Christmasbox, I have the letter in my hand now and this doesnt have a paragraph that says about appeal :(
It just has a "conclusion: It is concluded that the grounds stated for denial have not been overcome" and the next para
"Order: It is ordered that the original decision denying form I140 remain undisturbed"
Can i appeal at all now ? or its done with MTR and Reconsider??

In the denial letter of my first MTR, there are "conclusion:...", "Order:...", then "Right to appeal:..." and an attached empty I-290B copy. I saw a poster in another forum, an online lawyer mentions there should not be a limit for MTR/appeal times. You should double check with your lawyer about it.
Why not file another I290B for appeal? The worst outcome is that USICS will not accept this appeal and you will lose filing fee. But if they accept this appeal, you get extra time to plan your future.

I am sorry to hear your situation. I believe you can apply for second MTR or appeal. You can double check the denial notice for your first MTR. At the end of the denial notice, if there is "Right to appeal...", that means you can file another MTR or appeal. If there is no paragraph about "Right to appeal..." then you can not. In both Kazzuk and my case, when our first MTR were denied, they gave us the second chance to appeal/MTR. But if they deny the second MTR/appeal, they will not give you more chance (according to Kazzuk's experience.) Make sure to pick appeal option on I290B. If you pick MTR and address that appeal as an alternative in the statement, some officer will transfer the case to AAO as appeal case if they deny the MTR, but other officers will treat it as MTR only. Just got a call from a congressman's office in Arizona. According to the lady, our case was just assigned to an officer today. She also mentioned that everything else looked in order in respect to the FBI clearance etc. She also said that we should get a response within the next 2 weeks and also mentioned something about adjudication stage.
Any input would be greatly appreciated guysss..
Under adjudication stage means your case is on the table of a IO. It usually takes 2 days to 2 months to get a decision after the case is assigned to a IO, the average is 21 days. Pre-adjudication stage means that case is in the stoage room with other unassigned cases, which means long...long waiting. So it is a good news! |

It is not necessary to enclose the phone number, but address might be necessary. Here is a sample affidavit from my friend. Hope it helps.

they ask for affidait.pls help
My friend married a American husband, and she prepared more than five affidavits from their friends, coworkers and family members. Affidavits mention that they were very close friends coworkers to either/both of the couple, they attended the wedding ceromeny/reception, was maid of honor, bestman, and described in details when the wedding reception was, how many guests... how they know the couples, how many years they dated... Just everything in details, and more affidavits are better. Hope this helps. |

For my first MTR, I did see SLUD on denied I140, but no on denied I485 when USCIS received application I290B. Then I got two SLUDs on denied I140 only. Till 09/12/2008, I got a hard LUD on denied I140 saying "Denial notice sent. On 09/12/2008, we sent you a denial notice..." But no LUD on I485. There was a SLUD on I290B, but even now, that I290B still indicates "Case received and pending..."
For my second MTR, I did not get any SLUD on either I140 or I485 when USCIS received the second I290B. I got the first soft LUD on both denied I140 and denied I485 in the morning of 10/27/2008, but no context changes. Then around 8-9 PM of 10/27/2008, there was a hard LUD on denied I140, and the information changed from "Denial notice sent. On September 12, 2008, we sent you a denial notice..."to "Approval notice sent. On October 27, 2008, we sent you an approval notice..." Even till now, I haven't got any email notice about the approval.
There are SLUD on both I140 and denied I485 again on 10/28/2008, but the I485 information still same as June 30, 2008 when the I1485 was initially denied. "Denial notice sent..."

Finally, second MTR approved!
Update my case:
I 140 EB1b(NSC) denied: 06/30/2008, (lacking original permanent job offer letter and contract)
First MTR: received 08/01/2008, denied 09/12/2008.
Second MTR:received 10/14/2008, approved 10/27/2008.
Soft LUD on denied I485s of all family members on 10/27/2008.
I learned a lot and got so much helpful suggestions from this forum. For those who are still waiting for the MTR decisions, please hang in there. Your day is coming very soon. I will pray for everyone in this topic. |

Hi: I looked through your posts and didnot find the basis for which your 1-140 had been denied. I might have missed it. Can you please share. Mine was denied October 9 and I am just having it rough hanging in there and bing hopefully.

My I140 EB1b was denied because of lacking original permanent job offer letter. My lawyer did not want to submit the job offer letter because it indicated that my job is based on funding. Instead, the lawyer responded that I did not have original job offer letter. Furthermore, the lawyer asked the Head of my Department to write a letter saying my job is permanent. The officer didn't accept the Head's letter as original job offer letter and denied my first MTR. On second MTR, we submitted the original job offer letter and the funding history. Now, what I can do is waiting.
If you haven't submit MTR, you should try. At least, it is another chance. |
