I spoke to received notice for fingerpriting atleast two times after applying I-485 (in Aug 2007). Please let me know if I need to be concerned.

Thank you.

Topic: Mailing RFE reply

How do you all mail RFE replies?

USCIS mailed me an envelop to use for replying back to them, but all the supprting document will not fit into it.

I want to use USPS (Priority Mail) 1-2 day delivery in USPS provided flat rate envelop, is that fine?

Topic: After entering on AP, can I travel abroad again for H1B stamp

"You may travel on the advance parole without obtaining an H-1B stamp in your passport. You will continue to be eligible for extensions of H-1B status even though your most recent entry will have been as a parolee."

The above note is from my attorney.

Topic: I-485 RFE still not received

Hi,

My dependent's RFE letter was delivered 2 days after we received CRIS email. My dependent and Myself received the CRIS at the same time but I did not receive my RFE letter as of yet, neither my attorney received the RFE letter.

It has been almost 2 weeks. Should I wait, or should I contact USCIS regarding this?

Please let me know.

Topic: I-485 : TB Test RFE

Hi,

My wife got her TST done and it turned positive. The X-ray result is negative. The civil surgeon provided me with a new I-693 with details of TST and a radioligist X-ray report indicating that there is no TB, along with RFE letter and old I-693 - all sealed in an envelop.

So when I respond to the RFE, besides the RFE letter and the sealed envelop (provided by civil surgeon) do I have to send anything else?

Please let me know.

Topic: Used AP to enter US - Is H1 still valid

I agree. My company attorney conveyed the same message (below)

"You may travel on the advance parole without obtaining an H-1B stamp in your passport. You will continue to be eligible for extensions of H-1B status even though your most recent entry will have been as a parolee."

Topic: I-485 : TB Test RFE

I did ask the surgeon about the Xray. He mentioned that Xray is not necessary if TST turns negative.

So do you suggest going going for a Xray even if TST turns negative?

Also, he is not filling in the old I-693 returnred back by USCIS, the surgeon is submitting a new I-693, is that what happened in your wife's case as well?

Thank you.

Topic: I-485 : TB Test RFE

My wife took the TB skin test today. The Surgeon mentioned that he is going to submit a new I-693 as the one that was sent back by USCIS is outdated.

The surgeon asked her to come back after two days to examine the reaction of the skin test. If it turned positive then he wants to take a XRay.

Topic: I-485 : TB Test RFE

Folks,

My wife and I received the RFE letters today.

It is regarding the medical tests that were conducted when we submitted our I-485 application in Jul/Aug 2007. The letter indicates that TB tests were not conducted earlier and that USCIS requires the tests to be done. They also asked for a chest X-ray to be submitted.

They sent back my I-693 (medical test form) that I submitted and it was signed by my previous Civil Surgeon. I moved to a new address, can I go a Civil surgeon close by my new address and get the TB tests done and submit the form again?

Anybody received a RFE on TB Tests, please let me know.

Thank you.

Topic: RFE on I-485 While I-140 ammendment pending

Hi,

My wife and I filed I-485 and I-140 concurrently in July 2007 (during the rush time).

My new company has filed for I-140 ammendment as my old company that has applied the original I-140 and I-485 was acquired by another company. My first/original I-140 got approved in Dec 2008 but Ammended I-140 is still in pending status.

Last week I received CRIS email notifying that a RFE has been issued on both my wife's as well as my I-485. Still not received the physical letter and do not know the reason for RFE.

I am kind of tensed.

Any body in a similar situation?

Thank you.

Topic: Received a query for I-140 from previous company

My company was bought by another company while my I140 was pending. I got a RFE and the new company's lawyer has responded explaing the acquisition.

During the acquisition the new company has filed for an ammendment of I-140.

Consult an expert lawyer, in your case.
